ANALYSIS: All properties abutting 1013 Highway 80 are zoned C-2. The uses to the north, east and west are residential.A commercial business operates to the south across 4-lane Highway 80.The proposed conversion of the existing single-family dwelling to a mixed use building is in keeping with the C-2 Highway Business District as outlined in Section 4-050(F): The purpose and intent of commercial districts is to provide central locations for city businesses and services to meet the market needs of Tybee Island residents and visitors. The focus of the C-2 highway business land use district is to provide for commercial land uses that support and complement the motorized customer. C-2 districts are intended for location along arterial streets where the negative impacts of traffic congestion, noise, intrusions into residential neighborhoods will be minimized. The Character Area of the locations is the Arts, Eats, and Eco-Business Corridor.The following table compares the proposed mixed use project with the Recommended Development Strategies of the Comprehensive Plan. Y 1 The proposed Site Plan includes the Basic Requirements of Section 3-160, Protection Screening of Adjacent Property where Commercial Use and Residential Use Abut.The Parking Calculations as shown on the Site Plan are accurate.The required 8 parking spaces are provided. A drainage plan is needed for this project. Staff has deferred this upfront expense for the applicant until a Site Plan Approval decision has been made by City Council. The intent of the owner is to dry floodproof the ground level commercial use up to the required Design Flood Elevation (Base Flood Elevation plus 1-foot freeboard). This technique is allowed by FEMA for non-habitable structures. The Engineer of record has provided a preliminary Flood Protection Detail which has been attached to this Staff Report. If this project is approved by City Council, the commercial plan review for permitting will include a comprehensive check for compliance with all floodproofing and other applicable construction codes The City of Tybee Island requires an Emergency Plan to be on file for dry floodproofed buildings within the city limits. Also, a document stating the building is dry floodproofed must be recorded by the property owner with Chatham County so any future potential buyer is aware of the dry floodproofing aspect of the structure. If Site Plan Approval is granted, the applicant has been advised by Staff that a recombination of Lots 14 and 15, and portions of Lots 13 & 16 is required prior to a Certificate of Occupancy being issued for the building. The applicant has been advised the existing sign located in the Georgia Department of Transportation right-of-way needs either to be properly permitted by GDOT or removed. STAFF FINDING Staff finds the proposed renovation of the single-family dwelling to mixed use does not violate the intent of the Comprehensive Plan. The proposal is in keeping with the purpose of the C-2 district. The off-street parking plan meets the requirements of the Land Development Code. This Staff Report was prepared by Dianne Otto. Parking spaces 8 & 9 do not have sufficient maneuvering area behind them. Relocation in their general area, widening the spaces, increasing the width of the drive lane south of them and/or possibly angling the spaces should resolve this. 2. The site drains to the rear (north) with the permeability of the open graded stone being the only protection against increased runoff onto the rear of residential properties to the north. This stormwater management feature will require design and detailed plans with supporting hydrology report, both prepared by and bearing the signed seal of a professional designer licensed in Georgia to provide such services. 3. The inside radius of 10' at the exit drive appears more restrictive than necessary. Turn templates or other method of supporting this design feature will be required on the final plans. There is room for wider pavement in this area. This is not a full engineering review as there are no plans or documents to allow such review. As there are no major engineering challenges, it appears that this project can be designed to meet City Code. I agree with this 1 project being allowed to address the more technical design requirements after site plan approval is given by the City Council and before construction is permitted.
