I am working with Danny Brannon and the Town of Gulf Stream on the Utility Undergrounding Project.
I am attaching the easement documents that were sent to Susan Phillips for your information.
I am also attaching the Declaration of Condominium found on the Public Records of Palm Beach County. The Condominium property is described in Exhibit A of the Declaration at ORB 2133
PG 741. I would also call your attention to Item 1 on the first page of the Declaration at ORB 2133 PG 725 and to Item 2.4 on the second page.
Item 1. states, “The real property described in Exhibit A shall be condominium property and is hereby submitted to condominium ownership.....”
Item 2.4 states, ““Common Elements” means the portions of the condominium property not included in the units.” Exhibit C2 of the Declaration describes the Units. Units 1 – 4 are shown
in the North building which faces Sea Rd, and Units 5-8 are shown in the West building which faces Bermuda Ln.
From the above I believe it follows that the area of the easement being requested for the Town’s utility undergrounding project is in the Common Elements of the Condominium and therefore
owned by the Condominium. The condominium is incorporated (see ORB 2133 PG 750 in the attached), so doesn’t the easement need to be executed by the corporation, i.e. BERMUDA CLUB OF
GULF STREAM, INC. and its authorized officers?

My name is Suzanne Smith and I work for the Property Manager of the Bermuda Club 3883 Bermuda lane, Erik Smith.
We were forwarded a letter from the President of the association Susan Phillips that has to deal with the easement for Bermuda Club on Bermuda Lane.
All the residents of the Bermuda Club are at the northern address, there is no one on site until season starts. I am not sure if this letter was sent just to the President but she lives
on the Sea Rd side which is not affected by this letter.
I wanted to give you the addresses and email for the 4 residents who do live at the Bermuda lane addresses so you can mail this directly to them for their signature. Please let me know
you got this email. If there is anything else I can do to assist you. The president did not want to sign off on this since it asked for all people listed on the deed and she is at another
apartment. If you have anything else you may need to speak with the property manager about our office # is 561-272-7748. Thank you Suzanne

We are writing to update you on the progress of the Town’s overhead utility undergrounding project and request your assistance in making this project a success. We have been working
with the various utilities to complete the design of the new underground systems for construction of Phase 2. Your property located at 3883 BERMUDA LANE, Gulf Stream, FL falls within
our Phase 2 which extends from Golfview Drive northward to Little Club Road. We are very excited about moving forward with this second and final phase of this important community
improvement. Over the next few months, the existing overhead power and communications lines in this area will be replaced with underground systems. Many transformers and other utility
devices will need to be placed on private property. The Town is required to obtain the necessary easements from the property owners as needed to accommodate utility transformers and
other devices that cannot be placed within the road right-of-ways. Enclosed you will find easement documents, flagged for your signature, which need to be signed, witnessed, notarized
and returned. These documents include an Exhibit “A” with sketches showing the locations of the easements on your property as well as a legal description of easement area. Also enclosed
is an instruction sheet that will answer several common questions relative to executing the documents. Our current plan is to begin construction on Phase 2 in the fall of this year,
but this is dependent on the timely return of all properly executed easements. We encourage you to return your signed and notarized easement documents by August 21, 2015. A self-addressed,
stamped envelope is enclosed for your convenience. However, if you have recently sold the property, please let us know so that we may contact the current owner. Every effort has
been made to keep the location of the new underground system components as unobtrusive as possible. The Town will make every effort to ensure that your property is treated in a careful

and Return the easement to Danny Brannon. This easement needs to be delivered to FPL prior to energizing the proposed underground facilities. Signing and Witnessing: A. For Individuals:
All persons shown on the deed must sign the easement. Enter date in space provided. Sign on the indicated lines on the right side in the presence of two (2) separate witnesses, who
sign on the lines to the left, and a notary public who completes the acknowledgement forms as described below. The notary public may be one of the witnesses and if so must sign at the
left in the space provided. B. For Corporations: Enter date in space provided. The President, or Vice-President and the Secretary or an Assistant Secretary sign on lines indicated
on the right, filling in their title below, in the presence of two (2) separate witnesses, who sign on the lines to the left, and a notary public who completes the acknowledgement forms
as described below. The corporate seal must be affixed adjacent to the officer's signatures. Notary Public Acknowledgements: The notary public should legibly fill in all blanks, including
state and county of execution, names of individuals or officers signing and their titles, state or county where empowered to act, expiration date of commission, fill in date, sign on
line provided and affix seal adjacent to the signature of the notary public. Return the Easement to Town Hall: Upon executing the easement, the property owner should mail it Danny
