RESOLUTION NO. 22-076
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF OPA-LOCKA, FLORIDA, APPROVING THE
RECOMMENDATION OF THE INTERIM CITY
MANAGER TO ISSUE A SPECIAL CERTIFICATE OF
APPROPRIATENESS FOR THE STRUCTURE AT 1145
SHARAR AVENUE, WITHIN THE CITY, TO ALLOW FOR
THE INSTALLATION OF FIVE IMPACT WINDOWS
AND ONE IMPACT DOOR ON THIS REGISTERED
HISTORIC PROPERTY; PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the City of Opa-locka, Florida, has established a Historic Preservation
Ordinance, and established the Historic Environmental Tree Preservation Board by
Ordinance 16-13 in order to preserve and protect the City's historic and cultural heritage
and to foster civic pride; and
WHEREAS, the Historic Environmental Preservation Board was also established
to protect the green environment and preserve the trees in the City in order to support
Arbor Day principles; and
WHEREAS, as required by Miami -Dade County in order to maintain a separate,
independent Historic Preservation Ordinance, the City practices a fully functional
process and has adopted Ordinance 2022-02 to establish minimum standards for
municipal historic preservation programs, as set forth in the Miami -Dade County
Historic Preservation Ordinance Section 16A-3.1; and
WHEREAS, the Historic Preservation Ordinance permits issuance of a Special
Certificate of Appropriateness for a building permit to allow for the installation of five
impact windows and one impact door on the structure at 1145 Sharar Avenue, within the
City, after an approval recommendation by the Historic Environmental Preservation
Board, and review and approval by the City Commission in accordance with Ordinance
2022-02; and
WHEREAS, on November 17, 2022, the Historic Environmental Preservation
Board met to discuss the instant project and to consider a request for a certificate of
appropriateness approval for the structure at 1145 Sharar Avenue, within the City, to
allow for the installation of five impact windows and one impact door on this registered
historic property; and

WHEREAS, the instant project was not presented, however due to lack of quorum
of the Board; and
WHEREAS, pursuant to Ordinance 15-03, in the absence of a quorum of the HEPB
the City Manager may issue Regular or Special Certificate of Appropriateness, subject to
a majority vote of the City Commission; and
WHEREAS, the Interim City Manager recommends issuance of a Special
Certificate of Appropriateness on the structure at 1145 Sharar Avenue, within the City,
as described herein; and
WHEREAS, the City Commission finds it in the best interest of the City and
residents to issue a Special Certificate of Appropriateness for the structure at 1145 Sharar
Avenue, as provided herein.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF OPA-LOCKA, FLORIDA AS FOLLOWS:
Section 1. The recitals to the preamble herein are incorporated by reference.
Section 2. The City Commission hereby accepts the recommendation of the
Interim City Manager to issue a Special Certificate of Appropriateness for the structure
at 1145 Sharar Avenue, within the City, to allow for the installation of five impact
windows and one impact door on this registered historic property.
Section 3. If any clause, section, or other part or application of this Resolution
is held by any court of competent jurisdiction to be unconditional or invalid, in part or in
application, it shall not affect the validity of the remaining portions or application of this
Resolution.
Section 4. Sections of this Resolution may be renumbered or re -lettered and
corrections of typographical errors which do not affect the intent may be authorized by
the City Manager following review by the City Attorney and without need of public
hearing, by filing a corrected copy of same with the City.
Section 5. This Resolution shall take effect upon the adoption and is subject to
the approval of the Governor or Governor's Designee.

ONE IMPACT DOOR ON THIS REGISTERED HISTORIC PROPERTY; PROVIDING FOR
AN EFFECTIVE DATE.
Staff Summary:
The City has adopted Ordinance 22-02 to establish minimum standards for municipal historic preservation
programs and in agreement with Miami -Dade County Historic Preservation Ordinance Section 16A-3.1.
The Historic Environmental Preservation Board per Ordinance 22-02, Section 2-570.84 (2) (B) Special
Certificate of Appropriateness: "For all applications for a special certificate of appropriateness involving the
demolition, removal, reconstruction or new construction at an individual site or in a district, a special
certificate of appropriateness is required that is issued by recommendation of the Historic Environmental
Preservation Board" and review and approval by the City Commission. The Historic Environmental
Preservation Board scheduled a meeting for November 17, 2022 to discuss current projects and to consider
a request for a certificate of appropriateness approval for the structure at 1145 Sharar Avenue to allow for
the installation of five impact windows and one impact door on this registered historic property. This
request was not presented to the Historic Environmental Preservation Board at the scheduled
November 17, 2022 meeting because of a lack of quorum. According to Ordinance 15-03 in the absence
of a quorum of the HEPB the City Manager is authorized to recommend the issuance of a Special
Certificate of Appropriateness as requested by the property owner.
BACKGROUND:
The City of Opa-locka established the Opa-locka Historic Preservation Board by Ordinance 81-13 for the
purpose of protecting and perpetuating properties worthy of historic preservation. The City adopted
Resolution 91-01 and Ordinance 91-02 to identify the properties in the City that were deemed outstanding
examples of Moorish architecture, that were built based on the original plans as designed by its founder,
Glenn Curtiss and to establish a list of properties that meet the requirements for being of historical,
cultural, architectural and archeological significance which included the property at 432 Opa-locka
Boulevard. The City Commission has determined that it is in the best interests and welfare of the City of
Opa-locka and its residents to enact an ordinance that establishes a board that performs the functions of
both the Historic Preservation Board ad the Environmental Tree Board. The City established the Historic
Environmental Preservation Board pursuant to Ordinance 16-13 on October 12, 2016 in order to preserve
and protect the City's historic and cultural heritage and foster civic pride. The Historic Environmental
Preservation Board was also established to protect the green environment within the City, especially, the
preservation of its trees in order to support Arbor Day principles. The Historic Environmental
Preservation Board held a meeting on January 28, 2021 to introduce new board members, establish Board
Chair and Vice -Chair, and to improvements to the HEPB. Pursuant to Planning & Community
Development Department Director & Staff meeting with Miami Dade County Historic Preservation Chief,
we received notice that independent municipal historic preservation programs were required to adopt the
minimum standards as provided by Miami -Dade County regulations, Chapter 16A-3.1. The City Historic
Environmental Preservation Legislation, Chapter 2 Article XI, Division 13, Sec 2-570.81 and Sec. 2-570.82
of the City Code of Ordinances concerning the composition, term of office, qualifications, organization,
meeting, records standards and established duties and responsibilities of the HEPB.
Financial Impact
The City will receive permit fees associated with ensuring the preservation of this building.

SCOPE:
This NOA is being issued under the applicable rules and regulations governing the use of construction
materials. The documentation submitted has been reviewed and accepted by Miami -Dade County RER-
Product Control Section 10 be used in Miami -Dade County and other areas where allowed by the Authority
Having Jurisdiction (AHJ).
This NOA shall not be valid after the expiration date stated below, The Miami -Dade County Product Control
Section (In Miatni-Dade County) and/ or the AHJ (in areas other than Miami -Dade County) reserve the right
to have this product or material tested for quality assurance purposes. If this product or material fails to perform
in the accepted manner, the manufacturer will incur the expense of such testing and the AHJ may immediately
revoke, modify, or suspend the use of such product or material within their jurisdiction. RER reserves the right
to revoke this acceptance if it is determined by Miami -Dade County Product Control Section that this product
or material fails to meet the requirements of the applicable building code.
This product is approved as described herein and has been designed to comply with the Florida Building Code,
includine the Hieh Velocity Hurricane Zone.

RENEWAL of this NOA shall be considered after a renewal application has been filed and there has been no
change in the applicable building code negatively affecting the performance of this product.
TERMINATION of this NOA will occur after the expiration date or if there has been a revision or change in
the materials, use, and/ or manufacture of the product or process. Misuse of this NOA as an endorsement of
any product, for sales, advertising or any other purposes shall automatically terminate this NOA. Failure to
comply with any section of this NOA shall be cause for termination and removal of NOA.
ADVERTISEMENT: The NOA number preceded by the words Miami -Dade County, Florida, and followed
by the expiration date may be displayed in advertising literature. Harty portion of the NOA is displayed, then
it shall be done in its entirety.
INSPECTION: A copy of this entire NOA shall be provided to the user by the manufacturer or its distributors
and shall be available for inspection at the job site at the request of the Building Official.

SCOPE:
This NOA is being issued under the applicable rules and regulations governing the use of construction
materials. The documentation submitted has been reviewed and accepted by Miami -Dade County RER-
Product Control Section to be used in Miami -Dade County and other areas where allowed by the Authority
Having Jurisdiction (AHJ).
This NOA shall not be valid after the expiration date stated below. The Miami -Dade County Product Control
Section (In Miami -Dade County) and/ or the AI-IJ (in areas other than Miami -Dade County) reserve the right
to have this product or material tested for quality assurance purposes. If this product or material fails to
perform in the accepted manner, the manufacturer will incur the expense of such testing and the AHJ may
immediately revoke, modify, or suspend the use of such product or material within their jurisdiction. RER
reserves the right to revoke this acceptance, if it is determined by Miami -Dade County Product Control
Section that this product or material fails to meet the requirements of the applicable building code.
This product is approved as described herein, and has been designed to comply with the Florida Building
Code, including the High Velocity Hurricane Zone.

APPROVAL DOCUMENT: Drawing No. W09-08, titled "Eco-Guard Series -100 Alum. S.H. Wdw.
(L.M.I.)", sheets 1 through 6 of 6, dated 02/12/09, with revision G dated 11/05/20, prepared by AI-Farooq
Corporation, signed and sealed by Jalal Farooq, P.E., bearing the Miami -Dade County Product Control
Section Revision Stamp with the Notice of Acceptance number and expiration date by the Miami -Dade
County Product Control Section.
MISSILE IMPACT RATING: Large and Small Missile Impact Resistant
LABELING: Each unit shall bear a permanent label with the manufacturer's name or logo, city, state,
model/series, and following statement: "Miami -Dade County Product Control Approved". unless otherwise
noted herein.
RENEWAL of this NOA shall be considered after a renewal application has been filed and there has been
no change in the applicable building code negatively affecting the performance of this product.
TERMINATION of this NOA will occur after the expiration date or if there has been a revision or change
in the materials, use, and/ or manufacture of the product or process. Misuse of this NOA as an endorsement
of any product, for sales, advertising or any other purposes shall automatically terminate this NOA. Failure
to comply with any section of this NOA shall be cause for termination and removal of NOA.
ADVERTISEMENT: The NOA number preceded by the words Miami -Dade County, Florida, and
followed by the expiration date may be displayed in advertising literature. If any portion of the NOA is
displayed, then it shall be done in its entirety.
INSPECTION: A copy of this entire NOA shall be provided to the user by the manufacturer or its
distributors and shall be available for inspection at the job site at the request of the Building Official.
This NOA revises NOA No. 18-1220.05 and consists of this page 1 and evidence pages E -I . E-2 and E-3. as
well as approval document mentioned above.

SCOPE:
This NOA is being issued under the applicable rules and regulations governing the use of construction materials. The
documentation submitted has been reviewed and accepted by Miami -Dade County RER -Product Control Section to
be used in Miami Dade County and other areas where allowed by the Authority Having Jurisdiction (AHJ).
This NOA shall not be valid after the expiration date stated below. The Miami -Dade County Product Control Section
(In Miami Dade County) and/or the AHJ (in areas other than Miami Dade County) reserve the right to have this
product or material tested for quality assurance purposes. If this product or material fails to perform in the accepted
manner, the manufacturer will incur the expense of such testing and the AHJ may immediately revoke, modify , or
suspend the use of such product or material within their jurisdiction. RER reserves the right to revoke this
acceptance, if it is determined by Miami -Dade County Product Control Section that this product or material fails to
meet the requirements of the applicable building code.
This product is approved as described herein and has been designed to comply with the Florida Building Code,
including the High Velocity Hurricane Zone.

Limitation:
1. See Single or Double Door Design Pressure (DP) ratings in sheet 2. See Single or Double Door DP ratings with
sidelites (w/wo Reinforcement) and Standalone Single sidelite rating in sheet 3. The max door leaf width shall
not to exceed 37". See locking options 1 & 2 in sheet 7_1.
2. Laminated glass types GI and G2 are limited to Kurarary's .090" Trofosil PVB and glass type G3 is limited to
Insulated laminated glass w/ Eastman Chemical's .090" Saflex interlayer.
LABELING: Each unit shall bear a permanent label with the manufacturer's name or logo, city, state and series and
following statement: "Miami -Dade County Product Control Approved", noted herein.
RENEWAL of this NOA shall be considered after a renewal application has been filed and there has been no
change in the applicable building code negatively affecting the performance of this product.
TERMINATION of this NOA will occur after the expiration date or if there has been a revision or change in the
materials, use, and/or manufacture of the product or process. Misuse of this NOA as an endorsement of any product.
for sales, advertising or any other purposes shall automatically terminate this NOA. Failure to comply with any
section of this NOA shall be cause for termination and removal of NOA.
ADVERTISEMENT: The NOA number preceded by the words Miami -Dade County, Florida. and followed by the
expiration date may be displayed in advertising literature. If any portion of the NOA is displayed. then it shall be
done in its entirety.
INSPECTION: A copy of this entire NOA shall be provided to the user by the manufacturer or its distributors and
shall be available for inspection at the job site at the request of the Building Official.
This NOA renews NOA #18-1220.11 and consists of this page I and evidence pages E-1, E-2 & E-3. as well as
approval document mentioned above.

A RESOLUTION OF THE MAYOR AND CITY
COMMISSION OF THE CITY OF OPA-LOCKA,
FLORIDA, IN THE ABSENCE OF A QUORUM OF THE
HISTORIC PRESERVATION BOARD, AUTHORIZING
THE CITY MANAGER TO ISSUE A SPECIAL
CERTIFICATE OF APPROPRIATENESS FOR THE
STRUCTURE LOCATED AT 111 PERVIZ AVENUE IN
OPA-LOCKA, FLORIDA REMOVING IT FROM THE
OPA-LOCKA HISTORIC REGISTRY AND ALLOWING
ITS DEMOLITION; PROVIDING FOR INCORPORATION
OF RECITALS; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Opa-Locka ("City") established the Opa-Locka Historic Preservation
Board by Ordinance 81-13 for the purpose of protecting and perpetuating properties worthy of
historic preservation; and
WHEREAS, the City adopted Ordinance 15-03, amending Ordinance 81-13, allowing
the City Manager to issue regular and special certificates of appropriateness, subject to the
approval of a majority of the City Commission and in the absence of a quorum of the Historic
Environmental Preservation Board Avenue; and
WHEREAS, Ordinance 91-2 identified the property at 111 Perviz Avenue, Opa-Locka,
Florida ("Property") as exemplifying the Arabian Motif and protecting it as a historic landmark;
and
WHEREAS, the Property, through neglect, became dilapidated and has been vacant with
no licensed activity since 2004; and
WHEREAS, on September 10, 2017 Hurricane Irma severely damaged the neglected
structure and portions of the Property collapsed and fell onto Perviz Avenue; and
WHEREAS, City Commission of the City of Opa-Locka, Florida to finds that it is in the
best interest of the City to authorize the City Manager to issue a special certificate of
appropriateness.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION
OF THE CITY OF OPA-LOCKA, FLORIDA:
Section 1. RECITALS ADOPTED
The recitals to the preamble herein are incorporated by reference.
Resolution No. 17-9428
Section 2. AUTHORIZATION
The City Commission hereby authorizes the City Manager to issue a special certificate
of appropriateness for the structure located at 111 Perviz Avenue in Opa-Locka, Florida
removing it from the Opa-Locka Historic Registry and allowing its demolition
SECTION 3. SCRIVENER'S ERRORS.
Sections of this Resolution may be renumbered or re -lettered and corrections of
typographical errors which do not affect the intent may be authorized by the City
Manager, or the City Manager's designee, without need of public hearing, by filing a
corrected copy of same with the City Clerk.
Section 4. EFFECTIVE DATE
This Resolution shall take effect immediately upon adoption and is subject to the
approval of the Governor or his designee.
