FL. 32536 Current Fines: $74.000.00 Proposed Compliance Date: Febroar; 20.2023 Proposed Mitigation Payment: $6.000.00 1) Property Owner proposes to mitigate the Current Fines by taking the following actions (the "Mitigation Plan"): a. Property Owner's resolution of all current outstanding violations of the City's Code of Ordinances, whether cited previously or existing but united, on or before the Proposed Compliance Date; and b. Making the Proposed Mitigation Payment upon execution of this Code Compliance Mitigation Agreement. 2) The City conditionally accepts the Property Owner's Mitigation Plan, subject to the following conditions: a. Property Owner's resolution of all outstanding violations of the City's Code of Ordinances on or before the Proposed Compliance Date; and b. Property Owner's payment of the Proposed Mitigation Payment upon Property Owner's execution of this Agreement. 3) Fines shall continue to accrue as ordered by the City's Special Magistrate until the Property Owner's successful completion of the Mitigation Plan on or before the Proposed Compliance Date. 4) If Property Owner successfully completes the Mitigation Plan set forth in Paragraph 1 on or before the Proposed Compliance Date, the City will accept the Proposed Mitigation Payment as a full and final settlement of existing code enforcement liens at the Property Address arising under Chapter 162, Florida Statutes, and will release such liens in the Official Records of Okaloosa County, Florida. 5) If Property Owner fails to complete the Mitigation Plan on or before the Proposed Compliance Date, the Proposed Mitigation Payment shall be applied by the City to outstanding fines and/or fees resulting from code citations arising at the Property Address (ie., a partial payment) and fines shall continue to accrue until paid. 6) Nothing herein shall waive the City's right to issue citations for subsequent violations of the City's Code of Ordinances, to include citations for "repeat violations" which may result in fines of up to S500 per day. e'j4 Property Owner ` City Manager I `i -Tr r4 Ua3 7D3 if;cDD Date of Execution Date of Execution
