HomeMy Public PortalAbout006-2022 - Granting Permanent & Temporary Right-or-Way Easements to INDOT BOARD OF PUBLIC WORKS & SAFETY CITY OF RICHMOND,INDIANA RESOLUTION NO. 6-2022 A RESOLUTION AUTHORIZING THE GRANT OF ONE PERMANENT AND TWO TEMPORARY RIGHT-OF-WAY EASEMENTS WHEREAS, The Board of Public Works and Safety (hereinafter "Board") is the disposing agent for property owned and to be acquired or transferred by the City of Richmond, Indiana (hereinafter "City"), pursuant to the provisions of Indiana Code (IC) 36-1-11, et seq. and IC 5-22-22, et seq., and the Board has custody, maintenance, and improvement powers of public ways in accordance with IC 36- 9-6, et seq.; and WHEREAS, The State of Indiana, by and through its Department of Transportation("INDOT") is undertaking its US 27 Road Construction Project which impacts the intersections of South"0" Street to North"I" Street within the City; and WHEREAS, INDOT is seeking one (1) permanent right-of-way grant for an approximate 539 square foot strip of area located upon "Parcel 55" which is located on the west side of a City parking lot located on South 9th Street (State Parcel ID No. 89-18- 05-220-108.001-030) which is a fee simple acquisition as further described on the submitted documents attached to this Resolution; and WHEREAS, INDOT is also seeking two (2) temporary right-of-way easements consisting of a combined approximate 767 square foot total area for driveway construction areas which areas are located on the west side of a City parking lot located on South 9th Street (State Parcel ID No. 89-18-05-220-108.001-030; easement area is approximately 592 square foot of the same) and on the east side of a City parking lot located on South 9th Street (State Parcel ID No. 89-18-05-220-220.000-030; easement area is approximately 175 square foot.of the same) as further described on the submitted documents attached to this Resolution; and WHEREAS, The City wishes to grant INDOT said-permanent right-of-way grant and both temporary right-of-way construction easements as shown in the attached Exhibit A for the amounts shown in the same. NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works and Safety of Richmond, Indiana, that said Board hereby approves of the grant of the permanent right-of-way grant and hereby approves of the grants of the temporary right-of-way driveway construction Page 1 of 2 easements outlined or contained in the documentation submitted by INDOT as designated in Exhibit A to this Resolution. NOW, THEREFORE, BE IT ALSO RESOLVED by the Board of Public Works and Safety that David M. Snow as the Mayor of the City of Richmond, Indiana, and Vicki Robinson as the President of the Board, shall be authorized to execute the fmal drafts of the deed and easement documents as previously examined by the Richmond Law Department and the Richmond Engineering Division, and all other appropriate documents as necessary in connection with the same. COMMENTS The subject is commercially unimproved and consists of two, non-contiguous parcels.
