BOARD OF PUBLIC WORKS AND SAFETY OF THE
CITY OF RICHMOND, INDIANA, OCTOBER 2, 1969
The Board of Public Works and Safety of the City of Richmond, Indiana,
met in regular session in the Municipal Bldg. , October 2, 1969, at the
hour of 9:00 o'clock a.m. (edst) . Mr. Cecere presiding with the following
members present: Mr. Howell, City Controller, and Mr. Jacobs, City Engineer.
The following business was had to-wit:
Mr. Jacobs moved that the minutes of the previous meeting be approved,
seconded by Mr. Howell and on unanimous voice vote the motion was carried.
Earlham College student, Becky Nagaski appeared to ask the Board's per-
mission for a group of students to hold a vigil on the South side of Main
Street between 4th and 5th Sts. on Oct. 15, reading the names of American
war casualties in Viet Nam over a loud speaker. The group will stand
single-file on the sidewalk, silently, except for the reading. . Marshal's
will have literature available for any ane who is interested. There will
be approximately 10 or 15 in the group and the reading is expected to take
from 7:00 a.m. until 1:00 a.m. Mr. Cecere said the City could not forbid
freedom of speech to any group and as long as the sidewalk is not blocked,
he saw no objection to the vigil. He asked Miss Nagaski whether the reading
could be done as effectively without the use of an amplifier. She answered
she did not think so. Mr. Howell said that other groups and merchants
have asked to use a p.a. system and have been turned down by the Board and
he did not feel the Board should set a precedent by allowing this group
to use one. Mr. Jacobs said he agreed with Mr. Howell. Mr. Cecere explained
to Miss Nagaski that the group hold the vigil without the use of a loud
speaker,.
Mr. Aaron Jarvis appeared, representing Community Litter Control, offering
to place trash receptacles in various locations in the City, paying the
Boys' Club $20.00 per receptacle, plus $1.00 per receptacle every ninety
days, when the Boys' Club will be responsible for cleaning them. At the
end of two years the Boys' Club will own the receptacle. Mr. Jarvis said
that Unlimited Services of America, together with the Optimist Club has
had a two-year agreement with the City which will expire the end of this
year. Mr. Cecere said the Board would look into the matter.
Asst. Police Chief Maj. Doren recommended that the Board advance Officers
Harry Edward Todd Thompson and Joseph Albert Nimitz from Probationary
Patrolman to First Class Patrolman, effective Sept. 30, 1969, both having
satisfactorily completed their probation. Mr. Jacobs moved the Board
approve the recomme.nde&advancements, seconded by Mr. Howellaand on unani-
mous voice vote the motion was carried.
Mr. Wayne Tash appeared to ask permission to close So. "A" St. between
22nd and 23rd Sts. on Oct. 11 for an ice cream social for the benefit
of the Test Parent-Teacher Association. Mr. Howell moved the Board
approve the request, seconded by Mr. Jacobs and on unanimous voice vote
the motion was carried.
Major Doren asked the Board' s approval to have an ordinance prepared for
Council for a transfer of $3,500.00 from L-1 (1-11-111) Payrolls to L-28
(7-72-722).. Motor Equipment in order to pay for the replacement of a
police cruiser which was damaged beyond repair in a recent accident. He
said if the Department would collect insurance, the money would be paid
back to the General Fund. Mr. Jacobs moved the Board approve the request,
seconded by Mr. Howell and on unanimous voice vote the motion was carried.
Weights and Measures Inspector, Francis Daniels, asked the Board to approve
a transfer of funds within his department amounting to $175.00 in order to
enable him to attend an advanced training course in Weights and Measures
Administration offered by the Department of Commerce at the University of
Colorado from Nov; ,17 to 21. Mr. Jacobs moved the Board approve the
request, seconded by,Mr. Howell and on unanimous voice vote the motion was
carried.

Mr. Daniels reported that the 32nd Annual Fall Meeting of the Indiana
Association of Inspectors of Weights and Measures will be held in
Richmond at the Leland Motor Inn, October 23 and 24.
Fire Chief William Berry requested the Board to approve the preparation
of an ordinance for Council requesting a transfer of $14,200.00 within.
the Fire Department for equipment repairs, testing of new applicants,
the purchase of a new 150' radio tower, and the purchase of new furni-
ture for the new No. 1 Fire Station. Equipment repairs are necessary
because a Department van had been in an accident. If insurance is
collected, the money will be returned to the General Fund. Mr. Howell
moved the Board approve the request, seconded by Mr. Jacobs and on
unanimous voice vote the motion was carried.
Chief Berry asked the Board' s approval to have a resolution for Council
prepared for a transfer within his Department of $75.00 in order to
up-date the Fire Department and Fire Prevention Bureau libraries.
Mr. Jacobs moved the Board approve the request, seconded by Mr. Howell
and on unanimous voice vote the motion was carried.
Chief Berry asked the Board' s approval to have a resolution for Council
prepared for a transfer of $50.00 within his Department in order to pay
for assistance received by the Fire Prevention Bureau in analyzing arson
evidence. Mr. Howell moved the Board approve the request, seconded by
Mr. Jacobs and on unanimous voice vote the motion was carried.
Chief Berry reported a Fire Department van had been involved in an
accident with a Wayne Dairy Milk truck on Airport Road, early indications
are that the milk truck had been over the center line. Estimated damage
to the van is $266.00.

Captain Griffin was on vacation from September 15 to September 30.
The Fire Prevention Bureau and the Bureau of Buildings worked together
on condemnations of buildings and other problems.
An alarm system will be installed at the Day Nursery as soon as the
material is available.
Captain Sparks and Bosell attended the'Ohio State Fire School from Sept.
8-12, 1969.
The Midwest Casket Company has completed the work on up-dating their spray
booth.
The Glic Apartments is up-dating the electrical wiring..to;serve additional
appliances and fire safety.
Captain Griffin showed a film and lectured on fire safety at Starr and
Pleasant View schools to a total of 73 children.
Captain Griffin showed a movie and lectured to the Northeastern Young
Farmers Organization on farm safety from fire. A total of 22 farmers.
On September 19th, Fire Marshal Green, Captain Sparks, Bosell and Griffin
showed films and lectured to 24 students studying nursing at the hospital.
This lecture at the hospital involved hospital evacuation, safe useage
of fire extinguishers and other fire safety points at the Reid Hospital.
On September 24th, Captains Sparks and Bosell showed a film and gave
lectures to two different classes at Boston School, 5 classes at Dennis
Junior High for a total of 104 students.
Chief Berry read the following letter:

Dear Bill,
Please be advised that I have preferred charges against you with the
Board of Public Works and Safety for Violation of Rules of the Richmond
Fire Department, to-wit: Article XIII, Section 1, page 27, specifically
for reporting late for duty eight times in the year 1969.
These charges will be presented to the Board of Public Works and
Safety on Thursday, October 2, 1969, at 10:00 a.m.
At this time, you will be given an opportunity to be heard personally
or by counsel.

Mr. Cecere said that he understood that Mr. Smith had been late in other
years also and asked Mr. Smith whether he wanted:to say anything in his
defense. Mr. Smith said that the charges were true, but that there had
been times when clocks were not synchronized. Mr. Cecere said that he
understood the charges were preferred because no one has been able to
impress upon Mr. Smith the importance of punctuality in the Fire Dept.
He said he. hoped Mr. Smith's continued negligence in this regard was not
due to lack of caring about his job, and Mr. Smith said it was not, and
it would not happen again. Chief Berry said that Mr.' Smith was under
threat of probation under Chief Price for the same reason. Chief Berry
read the following letter:

Dear Board of Works Members:
It is with regret that I have found it necessary to bring charges
of "Violation of Rules" , Article XIII, Section 1, page 27, of Rules
and Regulations of the Fire Department of the. City of Richmond, Indiana,
against Mr. William Smith, a fireman presently stationed at Company #5.
fire house. Mr. Smith has reported for work late repeatedly (8times,
1-11-69, 6-8-69, 6-14-69, 7-10-69, 8-13-69, 8-25-69, 9-26.-69, and 9-28-69) . '
The matter was discussed with him by his Captain, Charles Carroll, at
Company #3 on 7-10-69 and again on 8-25-69 at which time Battalion Chief i
James Ghearing informed Mr. Smith by letter that recurrence of this
violation of rules would make it necessary to bring it to the attention
of the Board of Public Works and Safety.
Mr. Smith was later transferred to Company #5 where he was informed
by Captain Melvin Ponder that reporting late for work would not be
tolerated. Mr.; Smith appeared late for work again on two.more occasions .
(9-26-69 amd 9-28-69) as mentioned above. . .
It is my recommendation at this time that. William Smith be sus-
pended for three (3) days without pay.

Mr. Howell moved the Board accept Chief Berry' s recommendation and suspend
Mr. Smith for three days without pay, seconded by Mr. Jacobs and on unani-
mous voice vote the motion was carried.
Chief Berry showed a lay-out of proposed furniture for the new No. 1 Fire
Station to the Board.
Chief Berry reported that two new fire trucks had come in during the
morning and a third was expected by Saturday. It will be about two weeks,
to be used for testing and training before the trucks will be in operation.
Mr. Howell reported having received the following petition, signed by
37 names:
We, the undersigned, residents of Western Drive and Southwest 19th
Street, Richmond, Indiana, do hereby petition on the City of Richmond,
for_the installation of a street light at the west end of Western
Drive and one on Southwest 19th Street near the north end of the
street. These areas are very poorly lighted at present.
Mr. Howell moved the petition be referred to the Street Lighting Committee,
seconded by Mr. Jacobs and. on unanimous voice vote the motion was carried.
Mr. Howell moved the Board approve having a resolution prepared for Council
for a transfer in the City Controller' s budget of $50.00 for repairs on
four calculators and two typewriters. Mr. Jacobs seconded and on unanimous
voice vote the motion was carried.
Mr. Howell moved the Board authorize the preparation of an ordinance for
Council for an appropriation in his Dept. of $84,000.00 for the recon-
struction of North "A" and South "A" Streets, seconded by Mr. Jacobs and
on unanimous voice vote the motion was carried.
Mr. Howell moved the Board authorize an Ordinance for Council for the
appropriation of $9,400.00 for payment of the Northwest 5th Street and
Industrial Area Survey, contracted with Steeg & Associates of Indianapolis,
seconded by Mr. Jacobs and on unanimous voice vote the motion was carried.
Mr. Howell moved the Board authorize an-ordinance for Council for the
appropriation of $5,250.00 for paying the balance due Gaar Nursery for
sodding City Building lawn, seconded by Mr. Jacobs and on unanimous voice
vote the motion was carried.

Mr. Jacobs moved the Board authorize a curb cut requested by Miller Kemper
at N.W. 2nd St. and "F" , the request having been approved by Traffic and
Zoning, seconded by Mr. Howell and on unanimous voice vote the motion was
carried.

Mr. Jacobs moved the Board authorize a curb cut requested by Charles Mat-
tingly at So. "I" and 9th Sts. , Traffic and Zoning having approved the
request, seconded by Mr.. Howell and on unanimous voice vote the motion .
was carried.

Mr. Jacobs moved the Board authorize a curb cut requested by Oxford Devel-
opers at So. 14th and "A" Sts. , for a new housing project, traffic and
zoning having approved the request, seconded by Mr. Howell and on unani-
mous voice vote the motion was carried.
Mr. Howell reported that he met with the County Commissioners concerning •
a contract with Ater' s Ambulance Service. He said the Commissioners
approved of the proposed contract and he would set up a meeting with
Ater' s.
Mayor Klute shoined slidesof downtown Pittsburgh which illustrated improve-
ments made through the cooperation of various government departments and
private business.
There being no further business on motion duly made, seconded and carried,
the meeting adjourned.

The Board of Public Works and Safety of the City of Richmond, Indiana,
met in regular session in the. Municipal Bldg. ; October '9-, 1969, at: the
hour of 9:00 o'clock a.m. (edst) . Mr. Howell. presiding, Mr. Jacobs : ._"
present and Assistant City- Attorney. Klinge sitting .in in an -advisory
capacity for Mr. Cecere who was absent. The following business was
had to-wit:

Mr. Edward L. Peterson, Executive Director of the United Fund of Wayne
County, . Inc.. , asked.. .the-:Board' s permission for the Tarum Shrine Scooter
Patrol to parade up and down. Main St. with their bus, on Saturday,
October 18, 1969, in support of the United Fund drive. The scooters are
also planning to visit shopping centers. They are covered by insurance.
Traffice Captain Martin said that the State law requires the scooters to be
licensed and suggested they go in pairs rather than in larger groups. Mr.
Jacobs moved the Board approve the request provided the scooters are
licensed according to State law and that they coordinate their movements
with the Traffic Division, seconded by Mr. Howell and on unanimous voice
vote the motion was carried.
Mr. L. K. Williams requested authority from the Board for his group to act .
as security police for various commercial-.establishments and school groups
whenever requested. He said the group does not carry arms except when
specifically permitted •by the Chief of Police, and their uniforms are
distinct from City and State Police and Sheriff's Patrols.- Assistant
Police Chief Major Doren suggested the Board hold the, request under advise-
ment until ,Chief Strahan returns from his vacation. Mr. Williams said they
did not ask for authority, to make arrests. Major Doren said that in that
case he did not think they needed Board authority. . Mr. .Howell moved .the
