NOW, THEREFORE, BE IT RESOLVED by the Mayor and die Council of the Borough of Carteret, County of Middlesex, State of New Jersey, as follows: 1. The proposal from T &M Associates for planning/engineering services in regard to the Noe Street Park Site Investigation at a total cost not to exceed $10,500.00 is hereby approved. 2. This action is approved as an award of a professional services contract pursuant to N.J.S.A 40A:11- 5(1)(a) in accordance with the Borough's Fair and Open Process as authorized by law. 3. A copy of this Resolution be forwarded to the Borough's Purchasing Department, Director of Engineering and T &M Associates. Re: Site Investigation /Noe Street Park Dear Mr. Bergen: As requested, we are providing a scope of services and fee estimate to conduct a site investigation for the Noe Street Park site recently acquired with Green Acres acquisition funds. The project covers several parcels (Block 5801; Lots 2 -7, 8.02, part of Lot 9, Block 6411; Lot 7) on both Noe Street and Emerson Street. Collectively, these parcels represent the proposed Noe Street Park (site). The Borough utilized funds obtained through the New Jersey Green Acres Program (Green Acres) to conduct a Preliminary Assessment on the site. The Preliminary Assessment Identified the potential for historic fill on the property. The New Jersey Department of Environmental Protection ( NJDEP) has determined that historic fill is a discharge and must be investigated. As such, the Borough is required to conduct a multi step investigation, in accordance with NJDEP Technical Rules and supporting Guidance Documents. Green Acres also requires this investigation be completed, and issuance of a Response Action Outcome (RAO) by a Licensed Site Remediation Professional (LSRP), prior to reimbursing the Borough for acquisition funds. The first step in meeting the requirements of the NJDEP regulations is to conduct a Site investigation The Site Investigation is required to determine the presence of historic fill in the site, including the proposed basin and proposed improved areas. T &M will conduct the following activities as part of this scope: Approximately 6 to 10 soil borings will be advanced randomly throughout the site, to a depth below the fill material. Each soil boring will be observed, logged and photo documented by T &M field staff. In accordance with NJAC 7:26E -3.3. The Site Investigation Report will document the investigation, include a map for the location of the boring and a fence diagram of the borings to document longitudinal and horizontal lithology. The report will provide recommendations for any additional activities, as required by the NJDEP. Please note the following The confirmation of historic fill requires the notification of a discharge to the NJDEP. The notification also triggers the requirements for retention of a Licensed Site Remediation Professional (LSRP). This also includes submission, by the LSRP, on the estimated number of contaminated sites, which triggers the NJDEP to Issue an Annual Remediation Fee (ARF) invoice directly to the Borough. T &M will also prepare an application to the NJDEP Office of Brownfields Reuse — Hazardous Discharge Site Remediation Program ( HDSRF). The application to HDSRF will be for the performance of the Site Investigation, including report. The application will require the Borough to prepare resolutions for the Site Investigation activity. HDSRF reimburses municipalities at a maximum rate of 100% for investigation costs and reporting, dependent on any other funding received. HDSRF will not reimburse the Borough for the ARF.
