Danny,
Items in red indicate response to the items below. Some things need to be clarified as to realistic
expectation related to these types of installations. We make every effort, at times to a fault, to
minimize construction impact
Construction Plan and Methodology: Conduit shall be placed via any
combination of directional boring, soft dig techniques, machine trenching, or manual trenching.
Bidder shall determine the construction methods to be utilized to complete the work. As part of
the pre-stated “Work Plan”, bidder shall provide a written depiction of the methods and
resources to be used for approval by Town with its bid. Bidder shall remove rocks, stabilize,
compact soil, and level all pre-cast concrete pad sites.
While the contract and associated Work Plan allows for multiple methods of trench and material
installation, it should be noted that directional bore is the least invasive of methods. Which is
why the job was designed this way. Machine trenching, for obvious reasons would be the most
invasive. Hand excavation can be misleading if it is thought to be least invasive as it requires
manpower throughout the vegetation and potential increase of root damage. There are minimum
requirements of access which must be allowed to perform the work and not be held as
accountable to the contractor. The crews to date have been doing an exemplary job of using the
available spaces to mitigate these effects on vegetation. The items and photos submitted by Cliff
Spitzer were not performed by Hypower crews. I believe Cliff has been keeping you apprised of
these items as we have been progressing.
Unless approved otherwise in advance by the Engineer, bidder shall be responsible for restoring
all damaged landscaping to either equal or better condition.
This shall be for items damaged by contractor without prior approval as stipulated. As stated
above, Hypower crews did not perform the associated clearing described in today’s submittal.
Engineer will have the authority to authorize the removal and replacement of landscape
materials when necessary to complete the work, but maintains the authority to redirect and
mitigate project and vegetative impact. Bidder shall not remove or damage any landscaping or
hardscape without approval of the engineer.
Agreed.
Work Site Access Restrictions: To the greatest extent possible,
construction equipment and personnel shall access the work via North Ocean Boulevard and
minimize travel on interior residential streets.
There really should be no traffic other than the actual construction support equipment and
vehicles during construction on interior streets as they do not lead anywhere that would tempt
travel otherwise. I don’t understand why this one is called out.
Work Base: Bidder shall arrange for one or more off-site locations
where material stocks will be held and equipment will be kept during idle times and during non-
work hours. Such sites shall not be located within the limits of the Town of Gulf Stream unless

approved by the Engineer. Bidder shall arrange for security as needed and shall be responsible
for any costs associated with loss of materials or equipment. Bidder shall not establish
temporary office or base of operations within the Town via an RV, mobile mini, or any other such
portable facilities unless approved by the Engineer.
This has been done. Again not sure why this is called out. We do have tailboard meetings at
each location to lay out the plan for the day. These are extremely important and are necessary
to be held onsite. The most we would have is possibly a table to open plans. This cannot be
performed remotely as there are multiple crews in multiple locations and the site conditions are
reviewed constantly.
Bidder shall remove all equipment from the Island at the end of each day unless prior approval
is given by the Engineer.
Agreed. From time to time we will contact you regarding the necessity to work beyond hours or
leave equipment onsite. This will be done in the interest of expedition of the project and not for
sake of convenience. The bore process does have “points of no return” that push the crews late
at times or hinder total evacuation of the site. Any items noted will be those directly affected by
that instance.

Sorry for delay on pictures
These are the areas Bill and I looked at on Monday that residents had concerns on.
Pictures also show were the 2 branches were cut by Towne Employees.
There is also pictures were we could not gain access from south side in these areas I have
informed crews again to be extremely careful of any area ..
