AN ORDINANCE CREATING A NEW SECTION IN CHAPTER 51 OF THE HOPKINSVILLE
CODE OF ORDINANCES PERTAINING TO SEWERAGE AND WATER PAYMENTS TO THE
CITY
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
HOPKINSVILLE, KENTUCKY AS FOLLOWS:
SECTION ONE
That a new section be added to Chapter 51 of the Hopkinsville Code of Ordinances to
read as follows:
PAYMENT TO CITY.
The Commission shall transfer to the City of Hopkinsville, a fee equal to 2% on the gross
revenue from the sale of water and sewer service received by the Commission from customers
located within the city limits of the City of Hopkinsville. Said fee shall be collected by the
Commission and considered as payments in lieu of taxes and as compensation for use of the
city's public rights-of-way. Said payments shall be made quarterly on January 31, April 30, July
31, and October 31, for the prior calendar quarter.
SECTION TWO
If any section, subsection, sentence, clause, or phrase of this ordinance is held
unconstitutional or otherwise invalid, such infirmities shall not affect the validity of the remaining
portions of this ordinance.
SECTION THREE
Any and all existing ordinances inconsistent with this ordinance are hereby repealed.
SECTION FOUR
This ordinance shall take effect on July 1, 2020, after its passage and publication
according to law.
