AN ORDINANCE AMENDING THE FRASER MUNICIPAL CODE BY IMPLEMENTING
W ATER CONSERVATION MEASURES AND DECLARING AN EMERGENCY.
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN
OF FRASER, COLORADO, AS FOLLOWS:
PART 1: AMENDMENT OF MUNICIPAL CODE. Chapter 13 of the Code of the Town of
Fraser, Colorado (herein sometimes referred to as the "Municipal Code") is hereby amended as
follows:
11 Chapter 13, Article 2 ("Water System"), Sections 13-2-140 and 13-2-360 ofthe Municipal
Code are hereby amended in their entirety to read as follows:
Sec. 13-2-140.
Water Conservation Measures.
(a) Outside watering and irrigation is strictly prohibited between the hours of 9:00 a.m. and
5:00 p.m. Hand held watering by hose and watering canister during this time will be allowed,
however, it is not encouraged.
(b) Timers are strongly recommended on all irrigation systems and hoses, with a maximum
time setting not to exceed 30 minutes per rotation. Rain sensors on such systems are also
recommended.
(c) Washing of cars, boats, campers, windows, and the like, shall be done only when the hose
is equipped with a flow-restricting device such as a trigger nozzle.
(d) All outside watering is prohibited within certain subdivisions within the Town of Fraser
approved after January 1, 2000, based upon specific conditions of approval.
Sec. 13-2-360.
Violations.
Failure to comply with the terms of this Article by failure to pay the necessary fees,
charges and taxes and failure to otherwise comply with the terms of this Article shall constitute
an offense and a violation thereof. Every person violating this Article shall be punished, upon
conviction, by a fine of not less than twenty-five dollars ($25.00) nor more than one thousand
dollars ($1,000.00), or by imprisonment for a term not exceeding one (1) year, or both such fine
and imprisonment for each offense. Delinquency for each calendar month shall constitute a
separate offense.

PART 2: REPEAL. Any and all existing ordinances or parts of ordinances of the Town of
Fraser covering the same matters as embraced in this Ordinance are hereby repealed and all
ordinances or parts of ordinances inconsistent with the provisions of this Ordinance are hereby
repealed; provided, however, that such repeal shall not affect or prevent the prosecution or
punishment of any person for any act done or committed in violation of any ordinance hereby
repealed prior to the taking effect of this Ordinance.
P ART 3: SEVERABILITY. If any section, subsection, sentence, clause or phrase of this
Ordinance is, for any reason, held to be invalid or unconstitutional, such decision shall not affect
the validity or constitutionality of the remaining portions ofthis Ordinance. The Town of Fraser
hereby declares that it would have adopted this Ordinance, and each section, subsection, clause
or phrase thereof, irrespective of the fact that anyone or more sections, subsections, sentences,
clauses and phrases thereofbe declared invalid or unconstitutional.
PART 4: DECLARATION OF EMERGENCY: EFFECTIVE DATE. Because ofthe
immediate risk to the municipal water supply if unregulated water use is allowed within the
Town of Fraser, it is hereby declared that an emergency exists, that this Ordinance is necessary
to the immediate preservation of the public peace, health and safety, and that it S~hll b . ull

NOTICE OF ADOPTION OF ORDINANCE
Please take notice that, on June 20, 2007, the Board of Trustees for the Town of Fraser,
Colorado, approved and adopted an Ordinance entitled:

Series 2007
AN ORDINANCE AMENDING THE FRASER MUNICIPAL CODE BY
IMPLEMENTING WATER CONSERVATION MEASURES AND DECLARING AN
EMERGENCY.
This Ordinance shall be in effect immediately upon adoption. A copy of this Ordinance
in full is available for public inspection during Town regular business hours at the Town
Hall, 153 Fraser Avenue, Fraser, Colorado.
