HomeMy Public PortalAbout2000-27 Zoning MapF ORDINANCE NO. 2000- a l e AN ORDINANCE AMENDING THE GREENCASTLE PLANNING AND ZONING ORDINANCE BY AMENDING THE ZONING MAP WHEREAS, the Plan Commission of the City of Greencastle, pursuant to the Petition of DePauw University, has prepared this ordinance to amend the Greencastle Planning and Zoning Ordinance by amending the zoning map; WHEREAS, the Greencastle Plan Commission has reported that it held a public hearing concerning this ordinance on November 27, 2000, after timely notice of the hearing was given by publication in the Banner - Graphic Greencastle, Indiana on November 17, 2000; WHEREAS, the Greencastle Plan Commission has reported that it paid reasonable regard to the following factors enumerated in IC 36 -7 -4 -603 in consideration of the ordinance and determination of a recommendation to be made to the Common Council: I . the comprehensive plan; ® 2. current conditions and the character of current structures and uses in each district; 3. the most desirable use for which the land in each district is adapted; 4. the conservation of property values throughout the jurisdiction; and 5. responsible growth and development. WHEREAS, the Greencastle Plan Commission has certified this ordinance to the Common Council with a recommendation by a majority vote in favor of adoption, WHEREAS, the Common Council has considered the recommendation of the Greencastle Plan Commission and has paid reasonable regard to the factors enumerated in IC 36 -7 -4 -603 before acting on this ordinance, WHEREAS, the Common Council has determined that this ordinance should be adopted without amendment as certified by the Greencastle Plan Commission. r 1 U Therefore, • BE IT ORDAINED AND ADOPTED BY THE COMMON COUNCIL OF THE CITY OF GREENCASTLE, INDIANA: SECTION 1. REZONING A. That the City of Greencastle Zoning Map, Chapter 10 -38 of the City of Greencastle Code, is hereby amended by changing the zoning classification for the following described real estate from RI (One - Family Residence) to R2 (Low Density Multiple - Family Residence): Situate in the State of Indiana, County of Putnam and being a part of the Southwest quarter of Section 21, Township 14 North, Range 4 West of the Second Principal Meridian, more particularly described to -wit: Beginning at the intersection of the South right -of -way line of Hanna Street and the East right -of -way line of Jackson Street; thence East 236.0 feet with the South right -of -way line of Hanna Street to the West right -of -way line of Indiana Street; thence Southerly 150.9 feel, more or less, with the said West right -of -way line to the North line of a 12 foot wide alley; thence West 220.5 feet, more or less, with the North right -of -way line of said alley to the East right -of -way line of Jackson Street; thence North 150.0 feet with the said East right -of -way line to the point of beginning, containing 0.79 acre, more or less. Subject to all rights -of -way and pertinent easements of record. B. That the City of Greencastle Zoning Map, Chapter 10 -38 of the City of Greencastle Code, is hereby amended by changing the zoning classification for the following described real estate from Cl (Local Business District) to R2 (Low Density Multiple - Family Residence): Situate in the State of Indiana, County of Putnam and being a part of the Southwest quarter of Section 21, Township 14 North, Range 4 West of the Second Principal Meridian, more particularly described to -wit: Commencing at a 518 inch rebar at the intersection of the North right -of -way line of Hanna Street and the East right -of -way line of Jackson Street which rebar is further described as being 9 feet North of the Southwest comer of Lot #212 in the Original Plat of the town, now City of Greencastle; thence North 89 degrees 47 O minutes 48 seconds West 10.00, feet with the Westerly extension of the North right- of way line of Hanna Street; thence South 00 degrees 26 minutes 31 seconds West • 40. 00 feet to a PK nail at the intersection of the South right -of -way line of Hanna Street and the East right -of -way line of Jackson Street and the true point of beginning of the real estate herein described; thence South 89 degrees 47 minutes 48 seconds East 236.76 feet with the South right-of-way line of Hanna Street to the West right -qf -way line of Indiana Street; thence with the West right -of- -way line of Indiana Street South 132. 00 feet to a mag nail; thence South 08 degrees 07 minutes 12 seconds West 22 7.67 feet to a 518 inch rebar; thence leaving the right - of -way line of Indiana Street North 89 degrees 47 minutes 48 seconds West 189.63 feet to a 518 inch rebar, thence Southwesterly 117.2 7 feet on a curve to the right having a radius of 320. 00 feet and subtended by a long chord bearing South 23 degrees 10 minutes 26 seconds West a distance of 116.61 feet to a mag nail; thence South 33 degrees 40 minutes 19 seconds West 18.59 feet to a 518 inch rebar on the North line of the 0. 12 acre tract as described in Deed Record 171, page 71 in the Office of the Recorder of Putnam County, Indiana; thence South 89 degrees 06 minutes 34 seconds West 30.36 feet to a 518 inch rebar marking the Northwest comer of said 0. 12 acre tract and the East right -of -way line of Jackson Street; thence with said East right -of -way line North 33 degrees 40 minutes 19 seconds East 35.87 feet; thence Northeasterly 171.09 feet on a curve to the left having a radius of 295.00 feet and subtended by a long chord bearing North 17 degrees 03 minutes 25 seconds East a distance of 168.71 feet; thence North 00 degrees 26 minutes 31 seconds East 289.62 feet with said East right -of -way line to the point of beginning containing 1.95 acres, more or less. • Except: Beginning at the intersection of the South right -of -way line of Hanna Street and the East right -of -way line of Jackson Street; thence East 236.0 feet with the South right -of -way line of Hanna Street to the West right -of -way line of Indiana Street; thence Southerly 150.9 feet, more or less, with the said West right- of-way line to the North line of a 12 fool wide alley; thence West 220.5 feet, more or less, with the North right -of -way line of said alley to the East right -of -way line of.lackson Street; thence North 150.0 feet with the said East right -of -way line to the point of beginning, containing 0.79 acre, more or less.
