Nays: none, motion passed. 7 Ordinances 8 Final Plats and PUDS 1. Conceptual Plat - White Wolf Run Planning Administrator N. Schwendt presented the board with information for a conceptual plat for a subdivision proposed just north and west of Jones Road. This subdivision is proposed just north and west of Jones Rd., with a connection to Jones Road to the south, and to the north. The subdivision proposes a realignment of Jones Road within the development. The subdivision Page 8 of 100 5 proposes 332 lots, which is within the allowed density provided by the zoning district and future land use designation. Chair M. Roy asked for comment from the Board. Mr. Follmar inquired about how many entries and exits there are for the proposed subdivision. Mr. Schwendt, Planning Administrator, answered that the points of entry/exit would be on Jones Road. Schwendt presented the board with information for a conceptual plat for a subdivision that is proposed south of Point Center Road, which is south of Antioch Elementary School on Whitehurst Lane. The subdivision proposes to connect to Garrett Pit Road, and, as such, Garrett Pit Road will be improved to a paved road, per Okaloosa County standards. The subdivision proposes 106 lots. Chair M. Mr. Zinke, Civil Engineer representing the Developer, explained to the Board how they were going to tap into the city's water system. A brief discussion ensued. Chair M. Roy called for action. Variance - Antioch Road Lot Split Planning Administrator N. Schwendt stated that for the record the Board that the Land Development Code, Section 3.04.03, requires a variance through the Board of Adjustment to split any lot in a platted recorded subdivision which was recorded after March 11, 1974, which is the date on which technical review of plats began in our area pursuant to Chapter 177 of the Florida Statutes, established in 1971. Staff finds that the resulting lots will be compliant with the LDC standards for the R-2 zoning district, the Comprehensive Plan standards for the Residential future land use designation, and that the resulting lot sizes (16,552 square feet and 18,295.2 square feet) as well as Page 9 of 100 6 the resulting density (2.5 dwelling units per acre). The standards are consistent and compatible with the lots in the same plat, as well as lots throughout the surrounding area. Mr. Schwendt informed the Board that one letter was received that made an inquiry concerning the variance and then read that letter. Chair M. Roy asked for comment from the Board. Mr. Frost asked if there were any developed lots in that area. Mr. Schwendt answered that there may be at least four. Mr. Hayes inquired about a question asked in the letter received from the public. Schwendt updated the board with the following information: new development orders: Staybridge Suites, a proposed 102-room hotel, located on a 2.37-acre site on John King Road, to the east of the AmVet's Post. No final plats have been recorded since the last meeting. No new development applications have been received since the last meeting. Our planning consultant, Kimley-Horn and Associates, is continuing analysis and data collection for the comprehensive plan update. 12 Comments from the Audience Chair M. Ord. 1938 - Retta Lane Annexation BACKGROUND: On June 5, 2023, staff received an application to annex property located 4869 Retta Lane. The subject property is currently located within unincorporated Okaloosa County with a future land use and zoning designations of Mixed Use. The request for voluntary annexation will be presented to City Council via Ordinance 1938 on August 14, 2023 for the first reading. FINANCIAL IMPACT The fees for annexation have been waived for this application as it was received during the moratorium on annexation fees. The cost of advertising was $411.50. The successful annexation of this property will have positive future impacts, including ad valorem revenue based on future taxable assessed value, development and building permit fees, and utility usage fees. The request for vacation will be presented to City Council via Ordinance 1947 on August, 2023 for the first reading. DISCUSSION: The construction of the Hospital Drive extension/Fallen Heroes Way will render a portion of Price-Gregory Way unusable as a road. This ordinance will serve to vacate that outstanding portion of Price-Gregory Way as right-of-way, and grant it to the adjacent property owner, who is the applicant. An advertisement ran in the Crestview News Bulletin on July 27, 2023. The property was posted on July 25, 2023. GOALS & OBJECTIVES This item is consistent with the goals in A New View Strategic Plan 2020 as follows. Foundational – these are the four areas of focus that make up the necessary foundation of a successful local government. Organizational Capacity, Effectiveness & Efficiency – To efficiently & effectively provide the highest quality of public services. Infrastructure – Satisfy current and future infrastructure needs. FINANCIAL IMPACT The application fee for a vacation was $600.00 and the cost of advertising was $193.00. Ord. 1948 - Comprehensive Plan Amendment - Commercial Density BACKGROUND: The first step of the Comprehensive Plan update process has been the Current Plan Analysis. Staff has conducting at least monthly meetings to coordinate this process since it began. DISCUSSION: While working on the current plan analysis, and in more detailed discussions with our consultant, it was noted that the Future Land Use element did not explicitly state a maximum density for apartments in the Commercial Future Land Use category, but rather referenced the Land Development Code Directly. The consultant and staff came to the conclusion that, to be clear and to have clear consistency between the Comprehensive Plan provision and the Land Development Code, that the maximum density allowance be explicitly added to the Commercial category in the Future Land Use Element of our Comprehensive Plan. An advertisement for this amendment ran in the Crestview News Bullettin on July 27, 2023. GOALS & OBJECTIVES This item is consistent with the goals in A New View Strategic Plan 2020 as follows. Foundational – these are the four areas of focus that make up the necessary foundation of a successful local government. Financial Sustainability – Achieve long term financial sustainability. Organizational Capacity, Effectiveness & Efficiency – To efficiently & effectively provide the highest quality of public services. Quality of Life – these six areas focus on the overall experience when provided by the city. Community Character – Promote desirable growth with a hometown atmosphere. Opportunity – Promote an environment that encourages economic and educational opportunity. Community Culture – Develop a specific identity for Crestview. FINANCIAL IMPACT The cost of advertising for this amendment was $155.00. RECOMMENDED ACTION Staff respectfully requests a recommendation to the City Council to adopt Ordinance 1948. Page 97 of 100 Attachments None Page 98 of 100 ORDINANCE: 1948 AN ORDINANCE PROVIDING FOR A COMPREHENSIVE PLAN AMENDMENT; AMENDING CHAPTER 7, POLICY 7.A.3.4, SUBSECTION 3, REGARDING DENSITY IN THE COMMERCIAL FUTURE LAND USE CATEGORY; PROVIDING FOR AUTHORITY; PROVIDING FOR FILING WITH THE CLERK OF CIRCUIT COURT OF OKALOOSA COUNTY, THE CHIEF ADMINISTRATIVE OFFICER OF OKALOOSA COUNTY AND THE FLORIDA DEPARTMENT OF STATE; PROVIDING FOR SEVERABILITY; PROVIDING FOR SCRIVENER’S ERRORS; PROVIDING FOR LIBERAL INTERPRETATION; PROVIDING FOR REPEAL OF CONFLICTING CODES AND ORDINANCES; AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF CRESTVIEW, FLORIDA AS FOLLOWS: SECTION 1 – COMPREHENSIVE PLAN AMENDMENT. This ordinance hereby amends the City of Crestview Comprehensive Plan Chapter 7, Policy 7.A.3.4, Subsection 3, as follows: Policy 7.A.3.4 - The LDC, adopted pursuant to Policy 7.A.1.1, shall include regulations pursuant to Policy 7.A.1.2(2) with the following densities, intensities, land uses and related provisions: 1. The Commercial land use category is designed for a wide range of business uses, including retail, wholesale, communication facilities, offices, services, motel/hotel uses, churches and places of worship and residential dwelling units that are clearly accessory or incidental to the principal non-residential use. Additionally, apartments and condominiums are permitted in allowed zoning districts, as established in the Land Development Code (LDC), with a maximum density of twenty-five (25) units per gross acre. Accessory residential units are allowed only for those business owners or managers who reside on the same parcel of in the same building as the business. The density for such accessory residential use is 1 unit per business parcel. The intensity of non-residential uses shall be governed by a FAR 3.0 and an impervious surface coverage of 80%. SECTION 2 – AUTHORITY. The authority for enactment of this ordinance is Chapter 171, Florida Statutes, and Section 2 of the City Charter. SECTION 3 – FILING. Upon passage, the City Clerk is directed to file a copy of this ordinance with the Clerk of Circuit Court of Okaloosa County and with the Florida Department of the State. SECTION 4 – SEVERABILITY. If any word, phrase, sentence, paragraph or provision of this ordinance or the application thereof to any person or circumstance is held invalid or unconstitutional, such finding shall not affect the other provisions or applications of this ordinance which can be given effect without the invalid or unconstitutional provision or application, and to this end the provisions of this ordinance are declared severable. SECTION 5 – SCRIVENER’S ERRORS. The correction of typographical errors which do not affect the intent of this Ordinance may be authorized by the City Manager or the City Manager’s designee, without public hearing, by filing a corrected or re-codified copy with the City Clerk. SECTION 6 – ORDINANCE TO BE LIBERALLY CONSTRUED. This Ordinance shall be liberally construed in order to effectively carry out the purposes hereof which are deemed not to adversely affect public health, safety, or welfare. Page 99 of 100 SECTION 7 – REPEALER. All Ordinances or parts of Ordinances in herewith be and the same are hereby repealed. SECTION 8 – EFFECTIVE DATE.
