Call to Order The Regular Meeting of the Crestview City Council was called to order at 6:00 p.m. by Mayor JB Whitten. Board members present: Mayor Pro-Tem Andrew Rencich, Council members: Doug Capps, Cynthia Brown, Joe Blocker, and Ryan Bullard. Also present: City Manager Tim Bolduc, City Clerk Maryanne Schrader, City Attorney Jonathan Holloway, and various staff members. 2. Invocation, Pledge of Allegiance 2.1 The Invocation and Pledge of Allegiance was led by Elder Echols of First Church of God in Christ. 3. Open Policy Making and Legislative Session Mayor JB Whitten declared a quorum was met. 4. Approve Agenda Mayor JB Whitten asked the City Council to add a presentation from Nathan Boyles of Adams Sanitation and called for action. Motion by Mayor Pro-Tem Andrew Rencich and seconded by Councilmember Joe Blocker to approve the agenda, as amended. Roll Call: Andrew Rencich, Douglas Capps, Cynthia Brown, Joe Blocker, Ryan Bullard. All ayes. Motion carried. 5. Presentations and Reports Nathan Boyles of Adams Sanitation updated the Council on the transition preparation scheduled for the first day of October. He distributed a letter regarding the transition. He noted that a Job Fair will be held on August 26th at the Crestview Holiday Inn Express from 1 to 5 for several positions. Responding to several questions from the Council, Mr. Boyles replied that they are coordinating transition efforts with Waste Pro. He added 95% of the residents should not see a change in their service days. Carts will be delivered starting the first week in September and will include an instructional flyer. In response to City Manager T. Bolduc regarding the media campaign, Mr. Boyles responded they are posting in several areas, coordinating with the city PIO, running billboard ads, partnering with restaurants, and utilizing social media. He will also include a public education campaign. 6. Consent Agenda Mayor JB Whitten called for action. Motion by Councilmember Capps and seconded by Councilmember Blocker to approve the Consent agenda, as presented. Ord. 1932 - Third Avenue Annexation Senior Planner Nicholas Schwendt presented Ordinance 1932 - Third Avenue Annexation to the City Council. He said he has not received comment from the public regarding the next three ordinances. He went over the zoning and courtesy notices and postings. Schwendt presented Ordinance 1933 - Third Avenue Comprehensive Plan Amendment to the City Council. He stated the information is the same as the previous ordinance. He then asked the City Clerk to read the ordinance by Title. Ord. 1934 - Third Avenue Rezoning City Attorney Jon Holloway swore in Mr. Schwendt for the quasi-judicial segments of the meeting. Senior Planner N. Schwendt presented Ordinance 1934, Third Avenue Rezoning, to the City Council and asked the City Clerk to enter the staff report into record: Background: On May 10, 2023, staff received an application to annex and to amend the comprehensive plan and zoning designations for property located at 2203 Third Avenue. The subject property is currently located within unincorporated Okaloosa County with a Future Land Use and zoning designation of Mixed Use. The application requests the Mixed Use (MU) zoning designation for the property. The Planning and Development Board recommended approval of the request on June 5, 2023, and the first reading was approved by the City Council on June 12, 2023. Schwendt presented Ordinance 1947, Price Gregory Vacation Way, to the City Council stating it is located near Crestview Commons. The construction near Fallen Heroes Way will render a portion of Price -Gregory Way unusable as a road. This ordinance will serve to vacate that outstanding portion of Price -Gregory Way as right-of-way and grant it to the adjacent property owner. He then asked the City Clerk to read Ordinance by Title. Schwendt presented Ordinance 1948, Comprehensive Plan Amendment - Commercial Density, to the City Council. He explained the process in working with Kimley-Horn. This process clears any inconsistency in the Code. He then asked the City Clerk to read the Ordinance by Title. Schwendt presented Ordinance 1949, Comprehensive Fee Schedule Amendment, to the City Council. This is an amendment that updates the. schedule and coincides with the annual budget process. He added upon the effective date, building permit fees will be reduced for a period of one year, at which time such reduction may be extended. Senior Planner N. City Clerk Maryanne Schrader read aloud: An ordinance of the City of Crestview, Florida, providing for a retroactive twenty percent reduction of building permit fees; providing for a twenty percent reduction of building permit fees for not less than one year; providing for an amendment updating the comprehensive fee schedule; providing for filing of this ordinance with the Clerk of the Circuit Court of Okaloosa County; providing for authority; providing for severability; providing for scrivener's errors; providing for liberal interpretation; providing for repeal of conflicting codes and ordinances; and providing for an effective date. Mayor JB Whitten called for comment from the Council. Council commented that they approved of the cleaner version which is streamlined for businesses. Mayor JB Whitten called for comment from the public. In hearing none, he called for action. Motion was made by Mayor Pro-Tem Andrew Rencich and seconded by Councilmember Joe Blocker to approve Ordinance 1949 on 1st reading and move to second reading for final adoption. Resolution 2023 - 16 2023-2024 CDBG Annual Action Plan Senior Planner N. Schwendt presented Resolution 2023-16, 2023-2024 CDBG Annual Action Plan, to the City Council. The city is considered an entitlement community. Staff accepted applications which were considered at the Citizen's Advisory Committee (CAC) public meeting held on August 9, 2023. He went over the applications that were received. He added an incorrect number was in the plan, but $50,636 is the approved correct number. City Manager T. Bolduc said we have been diligent in investing in projects that have capital value. This money removes the hurdles that a non-profit would have to overcome in order to provide services, as there is much need on the capital side. 111 Page Senior Planner N. Schwendt said we only received one application last year, and this year we received two more. He added the goal is to help more people. Senior Planner N. Schwendt asked the City Clerk to read the Resolution by title. City Clerk Maryanne Schrader read the Resolution aloud: A Resolution of the City Council of the City of Crestview, Florida, adopting the FY2023-24 Community Development Block Grant Annual Action Plan; and providing an effective date. Councilmember D. Capps clarified the correct numbers are included in the updated plan. He asked if we have received any that do not make the list, and City Manager T. Bolduc responded there were none. Mayor Pro-Tem A. Rencich asked about the declining income, and City Manager T. Bolduc replied the funds are distributed based off demographics and number of participants, so it will fluctuate. Motion by Mayor Pro-Tem Andrew Rencich and seconded by Councilmember Douglas Capps to adopt Resolution 2023-16 as amended and presented. Task Order 2023-01 — Mirage Avenue Roundabout Motion by Mayor Pro-Tem A. Rencich and seconded by Councilmember C. Brown to combine Items 10-1, 2 and 3 together. City Manager T. Bolduc updated the Council stating we are in cooperation with the County for permitting and bidding for a new roundabout intersection and traffic improvement along Mirage Avenue. He added construction would begin toward the next budget year. Council agreed on the importance. Mayor JB Whitten called for action. Final Plat - Shoal River Landing Phase 3A City Manager T. Bolduc stated this is the Final Plat for this review regarding Phase 3A of the subdivision, which encompasses 35.67 acres including 63 lots. There has 121Page been a letter received about the lack of streetlights that was required as part of the development order. He stated that FPL is behind but will add them. Motion by Councilmember Douglas Capps and seconded by Councilmember Joe Blocker to approve the Shoal River Landing Phase 3A Final Plat. Roll Call: Andrew Rencich, Douglas Capps, Cynthia Brown, Joe Blocker, Ryan Bullard. All ayes. Motion carried. 11. City Clerk Report City Clerk Maryanne Schrader stated she did not have a report. 12. City Manager Report City Manager T. Bolduc stated he has received a request from Third Planet stating they would like to participate in our grant program for the Code Compliance and Improvement and Facade grant. He displayed a depiction of their plan on the overhead. City Manager T. Bolduc went over considering approving both grants at the same time for a maximum of $75,000 to expedite progress by combining the two. He added that both the tenant and the property owner may apply. This totals $75,000 for qualified matching expenses. He added this is governed by the Council and CRA. Discussion ensued on the history of writing the policy as separate requests, and City Manager T. Bolduc explained that it gives us the opportunity to review each and ensure the money is used sensibly. Discussion ensued regarding waiving the maximum amount and sending it to the CRA Board as the CRA Board will make the final decision. Council concurred. City Attorney Jon Holloway said he will meet tomorrow with a law firm regarding foreclosure actions. City Manager T. Bolduc mentioned the contract for the city attorney permits him to assign another firm for foreclosure actions. In response to Councilmember R. Bullard on whether Chief McCosker will be included in the meeting, City Manager T. Bolduc replied he will be included. City Manager T. Bolduc announced Crestview Commons is completely open and Chipotle is being built. Barry met with another developer on a similar project today. He added there is no slowing down on the annexations. 13. Comments from the Mayor and Council Mayor JB Whitten called for comment from the Council. Councilmember C. Brown said she represented the city for a charitable event. The Gospel music concert to help collect school supplies was successful. She also attended the Bush House event last Saturday, which was nice. There will be another event on September 9th from 10 to 2 adding the Bush House holds an event on the second Saturday of every month. 131Page In response to Councilmember J. Blocker regarding an update of the signs downtown, City Manager T. Bolduc said all of the signs will be demolished. They are coordinating with the Tourist Development Council to assist with new signage. Mayor Pro-Tem A. Rencich asked for a downtown construction update, and City Manager T. Bolduc said the engineering firm is renewing the plans, so he should be able to update the Council the end of September. Mayor JB Whitten said the Florida League of Cities conference was a great event. He received many interesting recommendations and will bring them back at the next meeting. 14. Comments from the Audience Mayor JB Whitten called for comment from the public. Paul Raines, who lives off of PJ Adams, mentioned the vibrating roller that is used during construction is causing vibrations in the neighborhood. The walls are shaking, and he is concerned about potential damage to his premises. Mayor JB Whitten said PJ Adams is a County project, however, he will assist him in contacting the county engineer. Kevin Romero came forward stating he had to purchase new plumbing at a cost of $10,000 because of the construction vibrations. Mayor Whitten also took his phone number. Next, Shannon Hayes came forward and applauded the City Council on how they are conducting the meetings. He invited the Council to an "Evening of Black Culture" event on August 19th at 6 p.m. at Carver Hill Center. The event is dedicated to teachers. He also thanked Councilmember C. Brown for attending the fundraiser concert. He also took a citizen on a tour of Crestview and applauded the Council for being proactive towards the growth. 15.
