HomeMy Public PortalAbout12-09-1965 BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF RICHMOND, INDIANA, DECEMBER 9, 1965. The Board of Public Works and Safety of the City ofā€˛Richmond, Indiana, met in regular session in the City Hall in said City Thursday, December 9, 1965 at the hour of 9:00 a.m. (est). Mr. Jameson presiding with the following members being present: Mr. Gehr and Mr. Kemper. The following business was had to-wit: The Clerk read the minutes of the previous meeting. There being no corrections or additions Mr._ Kemper moved the minutes be approved as read. Mr. Gehr seconded this motion and on voice vote was unanimously carried. Fire Chief Fredricks advised the Board that Corbet Boswell has satisfactorily completed his year as Probationary Fireman and recommended that he be promoted to the rank of regular fireman as of December 1, 1965. Mr. Kemper moved the Board concur in the recommendation of the Fire Chief, seconded by Mr. Gehr and on voice vote was unanimously carried. Mr. Russell Robbins, representing the interest of the Whitewater Realty Corp., in the matter of theDeclaratory Resolution No. 1-1965,. which was adopted by the Board of Public Works and Safety November 4, 1965, was in attendance. , Mr. Robbins presented proof of publication of notice printed in the Richmond Palladium-Item, a newspaper of general circulation in the City of Richmond, Indiana on the dates of November 9-16, 1965, that a public hearing would be held on the ; date of December 9, 1965 at the hour of 9:00 o'clock a.m. EST. on Declaratory Resolution No. 1-1965. Mr. Kemper examined the proof of publication and found the same to be correct and in order and moved said proofs of publication be received and filed. Mr. Gehr seconded this motion and on voice vote wqs unanimously carried. December 9, 1965 being the date designated to consider any remonstrances that may be filed in the matter of the Declaratory Resolution No. 1-1965. There being no remonstrance filed and after hearing all persons interested, Mr.Kemper moved the Board of Public Works and safety sigh the following RATIFICATION OF DECLARATORY' RESOLUTION TO VACATE EASEMENT STRIP, and further that the same be made a record of this meeting. Mr. Gehr seconded this motion and on voice vote was unanimously carried RATIFICATION OF DECLARATORY RESOLUTION TO VACATE EASEMENT STRIP WHEREAS, the Board of Public Works and Safety of the City of Richmond, in -the State of Indiana, did gg the 4th day of November, 1965, duly adopt Declaratory Resolution No. 1-1965, to vacate a utility easement strip in the City of Richmond, Indiana, which said easement is more particularly described as follows, to-wit: Beginning at the Northeast corner of Lot Number 47 in Hale Terrace Subdivision, First Addition to the City of Richmond, Wayne County, Indiana, and running thence South along the east line of said lot to the southeast corner thereof; thence West along the south line of said lot 5 feet; thence North parallel to the east line of said lot to the north line thereof; thence East along said north line 5 feet to the place of beginning; and, WHEREAS, said Board has fixed Thursday, December 9, 1965, at 9 O'clock A..M. (EST) as the date upon which remonstrances may be filed or presented by persons interested in or affected by said resolution; and, WHEREAS, notice of said resolution has been duly published in the Palladium- Item, a newspaper of general circulation printed and published in the City of Richmond, Indiana, on the following day;es: November 9, 1965 and November 16, 165; and, WHEREAS, no remonstrances have 'been filed or presented; NOW THEREFORE, BE IT RESOLVED, By the Board of Public Yorks and Safety of the City of Richmond, in the State of Indiana, that it ratifies and confirms Declaratory Resolution No. 1-1965, and does now vacate said five foot utititytpaseraent strip running along the entire East side of Lot Number 47 in Hale Terrace Subdivision, First Addition to the City of Richmond, Wayne County, Indiana, which easement is more particularly described as follows: Beginning at the Northeast corner of Lot Number 47 in Hale Terrace Subdivision, First Addition to the City of Richmond, Wayne County, Indiana, and running thence South along the east line of 'said lot to the southeast corner thereof; thence West along the south line of said lot 5 feet; thence North parallel to the east line of said lot to the north line thereof; thence East along said north line 5 feet to the place of beginning. 60 All as shown by plat of said Hale Terrace Subdivision, First Addition to the said City of Richmond, in Plat Book 9, page 275 of the Records of the Recorder of Wayrie County, Indiana, and on file in the Office of the Department of Public Works and Safety of said City. Reeg, City Clerk Police Chief Stultz by letter requested permission to have Charles E. Benner,Jr. age 25 appointed to the Richmond, Indiana Police Department as a probationary officer as of December 16, 1965. Mr. Benner has passed all the requirements that are necesdary for this appointment. Mr. Kemper moved that the Board concur in the request of Chief Stultz and Charles E. Benner, Jr. be appointed as probationary officer to the Richmond Police Department as of December 16, 1965. Mr. Gehr seconded this motion and on voice vote was unanimously carried. Mr. Roy Ridge, Program director of WKBV by letter requested that parking be re- moved on the north side of Main Street, between Ninth and Tenth Street and on North Ninth from Main to the first alley on the east side of the street from 7:00 until 1:00 A.M. On the date of December 15, 1965 WKBV is sponsoring it's annual Salvation Army i hristmas Party at the Tivoli and this reserved space request will be used by the Jaycees who will be making trips to, and from the Tivoli Theatre. Mr. Kemper moved the request be granted provided that all safety measures will be under the supervision of the Police Department. Mr. Gehr seconded this motion and on voice vote was carried. Chief Stultz said his department will co-operate. Miss Francis Mayhew, Executive Secretary of the Wayne County Tuberculosis Assn. requested permission to station a chest x-ray unit on the east side of South Sth St. in front of the Knollenberg >nnex entrance December 13th to the 17th. Mr. Gehr moved the request be granted, seconded by Mr. Kemper and on voice vote was unanimously carried. Chief Stultz presented a letter from the Mosier Reasearch Products, Inc., of Danbury, Connecticut requesting permission from the Board of Public Works and Safety to install a Burglar Alarm System in, the Police Department to serve the J.C.Penney ;More, Richmond2, Indiana. Chief Stultz reported that the Police Department would not object to such an installation if it works in a manner that it does not interrupt the duties of the officer on duty in the dispatcher's office by excessive noises. Mr. Kemper moved the Board grant permission to Chief Stultz to sign the letter of request granting the Mosier Reaearch Products, Inc. to install the Burglar Alarm in the Police Department. Mr. Gehr seconded this motion and on voice vote was unanimous- ly carried. A letter was received from the A. & B. Music Co., 10 South 9th Street requesting permission to play Christmas carols which will be on recordings and will be amplified at a low volume, audible only in front of the store. The hours to start December 10th and continue through the Christmas Store hours. Mr.Kemper moved the request be granted provided that there are no complaints re- ceived from citizens. This motion was seconded by Mr. Gehr and onvoice vote was un- animously carried. Mr. Fred Lichtenfels appeared before the Board and reported that he had damaged his automobile in the sum of approximately U55.00. This damage was done when he hit a sewer inlet at South 7th and "M" Street which the City has since repaired and put in a safe condition. Mr. Kemper explained that Mr. Lichtenfels would have to file suit, against the City as there isn't funds available to pay this damage. Mr.Kemper presented, a contract between the,City of Richmond, Indiana and the Wayne Township for fire protection for the year 1966. Mr.Kemper moved the Board sign the contract, seconded by Mr. Gehr and on voice vote was unanimously carried. The Board declined further action on signing a contract with the Rogers Bird Exterminators to rid the birds at the building at the intersection of South 9th & "E" Streets, owned by the City.
