Dear Property Owner:
You are hereby formally notified that on October 17, 2023, at 5:30 P.M., there will be a Public Hearing
at City Hall, located at 198 Wilson Street North, Crestview, Florida 32536 in the Council Chambers. This
meeting is being held concerning violations that continue to exist on a parcel of property belonging to
you located at 998 Walnut Avenue West, Crestview, FL 32539 more particularly described as:
PIN# 17-3N-23-2490-0120-0060 LEGAL DESCRIPTION: CRESTVIEW LOT 6 BLK 120
The Special Magistrate has the power to levy fines up to $250 per day for a first violation, and up to
$500 per day for a repeat violation. If the Special Magistrate finds the violation to be irreparable or
irreversible in nature, a fine, not to exceed $5,000 per violation, may be imposed.
If a violation, or the condition causing the violation, presents a serious threat to the public health, safety,
and welfare, or if the violation is irreparable or irreversible in nature, the Special Magistrate will notify
the local governing body, which may make all reasonable repairs required to bring the property into
compliance, and charge the violator with the reasonable cost of the repairs along with the fine imposed.
If the City prevails in prosecuting a case before the Special Magistrate, it shall be entitled to recover all
costs incurred in prosecuting the case before the Special Magistrate, and such costs may be included in
the lien authorized under FS 162.09(3).

A certified copy of an Order imposing a fine, or a fine plus repair costs, will be recorded in the Okaloosa
County Public Records, and thereafter shall constitute a lien against the land on which the violation
exists and upon any other real or personal property owned by the violator.
You have the right to obtain an attorney, at your own expense, to represent you before the Special
Magistrate.
If you desire a verbatim transcript of the proceedings for appeal purposes, you should arrange for a court
reporter to attend the hearing.
The Crestview Special Magistrate was created pursuant to Florida Statue 162. The purpose of the Special
Magistrate is to facilitate the enforcement of local and state laws.

(w)Fences and walls: Fences and walls shall be maintained in
a safe and structurally sound condition, in good repair with
a material designed for this purpose. Fences shall be free
from loose or rotting materials. Metal fencing shall be free
from rust or deterioration. Fences shall comply with the
standards for fencing as provided in the Land Development
Code.
LDC Chapter 7.01.03 (b)
1. Fences and walls must be constructed of wood, masonry,
stone, wrought iron, chain link, vinyl, welded wire, or
composite materials.
CORRECTIVE ACTION REQUIRED :
The violation(s) may be abated by removal and/or repair of
all unapproved, unpermitted or deteriorating fences. Permits
may be required for repair or replacement of fencing. For

(s) Accessory structures: Garages, storage buildings and all
other accessory structures shall be maintained and kept in
good repair and sound structural condition.
Chapter 38 Section 66. Accessory Structures
Garages, storage buildings and all other accessory
structures shall be
1. Used for the purposes allowed by the Land Development
Code.
2. Maintained in good repair and sound structural condition.
Structures attached or unattached, to the principal
structure, which are found in disrepair, shall be repaired
or demolished within the timeframe set within the Notice of
Violation. Maintenance of accessory structures shall comply
with the following:

( 1) The exterior of the building and premises to include
but not limited to parking areas and landscaped areas shall
be maintained in a sound, clean and neat condition.
(2) Signs shall be maintained in good condition. Where the
sign structure remains, the sign faces are to be replaced
with blank panels (permit required). The design and color
are subject to the standards of the Land Development Code.
(3) All advertising structures, awnings and accompanying
supporting members shall be maintained in good repair and
shall not constitute a nuisance or safety hazard.
Advertising structures or awnings not properly maintained in
accordance with this subsection shall be removed. Awnings or
marquees made of cloth, plastic or a similar material shall
not show evidence of tearing, ripping or holes. Upon removal
of an advertising structure, such as a sign, all supporting
members shall be removed. Awnings must be repaired or
replaced to original condition. Where supporting members
have been left from sign removal prior to adoption of the
ordinance from which this chapter is derived, such
supporting members shall be removed within three months of
the effective date of such ordinance. Nothing in this
subsection shall be construed to authorize any encroachments
on streets, sidewalks, or other parts of the public
right-of-way.
(4) Where parking areas are to be barricaded to prohibit
vehicular travel, it shall be accomplished by installation
of parking bumpers pinned to the pavement.
CORRECTIVE ACTION REQUIRED :
The violation(s) may be abated by:
1. Using the accessory structure in a manner allowed by the
Land Development Code.
2. Obtain a building permit and repair the accessory
structure, or, obtain a demolition permit and demolish the
accessory structure. Remove all demolition debris from the
property.
(1) Maintain the exterior of the building and premises in a
sound, clean and neat condition.
(2) Repair or replace sign. Replace sign face with blank
panel, in accordance with standards set in Land Development
Code.

Chapter 38 Section 65
(e) Exterior walls. Exterior walls of buildings shall be:
(1) Maintained free from holes, breaks, and loose or rotting
materials; and
(2) Maintained, weatherproofed and surfaces properly coated
as needed to prevent deterioration. Exterior finishes must
be of material designed for such purposes and installed in
accordance with the manufacture's specifications. For
repairs, like materials must be used. Decorative features
such as cornices, belt courses, corbels, trim, wall facings
and similar decorative features shall be maintained in good
repair with proper anchorage.
(3) Any graffiti shall be removed or repainted to match
existing surfaces.
(j) Exterior surface treatment. All exterior surfaces,
including by way of example and not limitation, doors and
window frames, cornices, porches, decks, trim, balconies,
fences, and docks, shall be maintained in good condition.
Exterior surfaces shall be protected from the elements and
decay by painting or other protective treatment applied in
accordance with the manufacturer's instructions. Peeling
paint is prohibited and surfaces shall be repainted. All
metal surfaces shall be coated to inhibit rust and corrosion
and all surfaces with rust or corrosion shall be stabilized
and coated.
CORRECTIVE ACTION REQUIRED :
(e) The violation(s) may be abated by obtaining required
permits and repair or replacement of holes, breaks, and
loose or rotting materials. Maintenance, proper coating and
weather proofing as needed to prevent deterioration. For
repairs, like material must be used. Repaint of graffiti
shall match existing surfaces.
(j) The violation(s) may be abated by obtaining required
permits and repair or replacement of exterior surfaces, to
include protection from the element and decay by paint or
other protective treatment. Repair of peeling pant, and
coating of metal surfaces to inhibit rust and corrosion.
Coating and stabilization of all surfaces with rust or
corrosion.

(i) Exterior doorframes and storefronts: Exterior doorframes
and storefronts shall be maintained in good condition. All
moldings shall be securely attached to the structure and
maintained in good condition without splitting or
deterioration.

The violation(s) may be abated by repair or replacement of
exterior door, door frame, storefront, or molding. Building

(k) tGrass, weeds, and
uncultivated vegetation: All grasses or weeds, and
uncultivated vegetation, shall not exceed twelve (12) inches
in height on improved property, including the area between
the edge of the pavement in the street and the lot line.
Bushes, trees, and other landscape ornamentals shall be
maintained in a manner that will not create any unsafe or
unhealthy conditions. Landscape features shall be maintained
to ensure that the growth of such feature does not damage
any structure.
CORRECTIVE ACTION REQUIRED :
You may abate the violation by removing the overgrown or
uncultivated vegetation from the property.
