AiVFNDING N SUPPLEMENTING § 71 -23 ENTITLED
"UNLICENSED PREIVESES" OF THE CODE OF THE
BOROUG14 OF CARTERET
BE IT OPDAiNED by the Mayor and Borough Council of the Borough of
Carteret (the "Borough ") that the Code of the Borough is hereby amended and
supplements as follows:
Section I The present text of §71 -23. "Unlicensed premises." is hereby
repealed and replaced with the following: "The restaurants, dining
rooms or other public places where food and liquid refreshments
are served to the general public and where the consumption of
alcohol may be permitted pursuant to N.J.S.A. 2C:33 -27 shall be
limited to those restaurants serving hot food prepared on premises
and served by wait staff to a mi it um of forty (40) seals open to
the general public.
Section 2 All ordinances or parts thereof inconsistent with the provision of
this ordinance are hereby repeated limited to the extent of any
such inconsistency.
Section 3 If any section, paragraph, sub - division, clause or provision of this
ordinance is adjudged invalid, such adjudication shall apply only to
the section, paragraph, sub - division, clause or provision so
adjudged and the remainder of this ordinance shall be deemed
valid and effective.
Section 4 This ordinance shall take effect upon its passage and
publication according to applicable law.

The foregoing ordinance was
introduced at a meeting of the
Council of the Borough of Car-
teret held August 4, 2016 when
it was adopted on first reading.
The said ordinance will be fur-
ther considered on second
reading for final adoption at a
meeting of said Council of the
Borough of Carteret on Decem-
ber 1, 2016 at approximately
6:00 P.M., Borough Hall /Council
Chambers, 61 Cooke Avenue,
Carteret, New Jersey at which
time and place all persons inter-
ested will be given an opportu-
nity to be heard.
