HomeMy Public PortalAbout2000-23 Employee ManualE nY — ORDINANCE 2000 - 23 AN ORDINANCE AMENDING CITY OF GREENCASTLE'S EMPLOYEE MANUAL WHEREAS, City of Greencastle Police and Fire Department Employees currently are not covered for short-term disability or eligible for Worker's Compensation to cover loss of salary due to an accident, injury or occupational disease incurred in the course of the Employee's employment; and WHEREAS, the City desires to compensate employees injured in such a mariner for 'a reasonable amount of time; and 0� WHEREAS, upon use of all benefit days, Fire Department Employees are eligible for PERF benefits. NOW THEREFORE be it ordained by the Common Council of the City of Greencastle that the City of Greencastle Personnel Manual be amended to include the attached Injury Leave Policy. All other terms and conditions of the Personnel Manual shall remain in frill force and effect. Jones, ft\ord>_000 >, City of Greencastle Injury heave Policy Injury Leave Each regular full time employee of the City of Greencastle Police Department and Fire Department shall be eligible for injury leave. Injury leave, as distinguished from sick leave, shall mean paid leave given to an employee due to absence from duty caused by an accident, injury or occupational disease that occurred while the employee was engaged in the performance of his/her duties. This policy shall apply only to accidents, injuries or occupational disease which occurred in the course of employment, and shall be granted only upon submission of adequate documentation from a physician designated by, or otherwise approved by the City. 1. Time Span: a. Initial Leave: Employees are eligible for up to a maximum of the following amount of injury leave for each accident, injury or occupational disease occurring in the course of an employee's employment: Fire Department - 216 hours Police Department - 160 hours • 2. Sick Leave /Comp Time: If an employee uses the maximum injury leave listed above, and the employee is not able to return to work, as determined by the City's designated physician, the employee must then take any accumulated sick leave or compensatory time off (comp time) which the employee has accumulated. 3. Additional Injury Leave: After using all accumulated sick leave and comp time, an employee may request, in writing, additional injury leave up to the following amounts: Fire Department - 216 hours Police Department - 160 hours Said request must be in writing and must be accompanied by sufficient supporting documentation from a physician designated or otherwise approved by the City of Greencastle. Said request must indicate that the employee is not able to return to work, even in a light duty capacity. Said request shall be in writing and be submitted to the Clerk/Treasurer for consideration for approval at the sole discretion of the employee's Department FIead and the Mayor. 4. Notification: The need for injury leave must be communicated to the employee's department head and Clerk/Treasurer at the earliest practical time after the injury occurs. The physician designated by the City must provide a narrative of the nature of the injury or illness, the approximate length of time before the employee may return to work, and any restrictions the employee may have. n S. Prohibitions: Generally, no compensation shall be allowed for any injury or illness when due to: intentional self - infliction intoxication commission of a felony or misdemeanor failure or refusal to use a safety appliance willful failure or refusal to obey a written or printed rule posted in conspicuous place. - willful failure or refusal to perform a statutory duty - willful failure to follow a written policy or procedure of the City of Greencastle 6. Examinations: An employee with a minor injury shall seek medical attention from the department's designated physician. An employee with serious or life threatening injury should be transported to an emergency room of a hospital. An employee on leave as a result of an injury or illness incurred while on the job may be required to submit to a physical or mental examination by a licensed professional designated by the City of Greencastle, PERF representative, or insurance carrier. The City of Greencastle shall pay the cost of the examination. An employee on injury leave shall agree to release any and all medical information relevant to the injury and /or illness to his or her department head, the Clerk - Treasurer or the workers compensation insurance carrier. 7. Limited Duty Assignments: An employee may, with the approval and recommendation of the City's designated physician, request to return to work with specific restrictions as to the type of work the employee is capable of performing. • The City shall consider the request and shall grant such light duty assignment if an appropriate light duty assignment is available. The City is under no duty to create a position or light duty assignment if such is not needed by the City. An employee may be assigned to work in City departments other than his /her permanently assigned department. The employee's Department Head and Mayor shall review the request and make a determination, at their sole discretion, whether to grant light duty. 8. Public Employees Retirement Fund (PERT): When a Police Officer or Firefighter has exhausted his/her injury leave, sick leave, vacation time, personal time and compensatory time, he or she may apply to the local Police or Fire Pension Board for full -time disability. No employee shall be allowed to receive disability benefits from the City that exceed 100% of his /her weekly wages. 9. Miscellaneous: This policy shall not affect, extend or limit the requirements and time limits of the Family and Medical Leave Act, which may run concurrent to injury leave.
