Mayor Yu called the City Council Regular Meeting to order at 7:31 p.m. in the Council Chambers located at 5938 Kauffman Avenue, Temple City. 2. ROLL CALL PRESENT: Councilmember-Blum, Chavez, Vizcarra, Sternquist, Yu ABSENT: Councilmember-None ALSO PRESENT: City Manager Pulido, City Attorney Vail, City Clerk Kuo, Assistant to the City Manager Haworth, Administrative Services Director Hause, Parks and Recreation Director Burroughs and Public Safety and Services Manager Sahagun. 3. INVOCATION Pastor David Palmer from the First Methodist Church provided the Invocation. 4. PLEDGE OF ALLEGIANCE Mayor Yu led those present in the Pledge of Allegiance to the Flag. 5. CEREMONIAL MATTERS — PRESENTATIONS A. INTRODUCTION OF CAMELLIA FESTIVAL ROYAL COURT City Council presented certificates of recognition to the Camellia Festival Royal Court. B. DEPUTY OF THE YEAR —2012 City Council recognized 2012 Deputy of the Year, William Harrington. C. FIREFIGHTER OF THE YEAR —2012 City Council recognized 2012 Firefighter of the Year, Fire Fighter Specialist Andrew Otton. City Council Minutes February 5, 2013 Page 2 C. PET OF THE MONTH Ms. Pat Brayer, San Gabriel Valley Humane Society Director, gave a presentation on the featured pet for the month. Mayor Yu moved the report for Los Angeles County Sheriff Activities for November and December, 2012 from Communications to Presentation. D. LOS ANGELES COUNTY SHERIFF ACTIVITIES FOR NOVEMBER AND DECEMBER, 2012 Sergeant Miranda reviewed Temple City's crime statistics and Sheriff's activities for the month of November and December, 2012. 6. PUBLIC COMMENTS ON ITEMS NOT LISTED ON THE AGENDA — None 7. CONSENT CALENDAR Councilmember Blum moved to approve the Consent Calendar, seconded by Councilmember Vizcarra and unanimously carried. Recommendation: approve Items A through K per recommendations A. APPROVAL OF MINUTES 1) Minutes of the City Council Special Meeting of January 10, 2013; 2) Minutes of the City Council Regular Meeting of January 15, 2013; and 3) Minutes of the Special City Council Meeting of January 30, 2013. Recommendation: Approve. B. PLANNING COMMISSION ACTIONS — MEETING OF JANUARY 8, 2013 The City Council is requested to review the Planning Commission Actions of their meeting on January 8, 2013 Recommendation: Receive and file. C. PUBLIC SAFETY COMMISSION ACTIONS — MEETING OF JANUARY 23. 2013 City Council Minutes February 5, 2013 Page 3 The City Council is requested to review the Public Safety Commission actions of their meeting on January 23, 2013. Recommendation: Receive and file. D. RELEASE OF SECURITIES FOR PARCEL TRACT NO. 063510 FOR ROAD IMPROVEMENTS AT 5343 — 5353 SANTA ANITA AVENUE The developer (i.e., JCG-JDG Investments, LLC) submitted a Surety Bond in the amount of $15,600 to ensure that road improvements were completed at Tract No. 063510. The Los Angeles County Department of Public Works notified the City that the road improvements were completed, inspected and found to be in compliance with the approved plans. The City Council is requested to approve the work that has been completed, accept the improvements for public use and maintenance and approve the release of the deposited security. Recommendation: 1) Approve the work that has been completed and accept the road improvements for public use and maintenance; and 2) Authorize the release of the security in the amount of $15,600 for Tract No. 063510. E. ACCEPTANCE OF BID AND AWARD OF CONTRACT FOR THE EXPANSION OF THE PERFORMING ARTS PAVILION DANCE FLOOR IN TEMPLE CITY PARK During last year's mid -year budget review on March 8, 2012, the City Council directed staff to expand the concrete area of the Performing Arts Pavilion and to work with the Public Arts Advisory Committee (PARC) to develop an artistic component to be included in the additional concrete. The City Council is requested to accept the bid submitted by Parsam Construction, Inc. in the amount of $6,500 as the lowest, responsive and responsible bid; and authorize the City Manager to execute a Public Works Contract with Parsam Construction, Inc. Recommendation: 1) Accept the bid submitted by Parsam Construction, Inc. for the expansion of the Performing Arts Pavilion dance floor in Temple City Council Minutes February 5, 2013 Page 4 City Park; and 2) Authorize the City Manager to execute the agreement. F. CONSULTANT SERVICES AGREEMENT WITH FUGRO CONSULTANTS, INC. AND NINYO & MOORE The proposed agreements with Fugro Consultants, Inc. will provide quality control, and with Ninyo & Moore will provide quality assurance materials testing services during the Rosemead Project's 16 to 18 month duration. Fugro Consultants, Inc. as the quality control will serve as the primary lab testing consultant, and Ninyo & Moore as the quality assurance will provide random testing as needed. The contracts for the quality control and quality assurance are requirements of the Federal funding sources. The City Council is requested to approve the Consultant Services Agreements with Fugro Consultants, Inc. and Ninyo & Moore. The firms will provide the necessary material testing services to ensure that the Rosemead Project is built per the Project Specifications and all applicable construction codes. Recommendation: 1) Approve a $200,000 Consultant Services Agreement with Fugro Consultants, Inc. for Quality Control Material Testing services associated with the Rosemead Boulevard Safety Enhancements and Beautification Projects; 2) Approve a $50,000 Consultant Services Agreement with Ninyo & Moore for Quality Assurance Material Testing services associated with the Rosemead Boulevard Safety Enhancements and Beautification Projects; and 3) Authorize the City Manager to finalize and execute the Contract Services Agreements with Fugro Consultants, Inc. and Ninyo & Moore. G. AUDIT REPORTS FOR PROPOSITION A, PROPOSITION C, MEASURE R AND TRANSPORTATION DEVELOPMENT ACT ARTICLE 3 FOR FISCAL YEAR 2011-12 The City Council will review the audit reports for Proposition A, Proposition C, Measure R and Transportation Development Act Article 3 Audit Reports for Fiscal Year 2011-12. SECOND QUARTER BUDGET AMENDMENTS The City Council is requested to approve the second quarter (i.e., October — December) budget amendments and amend the adopted Fiscal Year 2012-13 City Budget accordingly. Recommendation: Approve the second quarter budget amendments and amend the adopted Fiscal Year 2012-13 City Budget accordingly. I. SECOND QUARTER TREASURER'S REPORT, REVENUE AND EXPENDITURE SUMMARY REPORTS AND CAPITAL IMPROVEMENT FINANCIAL REPORT The City Council is requested to review the December 2012 Treasurer's Report, Revenue and Expenditure Summary Reports and the Capital Improvement Financial Report. Recommendation: Received and filed reports. J. ADOPTION OF RESOLUTION NO. 13-4890 — APPROVAL OF PAYMENT OF BILLS The City Council is requested to adopt Resolution No. 13-4890 authorizing payment of bills. Recommendation: Adopt Resolution No. 13-4890. K. The City Council is requested to review, receive and file the Petty Cash and Visa Card Reports. Recommendation: Receive and file. 8. UNFINISHED BUSINESS — None 9. NEW BUSINESS A. INTRODUCTION OF ORDINANCE NO. 13-966 AMENDING SECTION 2607 OF THE TEMPLE CITY MUNICIPAL CODE RELATIVE TO DUTIES OF THE PARKS AND RECREATION COMMISSION City Council Minutes February 5, 2013 Page 6 As part of a reorganization of City operations in 2010, the trees and parkways program was transferred from the former Public Services Department to the Parks and Recreation Department. Over the next several months, Parks and Recreation staff reviewed the existing practices and procedures for the trees and parkways division as well as sections of the Temple City Municipal Code relative to street trees. With over 5,800 streets trees in the City's inventory, staff became aware of a need to express the value of the City's urban forest to the public and, proposed an item in the Fiscal Year 2011-13 work plan to build community awareness of the City's urban forestry program. The City Council is requested to review and adopt Ordinance No. 13-966 amending Section 2607 of Article A of Chapter 6 of Title 2 of the Temple City Municipal Code amending the duties of the Parks and Recreation Commission to include management of the City's urban forestry program. Parks and Recreation Director Burroughs gave a brief summary of the staff report. Mayor Yu opened public comment. Mayor Yu closed public comment. Mayor Pro Tem Sternquist made a motion to introduce Ordinance No. 13- 966 for first reading by title only, amending Section 2607 of Article A of Chapter 6 of Title 2 of the Temple City Municipal Code amending the duties of the Parks and Recreation Commission, seconded by Councilmember Blum and unanimously carried. Councilmember Chavez made a motion to schedule the second reading of Ordinance No. 13-966 for February 19, 2013, seconded by Councilmember Blum and unanimously carried. B. PUBLIC HEARING: CONSIDERATION OF MUNICIPAL CODE AMENDMENT TO MODIFY SECTION 9633, "DEVELOPMENT STANDARDS AND DESIGN CRITERIA" SO AS TO ALLOW THE SUBDIVISION OF SHOPPING CENTERS AND MINI -MALLS The proposed code amendment to allow the subdivision of shopping centers and mini -malls in commercial and industrial zones will augment options available for commercial retail developers to attract national tenants and would hereby promote economic development in the community. Furthermore, the code amendment is necessary for the Municipal Code to coincide with the State of California Subdivision Map Act. City Council Minutes February 5, 2013 Page 7 The City Council is requested to approve the Categorical Exemption from California Environmental Quality Act (CEQA) and introduce Ordinance No. 13-967 for first reading by title only. Associate Planner Adam Gulick gave a brief summary of the staff report. Mayor Yu opened public comment. Mark Lai, Temple City resident, spoke in opposition of amending the current municipal code. Mayor Yu closed public comment. City Attorney Vail recommended adding additional subdivision to Section 9336 of the Ordinance to include language that will address projects with parking garages. Section 9336 of the ordinance shall include language pertaining to parking structure condo and or common ownership projects for parking garage and parking structure including underground or subterranean shall comply with all development criteria contained in the applicable zoning classification or if the classification is silent then such criteria is prescribed by the City Building Official and Community Development Director. This language will allow the City to add these into appropriate zones and authorize the City to deal with common ownership and condominium situations with parking garages. Councilmember Chavez made a motion to introduce Ordinance No. 13- 967 for first reading by title only, amending Municipal Code Section 9633 so as to allow the subdivision of shopping centers and mini -malls in the commercial and industrial zones with additional language recommended by the City Attorney to add Parking Structure Condominiums or Common Ownership; and schedule the proposed ordinance for a second reading on February 19, 2013. Seconded by Mayor Pro Tem Sternquist and unanimously carried. 10. COMMUNICATIONS B. Temple City Chamber of Commerce Quarterly Progress Report Peter Choi, Temple City Chamber President/CEO, gave highlights from the Chamber's Quarterly Progress Report. 11. RECESS TO SUCCESSOR AGENCY TO THE TEMPLE CITY COMMUNITY REDEVELOPMENT AGENCY MEETING City Council Minutes February 5, 2013 Page 8 At 8:58 p.m., the City Council recessed to the Successor Agency Meeting. RECONVENE AS CITY COUNCIL The City Council meeting was reconvened at 9:00 p.m. with all Councilmembers present. 12. ACTIONS TAKEN BY CITY AS SUCCESSOR AGENCY TO THE TEMPLE CITY COMMUNITY REDEVELOPMENT AGENCY — None 13. UPDATE FROM CITY MANAGER City Manager Pulido announced upcoming city events: Permanent Vote -By -Mail ballots were mailed out Monday and residents should receive their sample ballot booklet this week. Those who have not received their sample ballot booklet should contact the City Clerk's Office. Deadline to register to vote is February 18 and voter registration form can be obtained at the City Clerk's Office or on-line at www.lavote.net; with the Rosemead Boulevard construction project underway and expected to last through summer of 2014, the city provides various resources for the public to stayed tune. One of those resources is the City's new multi-lingual radio station that provides construction update and traffic advisory in English, Mandarin, Cantonese, and Spanish. New messages are aired on Monday and played through Friday at 5 pm. Community members can also visit the project's website at www.rosemeadblvd.com to listen to broadcast and weekly construction notices and view live traffic info; February 7, Thursday, Neighborhood Watch meeting for area 9 (i.e., Olive Street, Baldwin Avenue, Lower Azusa Road and Temple City Boulevard) will take place at Golden West Baptist Church, 4856 Golden West Avenue, will start at 5:30 p.m., dinner and child care will be provided; February 6, Wednesday, Lunar New Year Celebration, will be held at Live Oak Park from 1030 a.m. to 12:30 p.m. with free dim sum at the picnic shelter while supplies last. Festivity continues on February 8, Friday, during the Senior's Lunch Program starting at 11:45 a.m.; February 15, Thursday, Senior Valentine Luncheon. Those interested in attending the luncheon should call Live Oak Park at 626-579-0461 to reserve a seat; February 19, Tuesday, Mayo's State of City Address from 6:30 — 7:30 p.m. Mayor Yu will update the community on City's accomplishment for 2012 and the upcoming plan of 2013 and forward; the regular City Council meeting will follow at 7:30 p.m. 14. Parks & Recreation Commission Appointment Ad Hoc (Mayor Pro Tem Sternquist & Councilmember Chavez) — Formed 11/06/2012 Councilmember Chavez reported that the task assigned to the Parks and Recreation Commission Appointment Ad Hoc Committee has concluded. He requested the dissolution of the Committee. Mayor Yu concurred. E. Civic Center Master Plan Ad Hoc (Mayor Yu and Councilmember Blum) — Formed 9/18/2012 Councilmember Blum announced that the Committee met on January 25 with consultant and the Committee will meet again on March 1. F. School District/City Standing Committee (Mayor Pro Tem Sternquist & Councilmember Chavez) — Formed 1103/2012 No report. G. Rosemead Boulevard Improvement Project Standing Committee (Mayor Yu & Councilmember Blum) — 6/3/2011 Councilmember Blum reported that the Committee meet about every other week. The Committee last met on January 25 and will schedule another meeting on February 8. H. City Code Review Standing Committee City Council Minutes February 5, 2013 Page 10 (Mayor Pro Tem Sternquist & Councilmember Chavez) — Formed 11/06/2012 No report. Fiscal Year 2012-13 Mid -Year Budget Review Standing Committee (Mayor Yu & Councilmember Blum) — Formed 11/06/2012 Councilmember Blum reported that the Committee has schedule to meet on February 7, Thursday. 16. COUNCIL ITEMS SEPARATE FROM THE CITY MANAGER'S REGULAR AGENDA A. COUNCILMEMBER BLUM Requested that the Parks and Recreation Commission look into the possibility of letting the Ficus trees along Las Tunas grow provide shade on the sidewalk. Also, he requested Community Preservation staff to look into removal of rustic equipment and overgrown weeds on the Gateway pro�ect property. Commented that the City's recent rating for being the 64t safest city in the country is due to the effort of the Sheriff but also the City's very aggressive Neighborhood Watch and graffiti removal program. B. COUNCILMEMBER CHAVEZ Made an announcement of upcoming Sanitation District Annual Earth Day on April 13 from 10 a.m. to 12 p.m. For more information, visit their website at www.lacsd.oro, or call 562-908-4288. Commented that Temple City is the 8th safest City in the state. Our rating is moving in the right direction. C. COUNCILMEMBER VIZCARRA Provided Council with a meeting summary from the San Gabriel Council of Government. Reported that Southern California Edison will be donating approximately 10,000 trees to the communities that they service. D. MAYOR PRO TEM STERNQUIST Requested that the Fiscal Year 2012-13 Mid -Year Budget Review Standing Committee allocate money to reinstated Brush for Kindness Program. Commended the sheriff's for doing an excellent job as Temple City was rated as the 64th safest City in the country. We are thankful for our Sheriff. City Council Minutes February 5, 2013 Page 11 E.
