BOARD OF PUBLIC WORKS AND SAFETY
NOVEMBER 14, 1963
The Board of Public Works-and Safety met in regular session with City
Attorney Cecere presiding - All Members present - The following business
was had to wit :
Attorney John Harlan appeared before the Board, representing the Gennett
Investment Properties concerning the location of a Street Light and curb
cuts at East First and Main Street. Mr. Swartz of Muncie proposes to
build a Pizza Restaurent there. The matter referred to City Engineer
Sherick for study and recommendation.
The Board approved a recommendation by Fire Chief Klotz to order the
Richmond Water Works Corporation to install fire protection at the North
end of 36th Street.
The Clerk presented proof of publication that this date had been set to
hear persons interested in Improvement Resolution No. 1061 -1963, "A
SANITARY SEWERAN;.PORTERFIELD AVE" . , the proofs were accepted and orderedi
filed. Ten persons appeared to ask questions concerning the sewer, if
no remonstrance is filed within ten days , a notice to contractors will be
advertised for the construction.
City Engineer Sherick moved that the Board adopt a Resolution to acquire
certain easements and right-of-ways along the route of the proposed Berry
Field Storm Sewer by condemnation, seconded by City Controller Tiffany,
unanimous Board approval. The Clerk was instructed to advertise a public
hearing and notigy the property owners by registered mail, of the Boards
action.
The Board approved the attendance of, Fire Chief klotz and A`ssistent Fire
Chief: Price at the Annual Indiana Fire School at Purdue University
November 21 through 23rd.
The Board approved the sale of approx. 0.03 acres more or less of City
owned property at South 6th & "E" Street for $200.00.

RESOLUTION OF THE BOARD OF PUBLIC
WORKS & SAFETY
WHEREAS , the City of Richmond, Indiana, by and through its Board of Public
Works & Safety, has heretofore determined that it is of public utility and
benefit to construct the Berry Field storm Sewer, and,
WHEREAS, the said sewer is to be constructed with fund here-tofore
appropriated by the Common Council of the City of Richmond from the Storm
Sewer Cumulative Construction Fund, and,
WHEREAS , the said Board of Public Works & Safety has heretofore
entered into a contract with the DeBolt Concrete Company, Inc . for the
construction of asid sewer pursuant to Plans and Specifications heretofore
prepared by Hnery B. Steeg & Associates , Consultant Engineers , and ,
WHEREAS, the Board now finds that it will be necessary to acquire
certain easements and rights-of-way along the route of the proposed Berry
Field Storm Sewer, which said easements and right-of-way are described as
follows, to-wit : Part of Lot 49 in the Berry Field Addition, described as
follows :
Beginning at the Southwest corner of Lot 49: thence Southeasterly
along the South line to the Southeast corner of Lot 49: thence
North 17.5 feet : thence West 12 feet : thence Northwesterly to the
place of beginning.
Also a temporary easement for construction 15 feet in width
adjacent to and parallel to the North line of the above described
permanent easement.
A plat of said easement is on file at the office of the City .
Engineer, City Building, Richmond , Indiana.

Part of the Northwest Quarter of Section 28, Twonship 14 North,
Range 1 West , in Wayne County, Indiana, described as follows :
Beginning at a point 1126.62 feet East and 1875.83 feet South of
the Northwest corner of the Northwest Quarter of said Section 28;
thence East 338. 79 feet ; thence North 25 feet; thence West 338.79
feet ; thence South 25 feet to the place of beginning.
Also a temporary easement for construction 50 feet in width
described as follows : Beginning at a point 12 .5 feet South of the
beginning point of the above described permanent easement ; thence
East 338.79 feet ; thence North 50 feet ; thence West 338.79 feet;
thence South 50 feet , to the place of beginning.
A plat of said easement is on file at the office of the City
Engineer, City Building, Richmond, Indiana.
Part of the Northwest Quarter of Section 28, Township 14 North,
Range 1 West , in Wayne County, Indiana, described as follows :
Beginning at a point 1465.41 feet East and 1850.83 feet South of
the Northwest corner of the Northwest Quarter of said Section 28;
thence South 285 feet; thence East 260 feet; thence South to the
North line of Cart Road; thence Northeasterly along the North line
of Cart Road 30 feet; thence North to a point 260 feet South and
285 feet East of the place of beginning; thence West 260 feet ;
thence North 260 feet; thence West 25 feet to the place of beginning.
Also a temporary easement for construction described as follows :
beginning at a point 25 feet North of the beginning point of the above
described permanent easement; thence South 310 feet; thence East 247.5
feet ; thence South to the North line of Cart Road; thence Northeasterly
along the North line of Cart Road 60 feet; thence North to a point 285
feet South and 297.5 feet East of the place of beginning; thence West

247.5 feet; thence North 285 feet ; thence West 50 feet to the place of
beginning.
A plat of said easement is on file attire office of the City Engineer, City
Building, Richmond, Indiana.
BE IT RESOLVED by the Board of Public Works & Safety of the City of Richmond,
Indiana, that;
1. That the acquisition by appropriation and condemnation of certain
easements and rights along the route of the proposed Berry Field Storm
Water Sewer, . as herein before described, be deemed to be necessary and
expedient and be hereby approved.
2. A public hearing shall be held on the question of the public
necessity of the acquisition of said easements and rights-of-way as set
forth in this resolution at the hour of 10;00 o 'clock A. M. (E. S. T. )
on the 5th day of December, 1963, which hearing Shall be held at the office
of the Board of Public Works & Safety, City Building, Richmond , Indiana.
3. Notice of the adoption of this Resolution and the purport thereof ,
setting out the date on which said public hearing will be held shall be
publised once each week for two (2) consecutive weeks in the Palladium-
Item (the only newspaper of general circulation printed and published
in the City of Richmond, and of general circulation in Wayne County) ,
the last of which publication shall be not less than ten (10) days prior
to the date of such public hearing, and further that a like notice shall
be sent by certified mail, return receipt requested to the owner of all
lands to be appropriated under and by this said Resolution.
