Taylor called the Hearing to order at 5:30 p.m. 2 Administration of oath to staff/ Respondents /Witnesses Special Magistrate S. Taylor swore in all participants for the quasi-judicial segments of the meeting at 5:35 p.m. 3 Red Light Hearing 4 Code Enforcement Hearings 4.1. Case 23-997 Special Magistrate S. Taylor opened Case #23-997 for the property located at 686 East Cobb Ave, Crestview. Code Enforcement Officer M. Tatom presented the case and requested that Exhibit 1 be entered into as evidence. Special Magistrate S. Taylor accepted Exhibit 1 into the record. Mr. Rice, property owner, objected to how the information was obtained. He did not dispute the code violations but only how the information was obtained. Special Magistrate S. Taylor thoroughly reviewed the presented case information with the property owners Mr. and Mrs. Rice. Code Enforcement Officer M. Tatom informed Mr. Taylor that when she was working in the capacity of the Animal Control Officer when doing an animal welfare check on August 30th, she noticed code violations and proceeded to inform the property owner of the visible violations and how they could go about rectifying them. Special Magistrate S. Taylor made the decision to exclude the pictures from the initial August 30th inspection and said he would start the analysis of the evidence gathered starting September 6th. Special Magistrate S. Taylor found that there were violations and informed the property owner that they had one hundred twenty days (120) to bring the property into compliance and stated the cost of the hearing is $250.00. Page 1 1 4.2. Case 23-949 Special Magistrate S. Taylor opened Case #23-949 Wilson stating the property is located at 648 East Griffith Ave, Crestview, Florida. Code Enforcement Officer M. Tatom presented the case violations. She asked that Exhibit 2 be entered into the record. Special Magistrate S. Taylor accepted Exhibit 2 into the record. Mr. Oglesby, the property owner, stated that most of the violations should be cleared but needed to know what else needed to be done for the property to not be in violation. Special Magistrate S. Taylor reviewed the violations with the property owner. Code Enforcement Officer M. Tatom then went through each violation to be sure the property owner understood what needed to be addressed on the property. Special Magistrate S. Taylor reviewed the documents and concluded that the property did stand in the violations submitted. He then ordered that the owner had on or before the next one hundred twenty days, to bring the property into compliance and ordered the payment of $250 for the Hearing. 4.3. Case 23-473 - Removed 4.4 Case 23-896 Special Magistrate S. Taylor opened Case #23-896 for the property located at 798 S. Wilson Street, Crestview. Code Enforcement Officer D. Lawson presented the case and requested that Exhibit 4 be entered as evidence. Special Magistrate S. Taylor accepted Exhibit 4 into the record. Mr. Devin Jones, the property owner, stated that during the time of the inspections and re -inspections he was going through serious surgeries. He then noted that on March 9th there was a development order filed with Community Development Services. The order was issued on July 7, 2022. During this whole process Mr. Jones informed the magistrate that he incurred fines since the development order was issued. He stated that there is a state statute that protects him being that he has an active development order. A discussion ensued. Special Magistrate S. Taylor stated that when there is a development order there are specific rules and regulations you must follow pursuant to the development order. He mentioned he would need to review the development order that is in place. He added he did not have enough necessary evidence to rule as the property is subject to a development order. Special Magistrate S. Taylor stated that there is not a violation for the property. 5 Adjournment Special Magistrate S. Taylor adjourned the Hearing at 7:18 p.m. Minutes submitted by, Natasha S.
