Present: Mayor, Thomas Anderson; Councilmembers, Wilfred Scherer, Anne Theis, Stephen Schmit; Clerk -Treasurer, Donna Roehl; Public Works Director, James Dillman Zoning Administrator, Loren Kohnen; Attorney, Ron Batty; Police Chief, Rick Rabenort Absent: Councilmember, Robert Mitchell 1. ADDITIONAL AGENDA ITEMS Moved by Scherer, seconded by Theis to discuss the following additional items: Independence Beach skating pond Hamel Legion Park Pioneer Creek Watershed District Clean Water Partnership Motion declared carried 2. MINUTES OF DECEMBER 19, 1989 Moved by Schmit, seconded by Theis to accept minutes of December 19, 1989, as presented. Motion declared carried 3. POLICE DEPARTMENT Office Assistant Hiring Rick Rabenort stated that they were still checking references office assistants position. He recommended the starting wage hour work week. Moved by Theis, seconded by Scherer to pay $6.25 per hour for for the office assistants position in the police department. Motion declared carried * CONSENT AGENDA of the finalists for the be $6.25 per hour for a 24 24 hours of work, per week, 4. PUBLIC WORKS DEPARTMENT Hackamore Rd./Rolling Hills Rd. Jim Dillman reported that work on Rolling Hills Rd. and Hackamore Rd. had been completed satisfactorily and that the dollar amount requested by Corcoran is correct. Moved by Scherer, seconded by Schmit to pay the City of Corcoran $90,401.68, for improvements to Rolling Hills Rd. and Hackamore Rd., according to the cities agreement. Motion declared carried Wessin-Jubert-Coplin, Special Assessments Ron Batty explained that the required $250 had been paid by Wessins, Juberts and Coplins and the prepared resolution completes the cancellation of their Tamarack Dr. special assess- ments. Moved by Theis, seconded by Schmit to adopt Resolution 90-1, cancelling Tamarack Dr. special assessments for Arthur Jubert, George Wessin and Sheldon Coplin. Motion declared carried * Public Works Clothing Allowance Moved by Scherer, seconded by Theis to increase the Public Works employees clothing allowance from $240. per year to $300 per year. Motion declared carried 5. PLANNING AND ZONING DEPARTMENT Scott Dallman, Septic System Variance Loren Kohnen stated that scott Dallman, 4602 Wichita Tr. had made application for a variance to allow a shallow trench system to be placed on his property, rather than a mound system. He explained that the soils on the property had been disturbed so that a mound system could not be installed. He reported that the percolation rate was acceptable. Thomas Anderson stated that if approval was given a list of reasons as to why this is diff- erent from other properties, should be given. Mbwed by Scherer, seconded by Theis to authorize preparation of a resolution granting a variance to Scott Dallman to construct a shallow trench septic system at 4602 Wichita Tr. according to Planning Commission recommendations , limiting house to three bedrooms, hardship being a septic system at an existing dwelling. Motion declared carried Inn Kahoots, Letter of Credit Loren Kohnen stated that he and Glenn Cook had reviewed the site improvements at Inn Kahoots and found that everything had been completed except screening of the trash container. He recommended release of $30,000 of their letter of credit, retaining $4275.00. Moved by Theis, seconded by Scherer to release $30,000 of Inn Kahoots Letter of Credit and to retain $4275. for completion of the work, according to recommendation of Loren Kohnen. Motion declared carried 6. CIGARETTE LICENSES Council asked that license holders be asked to moved cigarette machines so that employees can observe the machines, so as to discourage juveniles from buying cigarettes. Moved by Scherer, seconded by Schmit to approve 1990 cigarette licenses for Big Woods Saloon, Kunz Oil, Anderson Liquors and Stop 'N Go Liquors. Motion declared carried 7. NORTHWEST SUBURBAN CHAMBER OF COMMERCE, PULL TAB LICENSE RENEWAL Council discussed the ability of the city to designate dispersal of pull tab gambling profits and whether or not all of the profits should remain in Medina as the operation of the Chamber of Commerce is held at Medina Recreations. Stephen Schmit asked if there wasn't a balance of profits, such as the Orono Lions Club giving money to Medina for playground equipment. Donna Roehl stated that the scholarship fund that is established will assist students living in the Medina area, as had been done in 1989. Thomas Anderson stated that he had not asked the Loretto Fire Department how they had used the funds gotten through the Big Woods Saloon. He suggested that the Chamber of Commerce be asked to respond to the cities discussion. Moved by Anderson, seconded by Scherer to table renewal until February 6th and ask the Chamber of Commerce to attend the meeting. Motion declared carried 8. WEST MEDIATION CENTER Anne Theis stated that she did not believe Medina residents used the services of West Med- iation Services because of the rural character of the city. Moved by Scherer, seconded by Schmit to not contribute to West Mediation Services, at this time. Motion declared carried 9. YARD WASTE DISPOSAL Donna Roehl reported that a meeting of Hennepin County cities had been held to discuss proposed resolutions of the county board regarding disposal of yard waste and how cities would deal with the directive for each city to designate a disposal site. A committee of several cities was organized to prepare a response and a meeting was held the following day, which Ron Batty attended. Ron Batty stated that a resolution responding to that of the county board was prepared and given to the City Manager of Brooklyn Center who would be speaking on behalf of the cities on January 4th. He stated that for the time being the cities would like to present a united response. Councilmember Scherer stated that he would try to attend the meeting. 10. 1990 APPOINTMENTS The following appointments for 1990 were made by Mayor Anderson: Public Safety Commissioner Anne Theis Adminstration, Park, Health and Welfare Stephen Schmit Public Works Commissioner Wilfred Scherer Planning and Zoning Commissioner Robert M_tchell Pioneer Creek Watershed Commission Representative Anne Theis Q T Lake MInnetonka CAble Communications Commission Representative Thomas Anderson Northwest Hennepin League of Cities Representative Thomas Anderson West Hennepin Recycling Commission Representative Donna Roehl Weed and Tree Inspector Howard Schleif Fire Marshall Loren Kohnen Sign Administrator Loren Kohnen City Attorneys Holmes and Graven Deputy Clerk Laura Skarda Moved by Theis, seconded by Scherer to support the appointments and appoint Wilfred Scherer as Acting Mayor; Bonestroo and Associates as city Engineers the Crow River News as Official Newspaper for three months and ask them to respond to the council regarding Medina residents receiving the proper issue of the paper; Official Depositories of Farmers State Bank of Hamel; First Bank Minneapolis; Marquette Bank; Merrill Lynch; Shearson-Leahman- Hutton; Prudential-Bache; American National Bank. Motion declared carried I!. :.BILLS Moved by Theis, seconded by Scherer to pay the bills; Order Checks # 8245-8294 in the amount of $132,704.58 and Payroll Checks # 11348-11368 in the amount of $13,471.85. Motion declared carried 12. TNDEPENDENCE BEACH SKATING POND Anne Theis reported that there are some young people playing hockey on the Independence Beach skating pond, at the same time others are skating. Jim Dillman stated that signs cannot be put up unless they can be enforced. 13. PIONEER CREEK COMMISSION CLEAN WATER PARTNERSHIP Anne Theis reported that the Pioneer Creek Watershed Commission along with the county park, homeowners associations and others had pooled their funds to make application for a matching grant to study the problems with water quality of Lake Sarah. She stated that they were second on the list of those approved and she wanted the council to know mane✓ cnn- tributed by the cites in the district went into the project. 14. HAMEL LEGION PARK Jim Dillman asked if there were any plans for the Hamel Legion Park as additional equipment would need to be purchased if the city was going to take over maintenance. Stephen Schmit asked if the planner had presented anything to the city. Thomas Anderson stated that park planning would be included in the Comprehensive Plan amendment, with a hearing to heard sometime later. Donna Roehl asked that the date be set so as to allow time to include in the next city newsletter which would be sent out sometime in January. Moved by Theis, seconded by Scherer to adjourn.
