A RESOLUTION APPROVING A BOUNDARY LINE ADJUSTMENT FOR LOTS 51 AND 52 OF THE
BOWEN PLAT, NICHOLS-BOWEN SUBDIVISION AS SUBMITTED BY BUSTER J. NELSON
WHEREAS, Mr. Buster J. Nelson, 1732 Dovetail Drive, Fort Pierce, Florida 34982, as "Owner" of Lots 51
and 52, of the Bowen Plat of Nichols -Bowen Subdivision (580 locust lane) has applied for a lot line
adjustment between the two lots; and
WHEREAS, the properties are located in the R-2, single-family and two-family Residential Zone; and
WHEREAS, the Owner submitted to the City of Moab the appropriate application and documents for review
and approval of the proposed lot line adjustment; and
WHEREAS, Lot 51 will be comprised of 8,628 square feet (.20 acre) and be reshaped into a flag lot and
Lot 52 will consist of 7,772 square feet (.18 acre); and
WHEREAS, the proposed lot dimensions satisfy the minimum lot area of 5,000 square feet for the R-2
Zone; and
WHEREAS, Lot 51 satisfies the definition of "flag -shaped or panhandle lots" in Moab Municipal Code
Chapter 17.06.020, as follows: "Flag -shaped or panhandle -shaped lots" may be created in a residential
zone if all of the following requirements are met:
1. The lot has at least twenty feet of frontage on a dedicated public street, which frontage serves as
access only to the subject lot or parcel;
2. The handle portion of the lot is at least twenty feet in width, and not more than one hundred fifty
feet in length;
3. That the body of the lot meets the lot area and lot width requirements of the applicable zones.
WHEREAS, the Moab City Council ("Council'), in a regularly scheduled public meeting held on April 10,
2018, reviewed the proposal for compliance with the Moab Municipal Code and State Code Chapter 10-9a-
608(2) that allows an amendment of a subdivision plat without a public hearing if:
(a) the petition seeks to:
"Adjust the lot lines of adjoining lots or parcels if the fee owners of each of the adjoining lots or
parcels join in the petition, regardless of whether the lots or parcels are located in the same
subdivision..."
WHEREAS, subsequent to the consideration of a Staff recommendation and having reviewed the technical
aspects of the pertinent code sections, and pursuant to Council Resolution #21-2018, the City Council
hereby finds, that the code requirements have been met.
NOW, THEREFORE, BE IT RESOLVED BY THE MOAB CITY COUNCIL THAT, the application for the lot
line adjustment for Lots 51 and 52 of the Bowen Plat of the Nichols- Bowen Subdivision, is hereby approved.
ADOPTED AND APPROVED by action of the Moab City Council in open session this
10th day of April, 2018.
