ARTICLE 16
AN ORDINANCE AUTHORIZING THE EXECUTION OF A BOUNDARY
AGREEMENT BETWEEN THE CITY OF JOLIET, WILL COUNTY, ILLINOIS,
AND THE VILLAGE OF PLAINFIELD, WILL COUNTY, ILLINOIS
WHEREAS, the corporate authorities of the City of Joliet,
Will County, Illinois, (hereinafter sometimes referred to as
"Joliet") and the corporate authorities of the Village of
Plainfield, Will County, Illinois, (hereinafter sometimes
referred to as "Plainfield"), after due investigation and
consideration have determined it to be in the best interests of
their respective City and Village to enter into an Agreement
providing far the establishment of a boundary for their
jurisdiction in the unincorporated territory lying between Jaliet
and Plainfield; and
WHEREAS, under and by virtue of Article VII, Section 1p of
the Constitution of the State of Illinois, units of local
government, including municipalities, are authorized to contract
and enter into agreements to exercise, combine or transfer any
power or function, in any manner not prohibited by law or
ordinance; and
WHEREAS, pursuant to Section ~.1--12--9 of the Municipal Code,
Illinois Revised Statutes, Chapter 24, Sec. 11-12-9 (1989), the
corporate authorities of municipalities are authorized to agree
upon boundaries for the exercise of their prospective
jurisdictions within unincorporated territory that lies within
1-1/2 miles of the boundaries of such municipalities; and

WHEREAS, the corporate authorities of Jaliet and Plainfield
have reduced their proposed agreements and undertakings to a
written agreement entitled "Intergovernmental Cooperative and
Planning Boundary Agreement between the City of Joliet, and the
Village of Plainfield," a copy of which agreement is attached
hereto and is hereby made a part hereof; and
WHEREAS, the corporate authorities of Joliet and Plainfield
have determined that agreement on the boundary described in said
agreement and the execution of said agreement by Plainfield will
be in the best interests of the Village and will enure to the
public good and benefit of Plainfield and the residents thereof
and will be compatible with, and promote the orderly and
systematic development of the Village and the unincorporated
territory adjacent to its boundaries; and
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF PLAINFIELD, AS FOLLOWS:
Section 1: That the Village President be and is hereby
authorized and directed to execute on behalf of the Village of
Plainfield, Will county, Illinois, a certain "Intergovernmental
Cooperative and Planning Boundary Agreement between the City of
Joliet, and the Village of Plainfield," a true and correct copy
of which Agreement is attached hereto and by reference
incorporated into this Ordinance, and the Clerk of the Village of
Plainfield is hereby authorized and directed on behalf of the
Village of Plainfield to attest to the signature of the Village
President on said Agreement.

Section 2: That said Clerk be and is hereby directed to
file a certified copy of this Ordinance and Boundary Agreement,
attached hereto, after execution by all parties, with the
Recorder's Offices in Will and Grundy Counties and file for
record in the Clerk's offices, three copies of the executed
agreement.
Section 3: In the event any word, phrase, clause, sentence,
paragraph, provision or section of this Ordinance or any portion
thereof shall be held to be unconstitutional, unenforceable or
void, the same shall not affect the constitutionality or validity
of any remaining words, phrases, clauses, sentences, paragraphs,
provisions or sections hereof.
Section 4: This Ordinance shall be in effect an its
passage, approval and recording as required by law.
This Ordinance sha11 be numbered as Ordinance No. 1347
