ARTICLE 8: VARIATION TO ZONING ORDINANCE NO. 674, GRANTED
BY ACTION OF THE VILLAGE OF PLAINFIELD BOARD OF
TRUSTEES
Sec. 8-29: Variation of Front Set Back for property at 704
N. Division Street.
WHEREAS, a public hearing was duly advertised and held
on the proposed variation to the required front set backs, of
Chapter 8, Article 6 of said Village of Plainfield as
hereinafter set forth; and
WHEREAS, the Zoning Board of Appeals of the Village of
Plainfield has heretofore filed a report of its acts and
doings in the premises and its recommendations that the
petition requesting a variance for the real estate
hereinafter described from the minimum front set back
requirements under said Chapter 8, Article 6, Sections 6-1
through 6-35, entitled "An Ordinance Requiring Permits for
Buildings, Structures, and Uses, Dividing the Village into
Districts, Specifying Minimum Lot Sizes, Set Backs, and Side
Yards, Regulating the Bulk of Buildings Providing for Appeals
and Imposing Penalties", be granted, and
WHEREAS, we believe that the front set back
requirements of said Chapter 8, Article 6, places an undue
hardship upon the owner of said real estate, and
WHEREAS, it is the opinion of the President and Board of
Trustees of the Village of Plainfield that the petition
requesting a variance from the requirements of said Chapter
8, Article 6, Section 6-17, for the real estate hereinafter
described should be granted.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND
BOARD OF TRUSTEES OF THE VILLAGE OF PLAINFIELD, WILL COUNTY,
ILLINOIS, as follows:
Sec. 8-29-1: Territory Described. That the Following tract
of land, to-wit:
THE NORTH 75.5 FEET OF THE EAST 64 FEET OF LOT 5 IN
ASSESSOR'S SUBDIVISION OF BLOCK 6 OF ARNOLDS SUBDIVISION
TO PLAINFIELD, AND PART OF THE SOUTHEAST QUARTER OF
SECTION 9, TOWNSHIP 36 NORTH, RANGE 9 EAST OF THE THIRD
PRINCIPAL MERIDIAN ACCORDING TO THE PLAT RECORDED AUGUST
24, 1867 AS DOCUMENT 57286 EXCEPTING THAT PART TAKEN BY
THE STATE OF ILLINOIS FOR HIGHWAY PURPOSES, ALL IN
PLAINFIELD TOWNSHIP, WILL COUNTY, ILLINOIS.
which said tract of land is now subject to the minimum set
back requirements as established in Chapter 8, Article 6,
Section 6-17, of the Village of Plainfield, be and the same
is hereby exempt from the requirement that the minimum front
set back for any building or structure on such lot shall be
30 feet and the same is hereby granted a variance of said
minimum set back and is hereby permitted instead a minimum
set back of 4 1/2 feet from the front property line along
Division Street.
Sec. 8-29-2: If Part Invalid. The invalidity of any part or
section hereof shall not affect the validity of
the remainder hereof.
Sec. 8-29-3: This Ordinance shall be in full force and
effect from and after its passage and approval
as provided by law.
This Ordinance shall be numbered as Ordinance
No. 1278
