HomeMy Public PortalAbout2014.040 (03-04-14)RESOLUTION NO. 2014.040 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD ESTABLISHING A PUBLIC TREE REMOVAL CRITERIA WHEREAS, on September 20, 2011 the Lynwood City Council add Ordinance No. 1648 amending Chapter 13 -2 of the Lynwood Municipal Code (L relating to planting, protection and removal of street trees; and WHEREAS, Chapter 13 -2 LMC, as amended, sets forth City Engini responsibilities which include determining public tree removal based upon establi'i public tree removal criteria; and WHEREAS, a public tree removal criteria should aid the City Engineer to determine which tree is hazardous and which tree to retain. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: Section 1. • That the City Council approves the establishment of public, tree removal criteria as set forth below: Public trees meeting one or more of the following criteria would be by the City: 1. Tree is dead or 50% declining. 2. Tree is diseased beyond cure. 3. Tree is hazardous to the public or necessary root surgery would render it hazardous. A tree will be considered hazardous when the tree has a condition which makes failure imminent. 4. Tree causes repeated extensive damage to underground utilities or curb, gutter and sidewalk. 5. Tree is obstructing a permitted improvement such that it will be killed or become structurally unsound when the improvement is implemented. 6. Tree will be made hazardous by publicly funded construction and the project cannot be reasonably re-routed away from the tree. ;I 7. The tree is limiting the field of vision of a motor vehicle, is obstructing traffic or is causing a traffic hazard. If the removal request is due to a sight distance problem, and no other cost effective alternatives exist. Section 2. That the City Council authorizes the City Engineer to apply the public removal criteria as stated above and develop procedures and forms fir its implementation. Section 3.
