KOCH, JR. COMMISSION CHAMBERS OF THE TOWN HALL, 100 SEA ROAD, GULF STREAM, FLORIDA. I. Call to Order. Chairman, Thomas Smith called the meeting to order at 8:30 A.M. II. Roll Call. Minutes of the Regular Meeting and Public Hearing 7-3-19. Vice Chairman Murphy moved and Board Member Roach seconded the motion to approve the minutes of July 3, 2019 and all voted AYE at roll call. IV. Additions, withdrawals, deferrals, arrangement of agenda items. There were no changes to the agenda. V. ANNOUNCEMENTS. A. Meeting Dates 1. Regular Meeting & Public Hearing a. No August meeting b. September 26, 2019 at 8:30 A.M. c. October 24, 2019 at 8:30 A.M. d. TBD e. TBD Chairman Smith called attention to the future meeting dates. Vice Chairman Murphy and Alternate Board Member, Caroline Delafield, stated they will not be able to attend the September meeting. The Board determined the meeting dates for November and December to be November 21, 2019 and December 19, 2019. VI. PUBLIC HEARING. A. Declaration of Ex -Parte Communication There was no ex -parte communication. B. Administer Oaths The Town Clerk administered the Oath to Sophie Bent, Dan Carter, Eddie Dalidowicz, Bryan Donahue, David Gunther and Rob Lehner. C. Applications for Development Approval 1. An application submitted by Gary Eliopoulos, GE Architecture, Inc., as agent for Mr. & Mrs. Richard Wilson, owner of property located at 3420 Gulf Stream Minutes of ARPB Regular Meeting & Public Hearing Held 7-25-19 @ 8:30 A.M. Road, Gulf Stream, Florida 33483, legally described as Lot 1, Block 1, Plat No. 1 Polo Fields. a. Land Clearing Permit to trim, treat and shape existing hedge, remove dead stump and vines, and trim existing trees. b. Demolition Permit to remove two-story, single family dwelling, swimming pool and all other structures on the property. c. Level 2 Architectural/Site Plan Review to permit the land clearing and demolition permits, the installation of a 4'x5' aluminum gate in the center of the south property line, and an irrigation system along with new sod on the entire property. Mr. Dan Carter, of Landscape Architects, made the presentation beginning with the fact that they would like to put a clusia hedge instead ficus. He then explained that the demo and land clearing was basically making way for a back yard. Chairman Smith asked if there was going to be a Unity of Title, to which Assistant Town Attorney answered there was not. Town Manager Dunham asked if the Queen Palms were going to be removed as they were in bad shape and Mr. Carter answered in the affirmative. Town Clerk Taylor stated that there had been a call from a neighbor asking what the hedge was going to be but did not say he was opposed to a variety of hedging. Vice Chairman Murphy made a motion to approve a land clearing permit to trim, treat and shape existing hedge, remove dead stump and vines, trim existing trees and remove the three Queen Palms. Board Member Roach seconded the motion with all voting AYE. Vice Chairman Murphy made a motion to approve a demolition permit to remove a two-story single-family dwelling, swimming pool and all structures on the property. Board Member Roach seconded the motion with all voting AYE. Vice Chairman Murphy made a motion to approve a Level II Architectural/Site Plan Review to permit the land clearing and demolition permits, the installation of a 4'x5' aluminum gate in the center of the south property line and to sod, landscape and irrigate the entire lot with the following conditions: 1. Any minor modifications in the approved landscaping shall be submitted to the Town Manager for review and approval and any major modification shall be brought back to the ARPB for review and approval, prior to commencement of landscaping. Board Member Roach seconded the motion with all voting AYE. 2. An application submitted by Bryan Donahue, Insite Studio, as Agent for The Little Club, the owners of property located at 100 Little Club Road Gulf Stream, Florida, which is legally described as lying in Section 3, Township 46 South, Range 43 East Palm Beach County, Florida. Minares of ARPB Regular Meeting & Public Hearing Held 7-25-19 @ 8:30 A.M. a. Land Clearing Permit to permit the removal of existing 48" diameter Green Buttonwood tree from construction site. b. Level 2 Architectural/Site Plan Review to permit the construction of 2 Pickleball Courts with a spectator area, a total of 3,300 square feet, in an open area west of the existing Hillside House Condominium. Chairman Smith noted that the Town had received communication from some of the neighbors and then asked Town Clerk Taylor who was notified besides The Hillside House. Ms. Taylor stated that the applicant is responsible to supply the Town with the names of all the abutting neighbors as well as stamped and addressed envelopes for them. All of those were sent out and approximately a week after being sent, the letter that went to Las Casitas was returned to the Town by the Post Office. Ms. Taylor informed the applicant who at that point sent notices to the residents within the organization. Mr. Bryan Donahue of Insite Studio made a PowerPoint presentation on behalf of The Little Club. Mr. Donahue showed where the courts were projected to be and the landscaping that was being proposed. He added that for noise mitigation purposes, the Little Club was proposing a cushioned court surface and sound mitigating paddles that would be the only paddles allowed for use. Mr. Donahue said that in the application it was stated there would be a sound mitigating screen, but they were taking that off the table believing that all the other sound mitigation proposals would be enough. Board Member, Curtiss Roach, stated that he had received several phone calls regarding the pickleball courts and wanted to know if any consideration had been made to move one of the croquet courts to the proposed pickleball site and the pickleball courts to one of the croquet courts because two pickleball courts will fit into one croquet court. Mr. Donahue stated that the additional croquet court had just been added and it didn't make sense to separate them. Mr. Roach added that he had been told 80% of the Hillside House were opposed to the pickleball courts and in the process of being a good neighbor, some accommodations should be made by The Little Club. Mr. Donahue stated they were open to having conversation with any of the neighbors in opposition. Board Member, Jorgette Smith, asked why they had done away with the sound mitigating screen. Mr. Donahue answered they felt the paddles and court surface were enough to mitigate the sound and the screen was fairly expensive. Mrs. Smith then asked how much quieter were the paddles and cushioned surface to which Mr. Donahue said he did not know technicalities as far as decibel levels, etc. Chairman Smith asked Mr. Donahue to expound on the discussions to put the pickleball courts at the proposed location. Mr. Donahue deferred to Mr. Eddie Dalidowicz, who said that the proposed pickleball location does not grow grass well and it would not be a good location for a croquet lawn. Mr. Dalidowicz added that game play would be hurt as well since 30-40 people are off and on 3 Minutes of ARPB Regular Meeting & Public Hearing Held 7-25-19 @ 8:30 A.M. the lawn every 20 minutes or so and it's not conducive to the sport for the lawns not to be next to each other. Alternate Board Member, Caroline Delafield, stated that she understands the noise complaints the neighbors have, but stated that the Club is acting within what it is zoned for so it's a tough situation. Vice Chairman Murphy asked if there had been any response from the neighbors, to which Town Clerk Taylor read a letter from Mrs. Carol Stanley, a resident of Hillside House in Unit 11, affirming the pickleball courts. Ms. Taylor then read letters from other residents of Hillside House, John and Cynthia Gallagher, Sophie Bent and Wendy Barroll that were in opposition to the pickleball courts. Chairman Smith said there seemed to be a majority against the pickleball courts noting noise abatement. He added that the Bath and Tennis Courts were 300 feet from his home and he could hear them, so he knew 25 feet away would definitely be heard. Vice Chairman Murphy asked about the discussion between the two presidents and Mr. Dalidowicz said that it had been his understanding that Mr. Gallagher was not opposed to the pickleball courts, but that his letter now said differently. Mr. Roach and Ms. Taylor added they had received phone calls from Mr. Gallagher as well. Mr. Rob Lehner, the General Manager of The Little Club, stated that the proposed site for the pickleball courts was not large enough for a croquet lawn. He added there would also be nowhere to put the golf carts when they had tournaments. Ms. Sophie Bent stated she was at the meeting representing 11 out of 12 units who are opposed to the pickleball courts and that sight wasn't the issue, but it truly was the noise. Town Manager Dunham stated that when in discussions with the staff, it was his understanding that the sound mitigation screen was to be included. Mr. Donahue apologized and said it could be looked at again, if that is what the Board felt necessary. Mr. Dunham also added that future expansion had been mentioned when the staff asked the Club to look at moving the courts a little to the south. Mr. Donahue wanted to make clear that they were meeting all the requirements per the Code for this property. Alternate Board Member, Caroline Delafield had to excuse herself from the meeting at 9:20 A.M. David Gunther of Lang Realty suggested dual pane/impact windows for Hillside House residents. After much deliberation, it was decided to table this application until the September 26, 2019 meeting. The Board asked that noise abatement be addressed by a quantifiable third -party consultant, decibel testing, playing times, nuisance ordinances and additional landscaping for screening purposes all be addressed. Vice Chairman Murphy made a motion to defer Application 19-05 to September 26, 2019 when the points made have been addressed and brought back to the Board. The property is generally located approximately 3/a mile south of Woolbright Rd, on the west of side of N Ocean Blvd. It is identified by the following property control number 20-43-45-34-14-000-0010. The site has an Recreation (Rec) Future Land Use designation within the Outdoor Recreation (OR) Zoning district, and is located in the Urban/Suburban Tier. The area of the site subject to this request, is a portion of land adjacent to the clubhouse currently used as open space. The proposed plan consists of two pickleball courts, a spectator viewing area and associated landscape improvements. The court area consists of approximately 3,600 sf, as well as a 260 sf patio area. The project will require the removal of a large existing Green Buttonwood that situated in the proposed location of the court. The applicant has proposed a mitigation plan for the tree removal, shown below. (6) The proposed project and plans shall comply with the subdivision standards contained in chapter 62 of this Code. Preservation of natural conditions. The landscape shall be preserved in its natural state, to the degree practical, by minimizing tree and soil removal and by other appropriate site planning techniques. As noted above, the property is currently developed with a gold course and there is little native vegetation within the site. The applicant shall preserve native vegetation within the property to the greatest extent possible. The proposed court location will require the removal of an existing mature native tree, which shall be mitigated for as outlined below. c. Screening and buffering. Fences, walls, or vegetative screening shall be provided where needed to protect residents and users from undesirable views, lighting, noise or other adverse off-site effects and to protect residents and users of off-site development from on-site adverse effects. The proposed landscape plan for the pickleball court area provides adequate screening and buffering for the adjacent residential uses, located directly to the east. The applicant shall provide supplemental measures to buffer noise production. Exterior lighting shall not interfere with the quiet enjoyment of adjacent properties or the safety of public rights-of-way. The proposed plan does not include lighting fixtures. Per Sec. 66-368(b), lighting is prohibited in any manner so as to illuminate any tennis court. e. Access to public ways. All development sites shall have safe and convenient access to public rights-of-way and/or other areas dedicated to common use. We are not in favor of the current site and feel that the noise will be extreme and disruptive to the tranquil place we currently call home. My name is Sophie Bent and I am here to represent most of the residents of Hillside House, 200 Little Club Road, who are are quite concerned with The Little Club's intention, announced some three weeks ago, to build two pickle ball courts 25 feet away from the westerly wall of our condominium building. The reasons for our concern are twofold: namely, the loud and piercing noise made by the plastic whiffle -like ball and the wooden mallet that this game requires and the negative effect that having the two proposed courts in very close proximity (25') to our building would have on the values of our condominium units. For those folks who have played or seen the game, they will know how loud it is and for the others, we have provided copies of an article explaining how the growth in popularity on the game has led to issues of conflict between the proponents Of the game and neighbors of the proponents (often clubs or other recreational entities). The article is called "Why are your pickleball courts receiving complaints from neighbors?" The article says that courts located within 350 feet from residential structures often require abatement ( meaning " freestanding walls eight feet above the playing surface.". The next comment is that "courts located within 150 feet require careful abatement design to avoid complaints." It should not be surprising that the proposed distance between out building and the new courts is much less than what is recommended. Also, we do not see that `abatements' (freestanding walls) are a part of the plans. Thus, it is our belief that the plans should not be approved by this Board. We would not object to The Little Club moving the location of the new pickle ball courts being proposed to the relatively recent site of the new croquet courts and re- siting the croquet courts where the just- proposed pickleball courts are planned. It is fair to say that all of us like being neighbors of the Little Club. Some of us are members there and all the rest of us are always delighted when some gullible soul invites us to join them in that great dining room with that great food. Thank you. It has become very popular in retirement resort communities and other recreation centers. Unfortunately, some developers of pickleball courts have not adequately addressed the sound produced by the impact of the hard paddle and ball which creates a sharp pop. This has led to controversy between facility owners and neighbors when new pickleball courts are planned. Here in Arizona and elsewhere we have planned and mitigated many of these sites. We have had the opportunity to work with (� both pickleball clubs and home owners associations. In this post we will outline the process we have developed to evaluate the L4 1�� �� noise impact of pickleball courts and to enable pickleball to coexist with the surrounding community. Characteristics of Pickleball Sound The sound produced by the impact between a pickleball and paddle is characterized by a sudden onset and brief duration, typically on the order of two milliseconds for the direct path sound. Figure 1 shows a time trace of a pickleball paddle impact measured near Phoenix, Arizona. Paddle Impact Power Spectrum Measuring Pickleball Sound Due to the short duration of the impact, averaging sound pressure level metrics such as equivalent level (L�) and even maximum fast exponential time weighted level (L,,,a„) fail to accurately represent the perceived loudness of the impact. The fast exponential time weighting filter is a first order lowpass filter with a 125 millisecond time constant applied to the square of the acoustic pressure waveform. If a tone burst is applied to the squaring circuit and filter, after two milliseconds the filter output will only rise to a level that is 18 dB lower than the root -mean - square or equivalent level of the input signal. Because the short impulse is being significantly attenuated by the averaging in the sound level meter, in practice it is in general not possible to distinguish picldeball paddle impacts from the background noise when measuring L, or L. using an integrating sound level meter even though the paddle impacts may be identified by a listener as the primary sound source. The paddle impact sound pressure level is better represented by the sound exposure level (SEL). This involves windowing the measured sound pressure in time to include only the paddle impact and reflections from nearby surfaces. The equivalent sound pressure level of the windowed impact is then normalized to the length of the window giving a representation of the energy in the impact alone. Most acoustical standards for sound pressure levels with regard to compatible land use provide adjustment factors for different types of sound, e.g. impulsive, tonal, time of day, etc. Each of these categories of sound produces different levels of community impact and annoyance due to their temporal or spectral characteristics in comparison to a broadband sound that does not vary in level or frequency content with time. The purpose of the adjustment factors is to normalize these types of sound to a neutral broadband sound pressure level so that they can be reasonably compared to a defined sound pressure level limit or the background noise level. ANSI 512.9 Part 4 gives criteria for assigning adjustment factors to a variety of impulsive sounds. Sounds produced by many impact processes are classified as `highly impulsive' and assigned a 12 dB adjustment. Although not specifically enumerated in definition 3.4.1 of the standard, experience has shown that pickleball paddle impacts should be adjusted as highly impulsive sounds in order to set appropriate performance goals for abatement treatments. Inadequate abatement treatment will lead to ongoing complaints, strained relations with neighbors, the need for continued involvement on the part of authorities, and additional retrofitting and possibly demolition costs to improve the abatement later. Site Planning Considerations for Pickleball F on our experience working with pickleball facilities, courts within 350 feet esidential structures often require ent. Courts located within 150 feet req re careful ent design to avoid complaints. l batement treatments usually consist of freestanding walls strategically placed to shield noise sensitive areas from the �t pickleball courts. To be effective, the walls must block the line of sight to the paddles during play. On level terrain this means a minimum wall height of eight feet above the playing surface. The cost of the walls can be reduced by lowering the courts into the °t ground and using the excess soil to build a berm around the courts. Placing the wall on top of the berm will lower the required height of the wall itself, reducing construction costs. The wall may be masonry or a solid fence system having sufficient mass for effective sound insulation. For pickleball courts located in the middle of a residential area with houses on more than two sides, screen walls may be required on opposite sides of the courts. When these walls are parallel to each other, reflections between them can degrade the' performance of the walls significantly. This can almost double the cost of the walls and may make the site financially unfeasible. Court orientation also plays a role. More sound propagates in the direction of play than to the sides of the pickleball court. By positioning the courts so that the line of the net runs through the most noise sensitive area, a noticeable reduction in sound pressure level can be achieved at this location. When to Hire an Acoustical Consultant We recommend that pickleball courts to be located within 500 to 600 feet of residential properties or other noise sensitive areas be reviewed by an acoustical engineer during the site selection phase in order to avoid choosing a site that is expensive to mitigate, results in unexpected limitations on court use, or leads to ongoing disputes with neighbors. For sites that have a water feature or golf course as part of the intervening ground between the courts and homes or for sites located in a valley, it may be necessary to consider abatement at buffer distances greater than 500 to 600 feet due to additional refraction effects created in these situations. The abatement plan for the site should be prepared by an acoustical engineer with experience in assessing the community impact of short duration impulsive sounds such as those produced by pickleball paddle impacts. As can be seen from procedure outlined above, properly measuring sound from pickleball courts is not a simple matter of setting up a sound level meter and logging an equivalent sound pressure level (L"). The short duration impulses produced by the paddle impacts require a detailed process of applying a metric that can accurately represent the community noise impact of the pickleball courts. If you are in the process of planning pickleball for your site, consulting an acoustician can reveal unforseen issues with the selected courts site or the site plan before investing tens or hundreds of thousands of dollars in design and construction. Preparing a formal abatement plan can also ease concerns of neighbors about the community noise impact of the courts. The Little Club proponents state that the sound would be minimal with their plan. That is doubtful unless a more aggressive sound mitigation plan is installed which would include state of the art playing surfaces, special paddles and balls, higher fencing (8'- 10') surrounding at least the East, North and West boundaries, supplemented by trees, shrubs and sound reducing fence netting such as Acousti Blok. The current proposal does not have any of these features, and based on the presentation and supporting documents, is not included due to the apparent increased cost to The Little Club. The cost of quality of life and decreased property values to the neighborhood is not considered in this calculation by The Little Club. Our Fairways II Board of Directors, along with a significant majority of the impacted Fairways II residents, suggest that a reasonable alternative is to locate the pickleball courts more central in The Little Club property, closer to their croquet lawns and to significantly increase noise mitigation with higher fencing, noise abatement coverings and tree/shrubbery planting. Should the courts at the proposed site be approved, there should be restrictions for hours of operation, no lighting, and significant noise abatement that provides an attractive neighborhood with no impairment on quality of life and loss of property values.
