Meeting Minutes – December 9, 2019

Select Board Members Present: Brendan Tedstone, Chair, John Coutinho, Vice Chair, Brian
Herr, Irfan Nasrullah, Mary Jo LaFreniere
Officials Present: Town Manager Norman Khumalo, Assistant Town Manager Elaine Lazarus,
Town Counsel Ray Miyares, Alexandra Rubin, Bryan Bertram
CALL TO ORDER: Mr. Tedstone called the public meeting to order at 6:14 PM in Room 255
of the Middle School.
The Chair entertained a motion to enter into executive session to consider strategy with respect
to the lease, sale or value of real property, the easements under discussion at the Special Town
Meeting this evening, because the Chair declares that an open meeting may have a detrimental
effect on the negotiating position of the Board; to allow Norman Khumalo, Elaine Lazarus, Ray
Miyares, Alexandra Rubin and Bryan Bertram to participate in the discussion; and to convene in
Open Session after the conclusion of Executive Session.
MOVED by Mr. Herr and SECONDED by Mr. Nasrullah. ROLL CALL: Mr. Tedstone-Yes;
Mr. Herr-Yes; Mr. Coutinho-Yes; Mr. Nasrullah-Yes; Ms. LaFreniere-Yes. Vote to Approve:
Yes-5, No-0.
REOPEN PUBLIC SESSION: Mr. Tedstone reopened the Public Session.
Ms. LaFreniere referred to a possible motion by the petitioners for a vote by secret ballot under
Article 1 and asked about the voting procedure. Mr. Miyares described the process where a
motion for secret ballot is made, followed by debate and a vote to approve. He stated that the
procedure outlined by the Town Clerk would be for everyone to leave, check in again, receive a
ballot and then cast the ballot. He stated that town meeting could proceed with other articles
while the ballots are counted, or it could wait.
The Board reviewed the motion to be made by the petitioners under Article 6, street acceptance
for Legacy Farms North.
MOVED by Mr. Tedstone and SECONDED by Mr. Herr to adjourn the meeting effective at the
end of the Special Town Meeting tonight. Vote to Approve: Yes-5, No-0.
