A GENERAL ORDINANCE ESTABLISHING
A LAW ENFORCEMENT FUND
BE I'1' ORDAINED BY THE COMMON COUNCIL OF ]'HE CITY OF
GREENCASTLE, INDIANA:
SECTION 1. There is hereby created a "Law Enforcement Fund ". The Fund shall
consist of deposits in the form of proceeds recovered by the office of the Putnam County
Prosecuting Attorney and /or the Greencastle City Police Department in forfeiture actions filed
pursuant to Indiana Code Section 34 -4 -30.5, liquidations of personal or real property obtained
from criminal defendants in those actions, donations, costs as defined in I.C. 34- 4- 30.1 -8, and
voluntary surrenders of funds and assets from criminal defendants.
(a) The Law Enforcement Fund shall be established for funding law enforcement
conducted by the Greencastle City Police Department, other special crime units,
and for reimbursement of expenses incurred by the Prosecuting Attorney's Office
in pursuing forfeiture and RICO actions.
(b) All monies collected under this Section shall be transferred to the Greencastle
City Clerk, who shall deposit said funds in the proper account, subject to
requirements in SECTION 2, subparagraph (a). Disbursements of funds shall be
directed by the Greencastle City Police Chief or his designee, subject to the
appropriation requirement of subparagraph (c). Monies remaining in the fund at
the end of the year shall not revert to any other fund but shall continue in the Law
Enforcement Fund.
(c) Monies from this fund shall be subject to appropriation by the Greencastle City
Common Council in accordance with Indiana Code 36- 2 -5.2.
(d) That said funds, after appropriation, shall be used by the Greencastle City Police
Department for law enforcement and drug investigations, which may include the
purchase of drugs, controlled substances, stolen property, and to pay confidential
informants, and to purchase and maintain equipment and pay law enforcement
expenses as defined in I.C. 34 -4- 30.1 -8.
SECTION 2. That in order to facilitate the expenditure of the appropriated funds by the
Greencastle City Police Department, there is hereby established a Law Enforcement Fund
Checking Account, which may bear interest, and hold funds for usage by the Greencastle City
Common Council.
(a) The Greencastle City Police Department is hereby authorized to place funds
® appropriated from the Law Enforcement Fund in a "NOW" account or similar
account which may bear interest; the Greencastle Chief of Police shall account to
the Greencastle City Clerk, for all interest earned on said account; the interest
earned shall be kept and retained in said checking account and used for the
purposes set forth for the principal sums.
SECTION 3. This ordinance shall be in full force and effect upon passage and
compliance with I.C. 36- 2 -4 -8.
The foregoing was passed by the, Greencastle City Common Council this day of
