AN ORDINANCE APPROVING THE PETITION OF GREENCASTLE COAIMUNITY
• SCHOOL CORPORATION TO VACATE PUBLIC RIGHT -OF- WAY LOCATED
IN THE CITY OF GREENCASTLE. PUTNAM COUNTY INDIANA
WHEREAS, the Plan Commission of the City of Greencastle, Indiana, did at its regular meeting
held on May 22, 2000, approve the Petition of Greencastle Community School Corporation for
the vacation of certain public right -of -ways, located in the City of Greencastle; and
WHEREAS, the Common Council of the City of Greencastle, Indiana, pursuant to law,
published notice that this matter would come before the Common Council for public hearing at
the regular meeting of the Common Council to be held on June 13, 2 000 at 7:00 p.m. at the City
Hall, 1 North Locust Street, Greencastle, Indiana; and
WHEREAS, the adjoining property owners have consented or have been notified pursuant to
statute as to the vacation of the right -of -way; and
WHEREAS, the Common Council of the City of Greencastle, Indiana, has after public hearing
determined the relief prayed for in said Petition should be granted and that the portion of the
public right- of-ways located in the City of Greencastle, Indiana, should be vacated.
NOW, THEREFORE, be it ORDAINED by the Common Council of the City of Greencastle,
Indiana, that the following public right -of -way located in the City of Greencastle, Putnam
• County, Indiana, and more particularly described as follows:
Fos Run between lots 103 and 105 off Shadowlawn Avenue in Deerfield Estates.
Beginning at the Southwest corner of Lot #103 in Deerfield Estates, Phase 1;
thence North 85 degrees 44 minutes 32 seconds West 50.11 feet to the Southeast
corner of Lot #105; thence with the Easterly side of Lot #105 North 08 degrees 00
minutes 00 seconds East 107.00 feet; thence Northwesterly 28.65 feet on a curve
to the left having a radius of 20.00 feet and subtended by a long cord bearing
North 33 degrees 02 minutes 28 seconds West a distance of 26.26 feet; thence
leaving the Easterly side of Lot #105 Southeasterly 84.73 feet on a curve to the
left having a radius of 305.00 feet and subtended by a long cord bearing South 82
degrees 02 minutes 21 seconds East a distance of 84.46 :feet to a point on the
Westerly side of Lot 9103; thence with the R side of Lot #103
Southwesterly 28.62 feet on a curve to the left having a radius of 20.00 feet and
subtended by a long cord and bearing South 49 degrees 00 minutes 00 seconds
West a distance of 26.24 feet; thence South 08 degrees 00 minutes 00 seconds
West 103.79 feet to the point of beginning, containing 0.14 acres, more or less.
is hereby vacated as a public right -of -way of the City of Greencastle, Putnam County Indiana.

The City of Greencastle retains an easement in the vacated right -of -way together with the right to
inspect, repair, remove or replace existing water lines, sanitary sewers, storm sewers and other
is municipal utilities in said vacated right -of -way with modern equipment.
This Ordinance shall have the full force and effect of law immediately upon its passage by the
Common Council of the City of Greencastle, Indiana.
