4.Motion to Open Annual Public Hearing:
The Brewster Community Preservation Committee (CPC) will hold a Virtual Public
Hearing on November 17, 2021 at 4:00 pm. This Public Hearing has been
rescheduled from October 27th due to inclement weather. The purpose of the hearing
is to provide and gather information on the community preservation needs and
possibilities in the areas of community housing, historic preservation, open space,
and recreation. The CPC resources of the Town of Brewster will be reviewed, and
the information gathered at the hearing will be useful in assessing any funding
applications that the CPC may be recommending to the voters at the May 2022
Annual Town Meeting.
All interested parties are invited to attend and questions and comments are welcome.

The Brewster Community Preservation Committee is comprised of 9 members: four Citizen
Representatives, appointed by the Board of Selectmen and members designated by the following
committees: Conservation Commission, Planning Board, Brewster Historical Commission, Housing
Authority and Recreation Commission. The Committee was established with initial staggered terms and
three terms thereafter. For meeting schedules and agendas, please check the Brewster Calendar.
The Community Preservation Act (CPA) is a state law designed to help communities plan ahead for
sustainable growth. The CPA allows towns to levy a community-wide property tax surcharge of up to 3%
for the purpose of creating a local Community Preservation fund that can qualify for state matching funds.
The fund must be used to acquire and protect Open Space and recreation lands, preserve Historic
Buildings, Documents and Landscapes, and create and maintain Community Housing.
What is the Community Preservation Act?
In Brewster, the CPA has replaced the Cape Cod Land Bank, which had previously funded Open Space
acquisitions. The Act also created a State fund which will provide the Town with matching funds. A 20%
State match is anticipated for at least the near future.
Property taxes traditionally fund the Town's day-to-day operating needs of safety, health, schools, roads,
maintenance. - and more. The 3% CPA property tax surcharge will generate additional needed revenue to
meet Open Space, Community Housing, Historic Preservation, and Recreation goals.

How does the CPA work in Brewster?
The CPA was adopted by Town Meeting, November of 2004 and received ballot approval in May of 2005.
This approval results in a 3% surcharge on real estate tax, thereby replacing the Land Bank surcharge.
The Brewster By-law requires that 50% must be spent or reserved for Open Space, 10% must be spent or
reserved for Community Housing and 10% must be spent or reserved for Historic Preservation. The
balance, 30%, may be spent for Community Housing or Historic Preservation areas plus Recreation
purposes. This money is cumulative and can be spent in subsequent years.
This gives Brewster the opportunity to determine its priorities, plan for its future, and generate funds to
implement those plans.
What is the Application Process?
CPC Applications are available at Brewster Town Hall in the Selectmen's Office and the Planning
Office. Applications should be submitted by July 1st for the fall meeting or December 1st for the spring
meeting, to allow sufficient CPC review time for potential presentation to the following Brewster Town
Meeting. Note: Due to Town Meeting scheduling changes related to the COVID-19 pandemic, the CPC
will not be accepting any new applications on July 1, 2020 for FY2021 funding. The next application
submission date is December 1, 2021 for Spring Town Meeting 2022 (for FY2023).
These applications are reviewed, public hearings are held and decisions are made as to which
applications will be approved for recommendation at Town Meeting. Voters at Town Meeting will then vote
yes or no on CPC recommendations.

Chair Faythe Ellis called the meeting to order at 4:00 pm and announced a quorum.
This meeting will be conducted by remote participation pursuant to Chapter 20 of the Acts of 2021. No in-person meeting attendance will be permitted.

1.Financial Update
The spreadsheet is included in the packet with amended votes from last week’s meeting. Sharon said she
had nothing new to add. No further discussion.
2.Discussion and possible vote on changes to CPC Project Application Form
Faythe said this was an annual process to review the application and decide on any changes we think
necessary. Last year, we moved to a fillable form, the first page is instructions on how to use that file
and format.
On page 1, we updated Sarah as a member of the Committee. Paul recommended Peggy and
Bruce should be switched on the list to make it alphabetical.
He also said on the bullets in terms of criteria – he had questions regarding “how it boosts the
vitality of the Town” – wondering what that would mean. He was thinking of changing to: are
consistent with or help implement town planning documents such as the Vision Plan, the
Housing Production Plan, Open Space and Rec Plan, etc. to make it more specific and
measurable. Faythe and Sharon both felt this would be a good change. Peggy thought saying to
be consistent with and support the Vision Plan. She worries that to list specific plans may miss
something else. Faythe said perhaps help implement the Vision Plan and other CPC related
Town Planning documents. Sarah said she didn’t think the Vision Plan had much on the Historic
component.

Page 4 – recommendation from Faythe and Beth regarding beefing up the instructions of what
we are looking for folks to provide with the application. Please don’t provide any documentation
via online links as the Committee will not be checking for updates – be as concise as possible.
Paul said page 7 under recreation – appropriate to put something in about providing access for all
segments of the population as a check box. Rollie thought that was a good idea. Bullet point –
provide access or accessibility for all segments of the population/users. Peggy has a concern
about saying “all” as it’s hard to define some issues – can we make it more general? Perhaps
addresses accessibility needs, promotes accessibility, etc. Paul said provides or enhances
accessibility (please elaborate in application).
Page 8 – links wording to be added here as well.
Page 9 - Paul asked about step 5 the final report after project completion – is it necessary? Most
of the other awards haven’t submitted one, is this worth it? Faythe thinks we should keep and ask
liaisons to make sure we get it.

3.Update on 5 Year CPA Plan project
Faythe said the first thing she wanted to talk about were the signups for the focus groups – they are quite
thin. We haven’t heard back from any of them for some, two for others, 3 for another. Open Space is a
little better. General focus group only has one sign up. She thinks it makes sense for her to send the
original request again within the next day or so. She also thinks for those of the Committee involved
with the various categories, it might be helpful for them to reach out to others. She wants the groups to
be lively and helpful. Paul asked if Jenn Goldson gave a deadline for them to respond. Faythe said she
was unsure, but in her email, she will give a deadline. Sharon asked if Jenn Goldson has run into this
before. Faythe said she didn’t have any insight. She did say reaching out by email and phone would be
helpful. Paul said after the deadline, we could make calls to reach out to those we haven’t heard from.
Faythe said Jenn Goldson started the interviews yesterday. Faythe got a response from Chris Miller that
he is not available for any of the dates. She is open to other suggestions. Hal Minus, Charlie Sumner,
Peter Lombardi, and Cindy Bingham are the 4 we have right now. Faythe will reach out to Chris Miller
again. Faythe wanted to remind all members to take the time to go through the document draft and reach
out to her if there are any errors or omissions.
4.Public Hearing Planning – 10/27/21 at 5PM
Jenn Goldson confirmed she was available on the 27th and the 5PM start would be best as the Planning
Board will be pushed up to 7PM that evening. Faythe said she has included the planning that we have
done so far in the packet: the Agenda is posted on the Calendar, we have prepped the Cape Codder ads

for the 8th and the 15th, she suggests we send an email blast out 10/12 asking for speakers by 10/22, and
a follow up on the 10/25. We have a recommendation from Donna Kalinick to put a notice on Channel
18. And we will put the Announcement 10 days prior to the Hearing on the Brewster Webpage. Are
there any other suggestions? Paul mentioned the list and updating any of the contacts. Faythe said it does
need to be scrubbed as there are Committee changes – please email Faythe and cc: Beth for any updates.
5.Discussion and possible vote on draft award letters and authorization to forward to Town
Counsel for review
Bruce said the Housing Production Plan must be done as it is mandated by the State. The Plan was
responsible for hiring Jill Scalise, Brewster Housing Coordinator and other things that have come before
us having to do with Housing. There are experts which write the plan, just about every town does it.
They hire others, the fee is $25,000 which is the same as last time. The schedule is to hire the expert in
January, given there is approval at Town Meeting and must be complete by June. Faythe said in the
letter, the project completion date is June 30, 2022. Should the timing be longer? Paul said there is no
harm in giving it two years. For fall application, they go out to December 31, 2023. Paul said on number
4, requests for reimbursements – go to Beth and she will get it to Elizabeth? Paul also said for number 5,
project updates are – Jan 1, April 1, July 1, and Oct 1.

Latham Centers, Inc. Strong Start in Adult Living Apartments, Paul is the liaison. Paul said first
page is standard. Wanted to go over the terms and conditions. #1 & #2 standard, #3 is securing all
permits including Historical Commission, Planning Board and Zoning Board of Appeals? Faythe said it
was the Old King’s Highway Commission, not the historical commission. #4 is execution of the
affordable housing restriction, town counsel said for at least 30 years, its housing, but it is very different
from regular affordable rental housing, he would suggest a term of just 30 years would be acceptable.
Faythe said when they toured it, there was a thought that if the program changes, the building will still
be there, she would want it to be the standard affordable housing restriction – perpetually. Condition #5
is typical, the award is in form of the 0% loan, with a note and a mortgage – if for some reason
something goes awry, the town would be eligible to get the $150K repaid. #6 final project development
and operating budget pro-forma with confirmation the funding was received including from the school
district for the various sending schools. Page 3, condition #7, subsidized housing discussion, contacted
the department of Housing and Community Development if units eligible for inclusion and provide us
with documentation that everything has been satisfied on their end. #10 holding back 10% of the grant
funds until construction has been completed. Condition 7 satisfied – SHI eligible. He added that at least
5 units were occupied by income eligible individuals. Condition #11, term is 5 years; condition 7 re:

terms and conditions are binding, but significant changes should require CPC approval and amendment
of the award letter and need to be approved by the chair if changes are significant. Add Paul’s email and
phone number as liaison. Faythe said she would ask Counsel regarding the amount and total amounts
and how to award that - $155K with $150K to go toward this project.

for final review.

Paul wondered about the first page last paragraph about revenues received in excess of estimated
receipts – do we need that for Fall Town Meeting? Faythe said she would ask.

Elizabeth said the current draft is almost finalized, has been sent to the Cape Cod Commission for
review and approval. The Planning Board, Select Board, Open Space Committee, and Cape Cod
Commission for their letters, once we have them, we will be sending to the State for final approval.
Faythe asked if the Committee would like Krista to come speak with Committee if we wanted to do a
letter of support as well. Sharon would like her to come speak in front of the Committee, Faythe

thought it would be interesting. We will invite her. Elizabeth will contact her – perhaps the second

Chair Faythe Ellis called the meeting to order at 4:00 pm and announced a quorum.
This meeting will be conducted by remote participation pursuant to Chapter 20 of the Acts of 2021. No in-person meeting attendance will be permitted.
If the Town is unable to live broadcast this meeting, a record of the proceedings will be provided on the Town website as soon as possible.
1.Financial Update
Faythe asked Sharon to talk us through the update. Sharon said this was pretty much the same as the
information in the last packet, but we have received a check from the State for $192,400 which is for the
McGuerty Road land purchase. It is being held in a separate account but will be included in the CPC
funds available for use but reserved for Open Space. And after the reconciliation at the end of the fiscal
year, that money gets rolled into the Open Space bucket.
2.Discussion and possible vote on draft award letter and authorization to forward to Town
Counsel for review
Faythe said that Beth has done the first draft of the document and passed it on to Elizabeth and herself
for review and completion of contingencies. She asked Elizabeth to walk the committee through the
letter. On the first page, the highlighted part can be removed since it’s a town project and we don’t need
grant agreements. Period after Town of Brewster and remove the next paragraph. Terms and Conditions,
she added in number 4. The model grant agreement won’t be used, but we will put Eric Drey’s
information there. Project approval amounts, Faythe will call out the amounts to Counsel when she
sends for review. Elizabeth said it should show what was asked for and what we added for legal
expenses. Perhaps in the second paragraph. Faythe said we could break it out under Terms and
Conditions number 1. Faythe said that Peter Lombardi is still trying to sort out Article 97 covering us to
make sure the Town has control of the property for a 30-year term, and he will get back to the
committee. If they cannot sort it out, they will withdraw the request. Paul said perhaps it should say
prior to Town Meeting instead of prior to disbursement of the funds. Faythe will call the “historic

rehabilitation or restoration” when she sends it to Counsel for review. Paul said under number 4, adding
detailed in summery memo in whatever date Eric’s memo was, and says letter is going to both Brian
Locke and Peter Lombardi, Peter doesn’t need to be cc’d.

3.Report on warrant article presentations to Select Board and Finance Committee
Faythe said the Select Board meeting went well and everyone voted in favor of the three projects in our
article. The Finance Committee had much more discussion regarding the Latham project. For the first to
projects they voted unanimously – Crosby Mansion and Housing Production Plan update. The questions
were about Latham – how the selection of clients would work, is there a priority for Brewster youth, will
the units count toward our SHI, are other towns contributing, a statement from a member that they are
looking for housing projects that would have a local preference. Ultimately, the vote was 7 in favor, 1
opposed, none abstaining. The discussion went on for quite a while. Unfortunately, there was not a
representative from Latham to answer any of the questions. Sharon said her conception is that these
individuals are not in the program for the long term, only to be trained and helped until self-sustainable,
so the local preference didn’t make sense to her. Faythe agreed. She went on to say that maybe the local
preference should be part of information we provide to other committees so they can be aware of the
nuances of this topic. Barbara asked for Faythe and Paul to come up with some language regarding how
adding local preference could get us into “peril.” Paul said that folks will be there for at most 2 years
before moving on, and local preference applies to initial residence, not subsequent residence. He thinks
it’s worth getting back to Finance Committee on the issues around the selection process and local
preference – perhaps Latham can send an email to the Finance Committee regarding both.
4.Update on Public Hearing planning – 10/27/21 at 5PM
The Public Hearing is an annual meeting where we ask folks to come in front of us and tell us about
CPC projects coming down the line. We had thought we could combine our Public Hearing and Public
Forum where Jenn would be participating in, however, after discussing with Jenn what she was going to
have at the meeting, we decided it would not work to combine them. Faythe reached out to neighboring
town’s CPC Chairs and Chairs of Affordable Housing Trusts to ask if they might be aware of any
projects where people might come to Brewster asking for funding – in an effort to find any regional
projects that might be coming our way. She hasn’t heard of any yet. Last year, the Hearing was an hour
and a half, and she expects the same this year.

Faythe asked the members if they had completed the review of the member profiles from Jenn Goldson.
Elizabeth and Paul have. Jenn Goldson has extended our deadline for edits to October 20th. Faythe asked
for the committee to cc her when they are responding to Jenn Goldson and mentioned how much detail
there is in the profiles and asked for members to read through because things jump out at her each time
she goes through it. Faythe will ask Jenn Goldson to send an updated link per Elizabeth’s request.
The Public Forum is scheduled for November 10th at 4PM which will keep us on our timeline. She will
provide us with press release and wording for various media to help publicize that.
2 assignments for the Committee – read through the document again and set up an interview
appointment with Jenn Goldson.
6.Establish working group to complete content submission form for Town Website update due
11/15
The Town is doing an update on the Town Website – each committee has a page on the website. The
date to send information in for the update is November 15th. Faythe would like to establish a working
group of one or two members to go through and put together the content submission form for the
revisions to the CPC’s webpage. Bruce and Elizabeth volunteered. Faythe thanked them and said she is
available for any questions. She will close the Public Forum and have a bit of time for Committee
business after the Forum closes to discuss.

Faythe said included in the Packet was an update from the Habitat Red Top Road project. Paul said he
had an email from Habitat that they got approval for their comprehensive permit.
Faythe said regarding the Cape Rep Barn tour for the Committee and the Historical Commission as
well, Janine Perry is working to get everything in place before she books the tour. It is going to happen.
Peggy said the spoke to Ted Baylis regarding the PBCB grant – he said their Board and legal are
checking with the bank and he doesn’t have a response yet. He asked if there was a deadline for when
we need to hear back. Faythe said no.

Faythe said as you know in September there was a very comprehensive planning about Open Meeting
Law and Committee member responsibilities with a lot of material sent out after the meeting. Instead of

excellent information. Kudos for anyone attending that meeting and it is an excellent resource for
everyone.

1.CPA Public Forum
After Faythe opened the meeting, Jenn Goldson asked the members to introduce themselves. Jenn
Goldson then explained how the meeting would go. She said it is a bit challenging being on a webinar
because she can’t see everyone who is attending and asked for as much communication through the chat
function as possible – attendees typing their questions or statements into chat for others to read/see and
for her organization to be able to compile all the data and do its analysis. She is also using Poll
Everywhere software to ask questions to those attending where they can send their responses through
that software or connect through a text messaging program as well. So, how to participate during the
meeting: Polling and Open Questions, Chat, Open Q+A – where all questions and responses will be
visible to all attendees, and Open Comment time at the end by raising your hand in the Chat function.
All comments, questions and polling responses will be part of the public record. Jenn Goldson went on
to say that the primary objective of the forum is to get your informed opinion about the priorities for the
Community Preservation Plan for Brewster.
Jenn Goldson went into some CPA basics – an overview. In 2000 CPA was signed into law. In 2004,
Legislation to allow Cape Cod communities to convert from the Cape Cod Land Bank Program to CPA.
It is MA General Law (MGL c.44B) that allows MA communities to conduct referendums to add a small
surcharge on local property taxes. CPA allows communities to generate revenue for – open space and
natural resources, historic resources, community housing and outdoor recreation. Brewster voted to
adopt the CPA in 2005. There is a local 3% property tax surcharge – no exemptions. There is also a local
tax surcharge and variable annual distribution from the State CPA Trust Fund. Minimum statutory
requirements: at least 10% must be spent or set aside for the future spending for each of the following

categories: Community Housing, Open Space/Recreation, and Historic Preservation – up to 5% may be
used for CPC administrative costs. When Brewster adopted the CPA, they wanted to go above that 10%
--- 50% of CPA revenues to Open Space, 10% to Housing, 10% to Historic Preservation, and the
remaining 30% to any of those 3 as necessary. Brewster adopted a local bylaw that sets minimum
funding allocations by CPA category. One other community has codified minimums that exceed the
state requirements: Bourne. And some other communities have target allocations that are not codified in
bylaws or ordinances - they are just “target” allocations or guidelines.
Brewster wanted to preserve the level of funding for open space that it had under the Land Bank. Back
then, CPA funds were matched 100% by distributions from state CPA Trust Funds. The Land Bank was
set to expire in 20 years. Therefore, Brewster adopted the bylaw. People have been asking if it is time to
think about changing the allocation for Brewster or not? Some feel it should stay the same and others
want the bylaw changed or perhaps adjusted to the 10% minimums and then have these allocations that
aren’t part of a bylaw. Jenn Goldson went on to give examples of other towns and what they have done
for their allocations.
Jenn Goldson explained how Brewster goes through CPA Funding Area Profiles and mapping, which
will become pages to demonstrate needs and resources for CPA Funding. They have also looked at the
town’s vision plan in considering these changes. There are 8 Building Blocks of the Vision Plan –
Community character, Open space, Housing, Local economy, Coastal management, Water resources,
Governance, and Community infrastructure. She and her team pulled out the different goals that would
relate to CPA funding. They ran several focus groups and interviews to find out about priorities, needs
and resources that should be highlighted. She said the themes from the discussions were: opportunities at
the Cape Cod Sea Camps property, how best to balance needs for CPA funds to support both housing
and open space goals, questioned if recreation allocation has been enough to meet needs, and mixed
opinions on if and/or how to change the local allocation formula.
She went on to the Q & A portion: Jenn Goldson began by talking about each of the areas the CPA
could fund and giving examples from other towns where they have used their funds. Then she went into
the Questions:
What historic projects/priorities do you hope CPA could fund in the next 5 years?
What open space projects/priorities do you hope CPA could fund in the next 5 years?
What recreation projects/priorities do you hope CPA could fund in the next 5 years?
What multi-use projects/priorities do you hope CPA could fund in the next 5 years?
What criteria do you think the CPA should consider when reviewing regional project
applications?
The CPC has not deliberated on this yet but are using this process to understand what the community
needs are in the future.
Jenn Goldson thanked everyone for attending the webinar and for using the new technology to capture
all of the thoughts from the audience.
Faythe thanked everyone for participating as well. She also wanted to point out the Annual CPC Public
Hearing one week from today for people submitting project applications to the CPC in the Spring Town
Meeting Schedule and invited all to attend.
