HomeMy Public PortalAbout2000-09 Vacate Public Right-of-Way® ORDINANCE 2000 -9 An Ordinance Approving the Petition to Vacate Public Right -of -Way Located in the City of Greencastle, Putnam County, Indiana WHEREAS, James Wall and Stephanie Wall are the owners of certain real estate which is located in an area under the jurisdiction of the Common Council of the City of Greencastle; and WHEREAS, there are certain public ways contiguous to said real estate; and WHEREAS, the abutting landowners to the public way to be vacated are as follows: James & Stephanie Wall Jim MclMains Ewell & Maridee Dozier 410 W. Walnut County Road 200 West Greencastle IN 46135 Greencastle IN 46135 Brazil IN 47834 WHEREAS, all of the public way to be vacated lies wholly with in the jurisdiction of the Common Council of the City of Greencastle, Indiana; and WHEREAS, the Plan Commission of the City of Greencastle, Indiana, did at its regular meeting held April 24, 2000, approve the petition of James Wall and Stephanie Wall for the vacation of certain public streets and alleys located in the City of Greencastle, Indiana; and WHEREAS, the Common Council of the City of Greencastle, Indiana, parsuant to law 0 , published notice that this matter would come before the Common Council for public hearing at the regular meeting of the Common Council to be held on May 31, 2000 at 6:00 p.m. at the Greencastle City Hall, 1 North Locust Street, Greencastle, Indiana; and WHEREAS, the adjoining property owners have consented or have been notified pursuant to statute as to the vacation of the public ways; and WHEREAS, the Common Council of the City of Greencastle, Indiana, has, after public hearing, determined that closing of the following described public ways is in the public and economic interest of the City of Greencastle, such closing will not unreasonably interfere with the flow of traffic on the City of Greencastle road system and that the relief prayed for in said Petition should be granted and that the portion of the described public ways located in the City of Greencastle, Indiana, should be vacated. NOW, THEREFORE, be it ORDAINED by the Common Council of the City of Greencastle, Indiana, that the following public streets and alleys located in the City of Greencastle, Putnam County, Indiana, and more particularly described as follows: Situate in the State of Indiana, County of Putnam and being a part of Gillespie Street located in the Original Plat of the City of Greencastle, more particularly described to -wit: Beginning at the Northwest comer of Lot 49 in the Original Plat of the City of Greencastle; thence South 214.6 feet to the Southwest comer of Lot #10; thence West 50.0 feet with the Westerly extension of the South line of Lot #10 to the West line of the ® Northwest quarter of Section 21, Township 14 North, Range 4 West; thence North 214.6 feet with the West line of said Northwest quarter to the South right -of -way line of Walnut Street; thence East 50.0 feet with said right -of -way to the point of beginning, containing 0.25 acres, more or less. " are hereby vacated as a public right -of -way of the City of Greencastle, Putnam County, Indiana, and that such lands shall cease to be a public street, alley or right -of -way and that title to such vacated land shall be hereby transferred to the adjoining landowner for that portion of the street from its centerline to the current adjoining property line. The City of Greencastle retains an easement in the vacated alley together with the right to inspect, repair, remove or replace existing water lines, storm sewers, sanitary sewers and other municipal utilities in said vacated alley with modern equipment. This Ordinance shall have the full force and effect of law immediately upon its passage by the Common Council of the City of Greencastle, Indiana. Dear Nancy: Due to the inability of Herman and Associates to receive a sewer connection until the fall of 2002, their proposed apartment complex for the south side has been placed on hold until the spring of 2001. Inasmuch as the rezoning of the Skinner property was requested solely to facilitate Herman and Associates development, Mr. Skinner has elected not to pursue the rezoning at this time. We would like to request that the issue be tabled until April 2001 rather that terminates the process. Since there is a reasonable chance that the entire project will resume its active process next spring we hope to avoid repeating the costs associated with the appearance before the Zoning Board.
