AN ORDINANCE APPROVING THE PETITION OF GREENCASTLE COMMUNITY
• SCHOOL CORPORATION TO VACATE PUBLIC RIGHT -OF -WAY LOCATED
IN THE CITY OF GREENCASTLE PUTNAM COUNTY INDIANA
WHEREAS, the Plan Commission of the City of Greencastle, Indiana, did at its regular meeting
held on March 20, 2000, approve the Petition of Greencastle Community School Corporation for
the vacation of certain public right -of -ways, located in the City of Greencastle; and
WHEREAS, the Common Council of the City of Greencastle, Indiana, pursuant to law,
published notice that this matter would come before the Common Council for public hearing at
the regular meeting of the Common Council to be held on April 11, 2000 at 7:00 p.m. at the
Putnam County Public Library, 103 East Poplar, Greencastle, Indiana; and
WHEREAS, the adjoining property owners have consented or have been notified pursuant to
statute as to the vacation of the right -of -way; and
WHEREAS, the Common Council of the City of Greencastle, Indiana, has after public hearing
determined the relief prayed for in said Petition should be granted and that the portion of the
public right -of -ways located in the City of Greencastle, Indiana, should be vacated.
NOW, THEREFORE, be it ORDAINED by the Common Council of the City of Greencastle,
Indiana, that the following public right -of -way located in the City of Greencastle, Putnam
• County, Indiana, and more particularly described as follows:
Alley from Elm Street to Howard Street and Apple Street from Crown Street
to the existing Ridpath Elementary School.
Beginning at a 518 inch rebar marking the Southwest corner of Lot #8, Block 96 of
Central Survey to the town, now City of Greencastle, then North 89 degrees 54
minutes 28 seconds East 183.21 feet with the North right -of -way line of Apple
Street to a 5/8 inch rebar marking the Southeast corner of Lot 48; thence South 00
degrees 05 minutes 02 seconds East 40.00 feet to the Northeast corner of Lot # 1,
Block #3 of Ashes Enlargement, thence South 89 degrees 54 minutes 28 seconds
West 1 83.26 feet with the South right -of -way line of Apple Street to the
Northwest corner of Lot #2, Block #3 of Ashes Enlargement; thence South 00
degrees 01 minutes 05 seconds East 154.44 feet with the East right -of -way line of
an alley to a 5/8 inch rebar marking the Northwest corner of Lot #7, Block 93 of
Ashes Enlargement, thence South 89 degrees 53 minutes 55 seconds West 12.00
feet to a 5/8 inch rebar marking the Northeast corner of Lot #6, Block 93 of Ashes
Enlargement, thence North 00 degrees 01 minutes 05 seconds West 540.50 feet
with the West right -of -way of a 12 foot wide alley to the Northeast corner of Lot
42, Block #6 of Central Survey, thence North 89 degrees 52 minutes 33 seconds
• East 12.00 feet with the South right -of -way line of Elm Street to the Northwest
corner of Lot #1; thence South 00 degrees 01 minutes 05 seconds East 346.07 feet
with the East right -of -way line of a 12 foot wide alley to the point of beginning
containing 0.32 acres, more or less.
is hereby vacated as a public right -of -way of the City of Greencastle, Putnam County, Indiana.
The City of Greencastle retains an easement in the vacated right -of -way together with the right to
inspect, repair, remove, or replace existing water lines, sanitary sewers, storm sewers and other
municipal utilities in said vacated right -of -way with modem equipment.
This Ordinance shall have the full force and effect of law immediately upon its passage by the
Common Council of the City of Greencastle, Indiana.
