The procedure for filing a Zoning Map Amendment with the Plan Commission is as follows: 1. Find a sponsor from Common Council or Plan Commission 2. Pre-application meeting with the Zoning Administrator (City Planner) 3. Submit an application 28 days before the next Plan Commission meeting 4. Zoning Administrator will notify all interested parties of the public hearing by a minimum of 10 days before the hearing. 5. Plan Commission public hearing 6. Common Council meeting (Approve or Deny) A complete application contains the following: 7. Completed and signed application (hard copy, digital copy, or online application) 8. $100 application fee (to be paid upon submittal – payment does not guarantee approval) INCOMPLETE APPLICATIONS WILL NOT BE PROCESSED. It is the responsibility of the applicant to ensure that the request is complete. Staff will not perform work required to provide missing information. Page | 2 Meeting Information Time/Date: 5:30 PM, 4th Wednesday of each month Location: Richmond Council Chamber, 3rd Floor – Municipal Building, 50 North 5th Street, Richmond, IN 47374 Meeting Structure: - Roll Call - Pledge of Allegiance - Minutes - Proof of Publication - New Business (Text Amendment public hearing – public comment) - Old Business (TABLED applications from previous meetings) - Adjournment REMINDER – applicant or certified agent must be present at the Plan Commission hearing. *Failure to appear may result in the dismissal of the Application. Applicant/Agent Responsibilities: 1. Attend the meeting to discuss the application and answer potential questions. 2. Speak to proposed Findings of Fact in application: i. Is the request compatible with the City of Richmond’s Richmond Rising: Community Action Plan? ii. What are the current conditions and the character of current structures and uses in each district? iii. What is the most desirable use for which the land in each district is adapted? iv. Will property values be conserved throughout the jurisdiction? v. How is the request promoting responsible development and growth? Determination Process: The Plan Commission shall certify the amendment to the Unified Development Ordinance and forward the application to the Common Council with a favorable recommendation, an unfavorable recommendation, or no recommendation, along with any conditions or commitments. The Common Council makes the final determination regarding an Application for a Text Amendment and any recommended commitments by ordinance. 1. Ordinance is created for a completed Text Amendment application 2. Ordinance is placed on Common Council agenda for first reading 3. Common Council refers proposed ordinance to Plan Commission 4. Plan Commission meeting holds a public hearing and renders a recommendation to Common Council 5. Ordinance is placed on Common Council agenda for second reading 6. Common Council will either (a) suspends rules to allow a vote on second reading and render a determination (approve or deny), or (b) wait to render a determination after third and final reading at a later meeting.
