HomeMy Public PortalAbout20111214Exhibit_ParkingOrdinances.pdfORDINANCE NO, 19-2011 AN ORDINANCE TO AMEND THE CODE OF ORDINANCES SEC. 66-135 PERTAINING TO THE PARKING OF MOTOR, VEIHICLES FOR THE CITY OF TYBEE ISLAM, GEORGIA WHEREAS, the duly elected governing authority for the City of Tybee Island, Georgia, is authorized under Article 9, Section 2, Paragraph 3 of the Constitution of the State of Georgia to adopt reasonable ordinances to protect and improve the public health, safety, and welfare of F the citizens of Tybee Island, Georgia, and WHEREAS, the duly elected governing authority for the City of Tybee Island, Georgia, is the Mayor and Council thereof, and WHEREAS, the governing authority desires to adopt ordinances under it police, zoning, and home rule powers, and 3 WHEREAS, the City of Tybee Island is authorized by ordinance to establish rules of procedure for council meetings; and i WHEREAS, the governing authority desires to amend Sec. 166-135 of the Code dealing with the parking of motor vehicles so as to revise the provisions thereof and to provide for clarification as to parking spaces, pay and display meters, and for other purposes; NOW, THEREFORE, be it ordained by the governing authority of the City of Tybee i Island that Sec. 66-135 of the Code of Ordinances of the City of Tybee Island is hereby amended so as to add the following definition: E Pay and Display Meter means a device which will provide parking authorization by means of a receipt to be placed upon the dash of the vehicle for which parking time is permissible and authorized. It is the intention of the governing body, and it is hereby ordained, that the provisions of this ordinance shall become and be made a part of the Code of Ordinances, City of Tybee Island, Georgia, and the sections of this ordinance may be renumbered if necessary to accomplish such intention. ' The following words, terms and phrases, when used in this division, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning: Park ng means the standing of a vehicle in a city -owned parking lot or upon a street whether that vehicle is occupied or not and whether that vehicle be accompanied or not by an operator for a period of time in excess of two ?minutes. Parking meter and mecha7deal parking time indicator mean a device which shall indicate thereon the length of time during which a vehicle may be parked in a particular place which shall have as a part thereof a receptacle or chamber for receiving and storing coins of United. States money, a slot or place in which the coin may be deposited; a timing mechanism to indicate the passage of the interval of time during which parking is permissible and which shall also display an appropriate signal when the aforesaid interval of time shall have elapsed; also brief instructions as to its operation. Parking ,space, individual means a portion of the street or street right-of-way of sufficient length and depth to accommodate a vehicle to be parked, as shall be specified by the city. Also a space for parking in a city parking lot or other area designated for vehicular parking. Vehicle means any device in, upon or by which any person or property is or may be transported upon a public highway, except those as are used exclusively by human power. Pay andDisplay Meter means a device which will provide parking authorization by means of a receipt to be placed upon the dash of the vehicle for which parking time is permissible and authorized. ORDINANCE NO. 20-2010 AN ORDINANCE TO AMEND THE CODE OF ORDINANCES PERTAINING TO PAY AND DISPLAY METERS FOR THE CITY OF TYBEE ISLAND, GEORGIA WHEREAS, the duly elected governing authority for the City of Tybec Islands Georgia.,, is authorized under Article 9, Section 2, Paragraph 3 of the Constitution of the State of Georgia to adopt reasonable ordinances to protect and improve the public health, safety, and welfare of the citizens of Tybee Island, Georgia„ and WHEREAS, the duly elected governing authority for the City of Tybee Island, Georgia, is the Mayor and Council thereof, and WHEREAS, the governing authority desires to adopt ordinances -under it police, zoning, and home rule powers, and WHEREAS, the City of Tybee Island is authorized by ordinance to establish rules of procedure for council meetings; and WHEREAS, the governing authority desires to create a new Sec. 166-149 entitled Pay and Display Meters of the Code dealing with Pay and Display meters, and for other purposes; NOW, THEREFORE, be it ordained by the governing authority of the City of Tybee Island that Sec. 66-149 of the Cade of Ordinances of the City of Tybee Island is hereby created so to read as follows: See. +66-149. Pay and Display Meters. All provisions hereof in the preceding sections in Division. 2 dealing with metered parking shall have application to pay and display meters which may be placed in or the vicinity of parking spaces along right-of-ways and in parking lots within the City. Parking beyond the purchased interval of time in the use of a pay and display meter device shall subject the violator in all respects to the sane penalties as if the violation was as to a coin fed parking meter and as established in the preceding sections. It is the intention of the governing body, and it is hereby ordained, that the provisions of this ordinance shall become and be made a part of the Code of Ordinances, City of Tybee Island, Georgia, and the sections of this ordinance may be renumbered if necessary to accomplish such intention, This Ordinance shall become effective on day of , 2010. ORDINANCE NO. 22-2010 AN ORDINANCE TO AMEND THE CODE OF ORDINANCES SEC. 66-138 PER.TAMG TO DESIGNATION OF INDIVIDUAL PARKING SPACES FOR THE CITY OF TYBEE ISLAND, GEORGIA WHEREAS, the duly elected governing authority for the City of Tybee Island, Georgia, is authorized under Article 9, Section 2, Paragraph 3 of the Constitution of the State of Georgia to adopt reasonable ordinances to protect and improve the public health, safety, and welfare of the citizens of Tybee Island, Georgia., and WHEREAS, the duly elected governing authority for the City of Tybee Island, Georgia, is the Mayor and Council thereof, and V44MEAS, the governing authority desires to adopt ozdanances under it police, zoning, and home rule powers, and WHEREAS, the City of Tybee Island is authorized by ordinance to establish rules of procedure for council meetings; and WHEREAS, the governing authority desires to amend Sec. 66-138 relating to designation of individual puking spaces, and for other purposes; NOW, THEREFORE, be it ordained by the governing authority of the City of Tybee Island that Sec. 66-138 of the Code of Ordinances of City of Tybee island is hereby amended so as to include a provision clarifying the designation of parking places so that hereafter such section shall read as follows: Sec. 66-138. Designation of individual parking spaces. The city manager or parking services director is authorized and directed to designate any individual parking spaces as it deems proper along the streets within the city limits for the parking of vehicles. ORDINANCE NO. 21-2010 AN ORDINANCE TO AMEND THE CODE OF ORDINANCES SEC. 66-101 PERTAINING To PA KING ZONES FOR THE CITY OF TYBEE ISLAND, GEORGIA WHEREAS, the duly elected governing authority for the City of Tybee Island, Georgia, is authorized under Article 9, Section 2, Paragraph 3 of the Constitution of the State of Georgia to adopt reasonable ordinances to protect and improve the public health, safety, and welfare of the citizens of Tybee Island, Georgia, and WHEREAS, the duly elected governing authority for the City of Tybee Island, Georgia, is the Mayor and Council thereof, and WHEREAS, the g+oveming authority desires to adapt ordinances ander it police, zoning, and home rule powers, and WHEREAS, the City of Tybee Island is authorized by ordinance to establish hales of procedure for council meetings; and WHEREAS, the governing authority desires to amend Sec. 66-101 relating to parldng zones so as to include a reference to pay and display meters, and for other purposes; NOW, THEREFORE, be it ordained by the governing authority of the City of Tybee Island that Sec. 66-101(a) of the Code of Ordinances of the City of Tybee Island is hereby amended so as to include a reference to pay and display meters so that hereafter such section shall read as follows: Ser. 66-101. Parting zones. (a) The mayor and council shall have the authority to place parking meters and/or pay and display meters or devices on public streets and operate parking lots within the city. No parking zones will be marked by a sigh or a yellow .line. It is the intention of the governing body, and it is hereby ordained, that the provisions of this ordinance shall become and be made a part of the Code of Ordinances, City of Tybee Island, Georgia, and the sections ofthis ordinance may be renumbered if necessary to accomplish such intention.
