HomeMy Public PortalAbout2010-32 Opposing the expanded or intensified use of lands along the Rickenbacker Causeway and Virginia KeyRESOLUTION NO. 2010-32 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF KEY BISCAYNE, FLORIDA, ESTABLISHING A POLICY OPPOSING THE EXPANDED OR INTENSIFIED USE OF LANDS ALONG THE RICKENBACKER CAUSEWAY AND VIRGINIA KEY; PROVIDING FOR AFFIRMATIVE STEPS TO PROTECT AND PRESERVE THE NATURAL AND BUILT ENVIRONMENT OF KEY BISCAYNE, FLORIDA; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Village of Key Biscayne (the "Village") incorporated on June 18, 1991 with the mission of protecting and enhancing the quality of life of Village residents; and WHEREAS, the Rickenbacker Causeway is the sole means of ingress and egress to and from the Village, serving not only the residents of the Village, but the hundreds of thousands of visitors who enjoy Crandon Park and Cape Florida State Park; and WHEREAS, the activities that occur along the Rickenbacker Causeway and/or Virginia Key may adversely affect the mission of the Village to protect the public safety and quality of life of its residents and visitors; and WHEREAS, the Village wishes to take all steps necessary to ensure that no further adverse impact and degradation in the quality of life occurs for its residents; and WHEREAS, the Village Council finds it necessary to establish a formal policy opposing any effort by Miami -Dade County and/or the City of Miami to approve the development, redevelopment, alteration, modification or other use or reuse of lands along Rickenbacker Causeway or on Virginia Key which would in any manner adversely impact the Village residents and/or visitors to the Village, Crandon Park or Cape Florida State Park; and WHEREAS, the Village Council further finds it necessary and appropriate to establish a mechanism to ensure that no public or private development activity or development approvals are granted for any new development, use or reuse of land without the Village's prior knowledge and opportunity to comment and/or object to such activity; and WHEREAS, the Village Council finds that this Resolution is in the best interest and welfare of the residents of the Village. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF KEY BISCAYNE, FLORIDA, AS FOLLOWS: Section 1. Recitals Adopted. That each of the above -stated recitals is hereby adopted and confirmed. Section 2. Adopted Policy. It is the formal policy of the Village to oppose any new use, reuse or development activity along the Rickenbacker Causeway (including on the Causeway itself), which would in any manner adversely impact the daily life activities of the residents of the Village or would in any manner further degrade the existing natural and built environment of the entire chain of islands collectively known as Key Biscayne. Section 3. Implementation. The Village Council hereby authorizes the Village Manager to immediately establish a formal plan to monitor the activities of all public and private entities proposing the development or change of use of any lands along the Rickenbacker Causeway and/or Virginia Key and to take any and all affirmative steps necessary to enforce the spirit and intent of this Resolution, to protect and preserve the existing conditions within the Village and to prevent any further degradation thereof. 2 Section 4. Effective Date. That this Resolution shall be effective immediately upon adoption hereof. PASSED AND ADOPTED this 31st day of August, 2010. CONCHITA H.
