APPROVAL OF MINUTES The City Council is requested to review and approve: 1) Minutes of the City Council Regular Meeting of November 5, 2013; 2) Minutes of the City Council Special Meeting of November 6, 2013; and 3) Minutes of the City Council Special Meeting of November 13, 2013. Recommendation: Approve. B. PLANNING COMMISSION ACTIONS – MEETING OF OCTOBER 22, 2013 The City Council is requested to review the Planning Commission actions of their meeting of October 22, 2013. Recommendation: Receive and file. C. CONSIDERATION TO RELAX ENFORCEMENT OF OVERNIGHT City Council Agenda November 19, 2013 Page 3 of 13 PARKING RESTRICTIONS DURING THE HOLIDAY SEASON For the past three years the City Council has relaxed the enforcement of the overnight parking restrictions to allow families to gather during the holiday season without having to worry about obtaining an overnight parking permit. The Overnight Parking Ordinance does not contain an exception for the City Manager, or other staff members, to suspend or relax the parking restrictions. However, the City Council has the authority to temporarily suspend enforcement of the overnight parking restrictions during a specified period of time. Staff is proposing that the City Council temporarily relax enforcement from 12:00 a.m. (mid-night) on Sunday, December 15, 2013 to 11:59 p.m., Sunday, January 5, 2014. Enforcement of the overnight parking restrictions will resume at 2:00 a.m. on Monday, January 6, 2014. Recommendation: Relax the enforcement of the overnight parking restrictions from 12:00 a.m. (mid- night) on December 15, 2013 to 11:59 p.m. on January 5, 2014. D. ADOPTION OF RESOLUTION NO. 13-4954 APPROVING A MEMORANDUM OF UNDERSTANDING (MOU) BETWEEN THE CITY AND MEMBERS OF THE UPPER LOS ANGELES RIVER WATERSHED GROUP REGARDING THE ADMINISTRATION AND COST SHARING FOR DEVELOPMENT OF AN ENHANCED WATERSHED MANAGEMENT PROGRAM (EWMP) AND COORDINATED INTEGRATED MONITORING PROGRAM (CIMP) Earlier this year, the City Council approved a Letter of Intent to participate in the development of an Enhanced Watershed Management Program and Coordinated Integrated Monitoring Program with the Upper Los Angeles River Watershed Group, in an amount not to exceed $14,000. The Memorandum of Understanding (MOU) currently being considered by City Council is the next step towards the development of the EWMP and CIMP, it grants the City of Los Angeles and the consultant access to City storm drains, channels, catch basins, and other facilities in order to prepare the EWMP and CIMP. This MOU becomes effective December 28, 2013 and must be signed by the Mayor before that date in order for the City of Temple City to be included in the EWMP and CIMP. The MOU will remain effective until June 30, 2016. Recommendation: Adopt Resolution No. 13-4954 approving a Memorandum of Understanding (MOU) between the City and members of the Upper Los Angeles River Watershed Group for development of an Enhanced Watershed Management Program and Coordinated City Council Agenda November 19, 2013 Page 4 of 13 Integrated Monitoring Program. E. HISTORIC PRESERVATION UPDATE The City Council previously requested that the Planning Commission make a recommendation to the City Council on whether or not to proceed with the creation of an historic preservation program. The Planning Commission held a workshop on October 22, 2013, regarding historic preservation. Attendees of the workshop were asked to fill out a questionnaire about historic preservation. At the conclusion of the workshop, the Planning Commission did not feel they had enough information to make a determination one way or another. The Planning Commission then recommended that the discussion be continued as part of the General Plan 2050 process which will begin in January 2014. Recommendation: Receive and file the update on historic preservation and direct staff to make this discussion part of the General Plan 2050 process. F. CLOSEOUT REPORT ON TWO-YEAR WORK PLAN ITEMS (FY 2011-12 and 2012-13) The Work Plan closeout report recognizes Council and staff’s combined efforts over the past two fiscal years of transitioning City Hall from a status quo to high performing organization. Accomplishments cited include 49 completed projects, 57 projects underway, and seven projects not yet started or canceled. Projects identified as underway will be completed by June 30, 2013 with exception to longer-term initiatives like planning studies, which may take more than a year to complete. Furthermore, any projects not yet started or canceled will be discussed and assessed for consideration as part of the FY 2014-15 City Budget preparation process. Recommendation: Receive and file the closeout report on Two- Year Work Plan items, which includes the 2013 Second Quarter progress report (i.e., April through June). G. ADOPTION OF RESOLUTION NO. 13-4955 – APPROVAL OF PAYMENT OF BILLS The City Council is requested to adopt Resolution No. 13-4955 authorizing the payment of bills. Recommendation: Adopt Resolution No. 13-4955. 8. UNFINISHED BUSINESS A. SECOND READING AND ADOPTION OF ORDINANCE NO. 13-979, AMENDING ARTICLE E (“SITE PLAN REVIEW AND CONGESTION MANAGEMENT”) OF CHAPTER 1 (“ZONING CODE”) OF TITLE 9 (“ZONING REGULATIONS”) OF THE TEMPLE CITY MUNICIPAL CODE TO ESTABLISH LOW IMPACT DEVELOPMENT (LID) STANDARDS AND A GREEN STREETS POLICY The proposed ordinance will enable the City to establish LID standards and a Green Street Policy, in order to comply with the mandates and deadline (i.e., December 15, 2013) of the Municipal Separate Storm Sewer System Permit (MS4) issued by Los Angeles W ater Quality Control Board. Ultimately, the LID standards and Green Streets Policy will benefit the community by reducing impermeable surfaces for developments, improving water quality in the local aquifer, and enhancing landscape and streetscape within the City. The City Council is requested to have the second hearing and adopt the proposed code amendment, the Temple City LID Manual, and the Temple City Green Street Manual. Presentation: Community Development Director Recommendation: Waive further reading and adopt Ordinance No. 13-979, amending Article E (“Site Plan Review and Congestion Management”) of Chapter 1 (“Zoning Code”) of Title 9 (“Zoning Regulations”) of the Temple City Municipal Code to establish Low Impact Development (LID) standards and a Green Streets Policy. B. SECOND READING AND ADOPTION OF ORDINANCE NO. 13-980, AN AMENDMENT TO ARTICLE E (“SITE PLAN REVIEW AND CONGESTION MANAGEMENT”) OF CHAPTER 1 (“ZONING CODE”) OF TITLE 9 (“ZONING REGULATIONS”) OF THE TEMPLE CITY MUNICIPAL CODE TO CREATE A DISCRETIONARY SITE PLAN REVIEW PROCESS During the November 5th, City Council meeting, the City Council approved Ordinance No. 13-980 with modified Option 3 language. Option 3 would City Council Agenda November 19, 2013 Page 6 of 13 require a minor site plan review for all single-family residences and to post a notice on the site 10 days prior to approval. The first modification is that notices would be mailed to property owners within 100 feet rather than a notice being posted on site. The second modification was that single story residences (both new and additions) would be reviewed under a zoning clearance instead of a minor site plan review. The final modification was to remove any reference to historic preservation. The City Council is requested to have the second reading and adopt the proposed Ordinance as amended. Presentation: Community Development Director Recommendation: Waive further reading and adopt Ordinance No. 13-980, amending Article E (“Site Plan Review and Congestion Management”) of Chapter 1 (“Zoning Code”) of Title 9 (“Zoning Regulations”) of the Temple City Municipal Code to create a discretionary Site Plan Review process as amended by Council. 9. NEW BUSINESS A. FIRST READING AND INTRODUCTION OF ORDINANCE NO. 13-983 REPEALING AND REPLACING TITLE 3, CHAPTER 4, ARTICLE D OF THE TEMPLE CITY MUNICIPAL CODE RELATING TO PUBLIC TREES The City of Temple City currently owns and is responsible for maintenance of over 5,800 trees, valued at over $18 million, located in the public rights-of-way, parks, and parking lots. To protect this significant investment, a program was proposed in the Two Year Work Plan for the Parks and Recreation Department to build community awareness of the City’s urban forest. Elements of this Work Plan item included: 1) Identification of a tree advisory body that would make decisions and recommendations as appropriate on matters involving the care and maintenance of City-owned trees; and 2) Revision of the City’s Roadside Tree Ordinance. Ordinance No. 13-983 repeals the existing Roadside Trees Ordinance contained in Title 3, Chapter 4, Article D of the Temple City Municipal Code and replaces it with the proposed Tree Preservation and Protection Ordinance. The proposed Ordinance reflects current best practices relative to public trees and establishes policies, procedures, and expectations for City-owned trees located in public rights of way. Presentation: Parks and Recreation Director Recommendation: City Council Agenda November 19, 2013 Page 7 of 13 1) Introduce Ordinance No. 13-983 (Attachment “A”) for first reading by title only, repealing and replacing Title 3, Chapter 4, Article D of the Temple City Municipal Code (TCMC); 2) Waive further reading of Ordinance No. 13-983; and 3) Schedule the second reading of Ordinance No. 13-983 for December 3, 2013. B. FIRST READING AND INTRODUCTION OF ORDINANCE NO. 13-982 CORRECTING ORDINANCE SECTION NUMBERING ERRORS IN ORDINANCE NO. 13-975 PERTAINING TO HOOKAH/SMOKE LOUNGE LANGUAGE In October the City’s codifier contacted the City Clerk with questions regarding the section numbering within Ordinances No. 13-975 and 13-972. Both ordinances created a new Municipal Code Section 9454. The City Council is requested to adopt Ordinance No. 13-982 to correct the numbering errors in Ordinance No. 13-975. No other changes are proposed through the adoption of Ordinance No. 13-982. Presentation: Community Development Director Recommendation: 1) Introduce Ordinance No. 13-982, correcting code section numbering errors in Ordinance 13-975 by amending the section numbering as follows: change Section 9453 to 9452 and change Section 9454 to 9453; 2) Waive further reading of Ordinance No. 13-982; and 3) Schedule the second reading of Ordinance No. 13-982 for December 3, 2013. C. FIRST READING AND INTRODUCTION OF ORDINANCE NO. 13-985 REPEALING AND ADOPTING NEW CHAPTERS OF THE TEMPLE CITY MUNICIPAL CODE (TCMC) TITLE 7 (“BUILDING REGULATIONS”), CHAPTER 1 (“BUILDING CODE”), CHAPTER 2 (“MECHANICAL CODE”), CHAPTER 3 (“ELECTRICAL CODE”), CHAPTER 4 (“PLUMBING CODE”), CHAPTER 5 (“RESIDENTIAL CODE”) , CHAPTER 6 (“GREEN BUILDING STANDARDS CODE”), AND ADDING CHAPTER 7 (“SWIMMING POOL AND SPA CODE”) National Model Building, Mechanical, Electrical, Plumbing, Residential, Green Building Standards Codes are published periodically in response to improved City Council Agenda November 19, 2013 Page 8 of 13 safety standards and changing construction technology. The California Building Standards Commission adopts and amends each of these Codes every three years to create the California Building, Mechanical, Electrical, Plumbing, Residential, and Green Building Standards Codes. Pursuant to Health and Safety Code Section 18941.5, local jurisdictions are mandated to adopt such State Codes generally within 180 days after publication of the code by the California Building Standards Commission. The 2013 California Codes were published on July 1, 2013 and will become effective on January 1, 2014. To make the local amendments to the 2014 Los Angeles County Codes effective within the City of Temple City, the City Council must make a finding that the proposed Los Angeles County amendments to the State Code are based on climatic, topographic and/or geologic conditions local to the City of Temple City. Because the City of Temple City is located within the same seismic design category as most of the County of Los Angeles and has the same weather related issues, (chiefly high fire danger from late summer/early fall Santa Ana winds), staff believes that all of the climatic, topographic and geologic conditions identified by the County of Los Angeles are fully applicable to and appropriate for the City of Temple City. The City Council is requested to adopt Ordinance No. 13-985 adopting the Los Angeles County Codes by reference with local amendments to ensure that Temple City is meeting the most current building and safety standards. Presentation: Community Development Director Recommendation: 1) Introduce Ordinance No. 13-985 for first reading by title only repealing and adopting new chapters of the TCMC Title 7 (“Building Regulations”), Chapter 1 (“Building Code”), Chapter 2 (“Mechanical Code”), Chapter 3 (“Electrical Code”), Chapter 4 (“Plumbing Code”), Chapter 5 (“Residential Code”) , Chapter 6 (“Green Building Standards Code”), and adding Chapter 7 (“Swimming Pool and Spa Code”) thereby adopting by reference portions of the 2013 California Code of Regulations as amended by the County of Los Angeles as the 2014 County Codes (Title 26 - Building Code, Title 27 - Electrical Code, Title 28 - Plumbing Code, Title 29 - Mechanical Code, Title - 30 Residential Code, Title 31 - Green Building Standards) and adopting by reference the 2012 International Swimming Pool and Spa Code as the City of Temple City 2014 Building and Safety Code; and 2) Set a public hearing date for December 3, 2013, to consider adoption of Ordinance No. 13-985 establishing new Building Safety standards for the City of Temple City. D. PUBLIC HEARING: FIRST READING AND INTRODUCTION OF ORDINANCE NO. 13–984 AMENDING THE TEMPLE CITY MUNICIPAL City Council Agenda November 19, 2013 Page 9 of 13 CODE (TCMC), TITLE 8 (STORM WATER POLLUTANT ELIMINATION) CHAPTERS 1-4, TO ESTABLISH AND MAINTAIN ADEQUATE LEGAL AUTHORITY TO IMPLEMENT THE PROVISIONS OF THE NEW NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM (NPDES) STORM WATER PERMIT FOR MUNICIPAL SEPARATE STORM SEWER SYSTEMS (MS4) In December 2011, the City adopted provisions (Title 8 of the Temple City Municipal Code (Code)) to implement and enforce the 2001 MS4 permit. However, there are a number of new or modified provisions in the new permit. The new MS4 permit requires that changes be made to the definitions and provisions for conditionally exempt non-storm water discharges, as found in Title 8. Some of the required changes will be made in separate actions, such as the Green Street Policy and Low Impact Development (LID) standards. The Ordinance currently being considered by City Council will codify the additional changes that must be made in order for the City to establish and maintain the required legal authority and thus be in compliance with the new MS4 permit. Temple City is required under Section VI.A.2.b of the MS4 Permit to submit a statement certified by the City Attorney that the City has the legal authority within its jurisdiction to implement and enforce the requirements of the new MS4 permit. This certification must be submitted to the Regional Board along with the annual report, which is due December 15, 2013. The City Council is requested to adopt Ordinance No. 13-984, amending Chapters 1-4 of Title 8 of the Temple City Municipal Code (TCMC) to establish and maintain adequate legal authority to implement the provisions of the newly adopted MS4 NPDES Storm water Permit. Presentation: Public Safety and Services Manager Recommendation: 1) Conduct a public hearing and introduce Ordinance No. 13-984 (Attachment “A”) for first reading by title only, amending Chapters 1-4 of Title 8 of the Temple City Municipal Code (TCMC) to establish and maintain adequate legal authority to implement the provisions of the newly adopted National Pollutant Discharge Elimination System (NPDES) Storm water Permit for Municipal Separate Storm Sewer Systems (MS4); 2) Waive further reading of Ordinance No. 13-984; and 3) Schedule the second reading of Ordinance No. 13-984 for December 3, 2013. City Council Agenda November 19, 2013 Page 10 of 13 E. REQUEST FROM SING TAO NEWSPAPERS LOS ANGELES LTD. FOR THE CITY TO HOST AND CO-SPONSOR THE “2014 SING TAO CHINESE NEW YEAR FESTIVAL” Chinese New Year (also known as the Spring Festival) is an important traditional Chinese holiday. Markets or village fairs are frequently set up as part of the New Year festivities. These open-air markets feature New Year related products such as flowers, toys, and clothing. Sing Tao, was founded in Hong Kong in 1938. The Sing Tao Daily Newspaper is a leader among Chinese media in serving the Chinese community worldwide, and is the only Chinese newspaper that has over a dozen local editions in the Americas, Asia, Europe and Australia. The City received a formal proposal from Sing Tao requesting co-sponsorship of the “2014 Chinese New Year Festival” on Saturday, February 1, 2014 from 10:00 a.m. to 4:00 p.m. This will be Sing Tao’s fourth Chinese New Year’s Festival. Previous festivals have been co-sponsored by the City of Walnut for the past three years. Presentation: Public Safety and Services Manager Recommendation: 1) Receive a presentation from Sing Tao Newspapers Los Angeles LTD. (Sing Tao) regarding the proposed “2014 Chinese New Year Festival”; and 2) Consider hosting and co-sponsoring the “2014 Chinese New Year Festival” on Saturday, February 1, 2014 dependent on Sing Tao’s completion of the following conditions by December 2, 2013: a) Submission of a completed special event permit application (Attachment “A”) to the City’s Public Safety and Services Division; b) Completion of the event’s proposed public safety and traffic plan for approval by the City Engineer, the City’s Public Safety Supervisor, Los Angeles County Sherriff’s Department (LASD), Los Angeles County Fire Department (LACFD), and Los Angeles Metropolitan Transportation Authority (METRO); c) Payment of LASD and City fees necessary for staffing and logistical support of the event; d) Provision of at least 10 vendor booths to be allocated to Temple City businesses, non-profit organizations, and City Departments at no cost; and e) Finalization of an outreach strategy and entertainment line-up City Council Agenda November 19, 2013 Page 11 of 13 schedule that maximizes public awareness and participation, and is inclusionary to all segments of Temple City’s population. 10.
