SPECIAL MEETING ,The Board of Public Works and Safety of the City of Richmond, Indiana, met in SPECIAL SESSION in its office in the City Hall in said city, Tuesday, December 20th, 1955, at the hour of 1: 30 P.M. ( CST) . Mr. Coelman presiding with the following members being present: Mr. Deuker and Mr. Haworth. .The , following business was had, to- wit: - The presiding officer stated that this special meeting was called for the purpose of adopting a .resolution. between the Civil City and the School City. Mr, Haworth, City Attorney presented the following resolution and read in full. RESOLUTION .WHEREAS, the School City of Richmond, Indiana, is the owner of the following described real estate, to—witt., °Lots Nos. 30, 31, 32, 33, 34, 35 and 16 in C.W. Ferguson' s First Addition, being a sub—division of Block .A of an Addition to the City of Richmond, Indiana, as laid out by S. C. Mendenhall end C.H. Coffin" , "and known as the Old Garfield School property", and WHEREAS, the School City is desirous of selling said_ real estate and ha.s ,heretofore advertised .same for sale and. requested bids on same, and • WHEREAS, the City of Richmond is desirous of purchasing said real estate to be used for off street parking, .and WHEREAS, the Common Council of R.ichmon did on the 19th day of December, 1955 authorize the City of Richmond, acting by and through its Board of Public Works and Safety to pro- ceed to purchase .said realestate from the School City at and for the sum of 50,000. 00, and to bid therefor the sum of $50, 000. 00, and if said bid is. accepted and the School City -sells said real estate to the City, then and in that event said City is to pay for said real estate by canceling and relieving the School City from paying the balance due on rental contract, heretofore entered into by Uity and School City on 3rd day of April, 1939, in the sum of $4.9, 830.00 and pat .ng in addition thereto to the School City the sum of $170. 00 in cash, and WHEREAS, said Council further appropriated, the sum of $49, 830.00 out of the proceeds from .said rental contract,- and $170,00 out of the Parking Meter Fund designated to be used for purchase of real estate for "off street" parking, and the Board of Public Works and Safety was authorized to 11 purchase said real estate on said terms, and WHEREAS, said Council further ordained that in the event said School City sells to the City said real estate as afore— said then said renta :scontract is hereby canceled and the School City is not required to pay said balance of $4.9, 830. 00 all without any further action by Council, and 166 WHEREAS, the City of Richmond and School City of Richmond did on the 3rd day of April, 1939, enter into a contract by which the City of Richmond rented to the School City the Civic Auditrium for an annual rental of 46,644.00, same payable one-half on August 1st and the other half on the following February 1st of each year up to the expiration of said contract which expires on the 31st day of July, 1964, and WHEREAS, the School City has appropriated . the sum of $6, 644. oO for the 1956 rental and intends to pay the same to the City, and - WHEREAS, there will be a balance due for the unexpired term from and after the first day of Jahuaryy 1957 up to the 31st day of July, 1964 in the sum of $49, 830._00, and - WHEREAS, THE City is desirous of submitting a bid to said School City for said real estate in the sum of '$p50,000r00, and nay therefor the sum of $170.00 in cash and cancel said rental contract to become effective on the ldt day of Jan- uary, 1957, said rental contract being the contract re- ferred to heretofore in this resolution. NOW, THEREFORE BE IT RESOLVED, that the City of Richmond by and through 3bts Board of Public Works and Safety, sub- mit a bid to the School City in the sum of y$50, 000.00, to be paid for on the following terms and conditions: 1. That if said School City accepts said bid of $50, 000. 00 for said real estate it shall be accepted on condition that the City be not required to pay said sum of $50, 000.00 in cash, but in .lieu thereof the City •is to cancel said rental agreement and relieve said School City from the payment of the balance due in the sum of $49, 830. 00 and in addition City is to ray School City the sum of. ";$170. 00 in cash, which sum of $49,830.00 and $170. 00 makes the total of $50, 000.00, the consideration to be paid for said real estate. 2. If said School City accepts said bid and said conditions and sells said real estate to the City then the City is to cancel said rental contract to become effective on lot day of January, 1957 and relieve School City from paying said - balance of said contract in the sum of <$49,830. 00, and in addition pay School City 1170.00 in cash. 3. In said event School City sells said real estate to City as aforesaid then said rental contract is hereby can- celed and School City is not required to ray said balance of said contract in the sum of $49, 830.00, all without any further action by said Board of Public Works abd Safety. BE IT FURTHER RESOLVED that the City Clerk transmit a copy of this resolution to the School City of Richmond and this Resolution is to considered as a bid for said real estate. • Mr. Haworth moved that the above resolution be adopted, seconded. by Mr. Deuker and on voice vote the motion was unanimously carried and so ordered.
