RECOMMENDATION:
The City Council is requested to adopt Resolution No. 13-4892 ordering the preparation
of the Lighting and Maintenance Assessment District annual engineer's report for FY
2013-14.
BACKGROUND:
1. On June 19, 1979, the City Council adopted Resolution No. 79-1825 creating the
Citywide Lighting Assessment District pursuant to the State of California Lighting
and Landscape Act of 1972.
2. On May 7, 1991, the City Council adopted Resolution No. 91-3048 amending the
existing Citywide Lighting Assessment District to include a maintenance zone,
thereby creating the Temple City Lighting and Maintenance District for the purpose
of funding other eligible programs, including traffic signal and tree maintenance
services.
3. On November 5, 1996, California voters approved Proposition 218, also known as
"The Right to Vote on Taxes Act", which prohibits the levy of any new
assessments or increase in existing assessment rates without property owner
approval. The local agency must distinguish between general and direct benefit
and shall only assess for direct benefit. At that time parks were considered to be a
general benefit.
4. On July 1, 1997, the City discontinued assessments for park maintenance
operations. The park maintenance program is currently funded through the
general fund.

5. On March 16, 1999, the City Council adopted Resolution No. 99-3737 extending
the duration of the Lighting District for an additional 20 years through 2019.
6. On March 15, 2011, the City Council considered a proposal from Harris &
Associates to provide the required engineering services for the ensuing three
years. The City Council agreed to retain the services of Harris & Associates to
prepare the engineer's report for the Lighting and Maintenance Assessment
District for one year and directed staff to solicit bids for this service in 2012.
7. On March 6, 2012, the City Council approved a Consultant Services Agreement
with Harris & Associates to complete the engineer's report for the Lighting and
Maintenance Assessment District in addition to conducting a study of the
anticipated maintenance costs and any available strategies to fund the expenses
of the lighting and landscape improvements associated with the Rosemead
Boulevard Safety and Beautification Enhancement Project.
8. On February 14, 2013, the City issued a Request for Qualifications (RFQ) for
Lighting and Landscape District Assessment services.
9. On March 1, 2013, the City received two Statements of Qualifications from David
Taussig & Associates, Inc. and Harris & Associates.
ANALYSIS:
Pursuant to the 1972 State Lighting and Landscape Act, an engineer's report must be
prepared for each fiscal year in which assessments are levied and collected for the
City's Lighting and Maintenance District ("District"). The engineer's report identifies
eligible program expenditures, establishes the District's operating budget, updates
individual property assessments, and documents the City's compliance with all
applicable laws.
In previous years, the City has utilized Harris & Associates to complete this engineer's
report and provide other similar assessment services. However, staff is aware of the
City Council's desire to solicit for proposals of qualifications for these services on an
annual basis to ensure competitive pricing and quality services. Since it was
anticipated the scope of services would be less than $25,000, staff conducted an
informal Request for Qualifications process in accordance with the Purchasing
Ordinance.
Two proposals were received and staff thoroughly reviewed the Statement of
Qualifications from Taussig & Associates and Harris & Associates and determined both
were qualified to complete the project. Each consultant was then asked to provide a
cost for completion of the project:

• David Taussig & Associates, Inc. - $ 15,000
• Harris and Associates - $ 8,500
As a result of their competitive cost to complete the project and the quality of work
provided by Harris and Associates in the past, staff will negotiate and execute a
professional services agreement for the scope of work to be performed.
Staff has prepared the appropriate resolution ordering the engineer's report for City
Council's review and adoption.
CONCLUSION:
The City Council is requested to adopt Resolution No. 13-4892 ordering the required
engineer's report for the City's Lighting and Maintenance District for FY 2013-14.
FISCAL IMPACT:
The City Council, as part of the FY 2012-13 City Budget, approved an appropriation of
$9,000 for the engineering work and related report.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE
CITY ORDERING THE ENGINEER'S REPORT REQUIRED TO LEVY
THE LIGHTING AND MAINTENANCE DISTRICT ANNUAL
ASSESSMENTS FOR FISCAL YEAR 2013/2014
WHEREAS, on June 19, 1979, the City Council of the City of Temple City adopted Resolution No.
79-1825 creating the Citywide Lighting Assessment District, pursuant to the State of California Lighting and
Landscape Act of 1972, as contained in Division 15 of the Streets and Highways Code of the State of
California; and
WHEREAS, the City Council, on May 7, 1991, adopted Resolution No. 91-3048 amending the
existing Citywide Lighting Assessment District to include a maintenance zone, thereby creating the Temple
City Lighting and Maintenance District for the purpose of funding other eligible programs, including traffic
signal and tree maintenance services; and

duration of the Camellia Lighting District for an additional 20 years through 2019, per §18062 of the Streets
and Highways Code of the State of California; and
WHEREAS, the Lighting and Landscape Act of 1972 requires the preparation of an engineer's
report to determine and adjust annual assessment rates for the Lighting and Maintenance District.
NOW THEREFORE, the City Council of the City of Temple City does hereby resolve as follows:
SECTION 1. The engineering firm of Harris & Associates is hereby ordered to prepare and
appropriately file the engineer's report required to determine and adjust the City of Temple City Lighting and
Maintenance District assessments for fiscal year 2013/2014 in accordance with Article 4 of the Lighting and
Landscape Act of 1972.
SECTION 2. The engineer's report shall reflect provisions and related assessment rate adjustment
in compliance with Proposition 218, also referred to as "The Right to Vote on Taxes Act," as approved by
the voters of the State of California on November 5, 1996.
SECTION 3. The report shall be titled: "Engineer's Report for the City of Temple City Lighting and
Maintenance District Fiscal Year 2013/2014 Assessments."
SECTION 4. The City Clerk shall certify to the adoption of this Resolution.

Dear Ms. Hause:
The City of Temple City relays on revenues from its current assessment district to provide a dedicated source of funding
which the City relies upon to use for the maintenance and operation of its street lights, traffic signals, and landscaping
improvements used by City residents. As outlined in our proposal, our team will work closely with City staff, and our
team is committed to providing the services required for the successful placement of the assessments on the tax roll for
collection.
As partners with the City, our team offers the following advantages:
Expert Project Manager. Our project manager, Dennis Mingelhofer has over 25 years of assessment engineering
experience. He has a unique understanding of the annual proceedings required for the placement of assessments on
the County tax roll and thoroughly understands the provisions and implications of Proposition 218. I Ie has served
as the assessment engineer for the formation and annual administration for over 100 assessment districts throughout
the state. He is often asked to provide peer review of assessment methodologies, including review of assessments for
compliance with Proposition 218. He recently authored a white paper discussing the impacts of a number of recent
court decisions on assessments districts ( a copy is include at the end of our proposal).
Skilled Project Team. Each of Harris' Southern California team members are located in the fan's Irvine office and
have extensive financial engineering experience including annual administration processes, assessment analyses, and
formations. We are experts in database research and development, as well as efficient ballot mailing and tabulation
processes. Additionally, our team successfully levied more than $56 million in assessments, fees, and taxes on more
than 1.0 million parcels for FY 2012-13. This experience will reduce the time required of City staff. This experience is
reflected in the comments from the Orange County Auditor Controller's office included in our proposal.
I am authorized to sign our contract and we acknowledge receipt of the RPP and all addenda. Our proposal is valid for a
60 -day period from the due date of the proposal, March 1, 2013.

APPROACH
Description of Proposed Services
Our approach to providing Assessment Engineering
services for the annual administration of the City's
maintenance assessment collected on the County property
tax roll will emphasize close and continuous coordination
with the City's project team during each phase of the
project. Harris & Associates believes that providing district
administration services involves more than providing the
data processing services needed in the preparation of the
levy rolls. It includes:
■ Identifying issues that may impact the City's annual
schedule for the administration of assessments and
fixed charges;
■ Working with City staff to identify future financial
revenue requirements and developing strategies that
will minimize impacts on property owners;
■ Serving as an expert in the changing statutory and
legal requirements regarding the placement of fixed
levies on the property tax roll for collection; and
In Providing the information needed by City staff to
develop accurate revenue.. forecasts in a timely manner
as part of the City's budget approval process.
■ Providing accurate and timely assessment database
for the City's assessment districts, incorporating Los
Angeles Comity Assessor's Information based on
over 20 years of experience in district administration
services.
SCOPE OF SERVICES
Harris will provide all of the services required for the
administration of the City's assessment district and the
placement of the assessment on the property tax roll
for collection. This will include an independent review
of the assessment methodology for compliance with
the requirements of Proposition 218 and the impact of
several recent court rulings regarding benefit assessments
(see white authored by our Project Team included at the
end of our proposal). In addition, we will conduct an
audit of the parcels included in the assessment district to
ensure that he district is collecting the maximum revenue

possible. The following summarizes the specific tasks to
be completed for the preparation of the annual Engineer's
Reports and preparation of the tax roll for inclusion on
the. County Property Tax roll for collections.
Kick -Off Meeting & Project Schedule
Kick -Off Meeting — Meet with City staff to review
expectations of the project, and develop action plan for
the administration of the district.
Project Schedule — Prepare detailed project schedule
which identifies all deliverables and meeting dates based
upon statutory requirements and City time lines for
preparation of City Council agenda packets.
Progress Meetings — Our Project Manager will meet
with City staff to review schedules and provide staff
with a clear understanding of project status on a regular
basis. Meetings will be scheduled as required to provide
for effective interaction with City staff or stakeholders as
required based upon the goals for the project.
Resolution of Key Issues — Our Project Manager
will bring to the attention of the City key issues that
may impact the project schedule. We will provide the
City with recommended strategies for resolving these
issues consistent with statutory requirements, including
Proposition 218, and the need to keep the project on
schedule.
Prepare Preliminary Parcel Data
Create parcel database based upon prior year's County
Assessor data which includes all data necessary for the
calculation of assessments or fees at the parcel level.
Conduct an audit of prior year's assessment rolls to
identify any parcels that were not included in last year's
rolls, or where data used for the calculation of assessments
did not match the County Assessor or City's data. Research
and resolve all discrepancies and review with City staff.
Prepare preliminary parcel database based upon most
current County data; also obtain data from City regarding
recently issued building permits or development approvals
that may impact parcel data fox the coming year.

Provide City with estimates of parcel changes and impacts
on revenues based upon prior year's assessment rates for
each district.
Update assessment diagram and maps as needed for
administration of the City.
Identify Changes From Prior Year
Obtain final parcel data from County and update parcel
database for the City to reflect all changes from the prior
year, including land -use, property ownership, mailing
address, benefit units, and other parcel attributes that may
impact the levy of assessments or fees.
Confirm changes in the County Assessor data.
Meet with City staff to review any outstanding issues.
Review of Staff Prepared Budget
Expenditures
Review of preliminary budget expenditures for
conformance with eligible district expenditures, that
budget format is consistent with adopted assessment
methodology, and that costs ate segregated by benefit zone
if requited.
Provide estimates of annual administrative costs, including
County fees that should be included in budgets for the
district.
Assist City Staff in Preparing Budget
Revenue Estimates
Provide City staff with budget model (in Microsoft Excel),
based upon preliminary parcel database, which can be used
by City staff to estimate projected revenues. The model
will allow staff to evaluate changes in projected revenues
based upon entered assessment rates, fund balances, and
contributions from other funding sources.
Model will allow City staff to forecast projected revenues
in future years by entering anticipated in land uses and
parcels.

Establish Project Schedule
Prepare project schedule after meeting with City staff,
showing key datesfor all project task
Coordinate schedule with City's annual budget review and
approval process as needed.
Identify any Proposition 218 proceedings that may be
required to include required 45 day noticing requirement in
project schedule.
All dates shall take into consideration the review and
approval time needed for preparation of City Council
agendas and publication of any required legal notices.
Prepare Annual Engineer's Reports
At the start of the annual administration process, review
prior year's reports and provide list of recommended
changes to the City which would improve the "usability"
and "readability" of the reports to clearly communicate
information to property owners and City staff. Discuss
recommended format changes with City staff.
Prepare Annual Engineer's Reports, in. required format,
for each district. All reports shall be submitted to the
City for approval in advance of required dates so that any
requested changes can be made prior to the City Council
agenda deadlines.
Once approved, provide City with an executed copy of
each report in electronic format and bard copy, including
assessment/levy rolls.
Attend Public Hearing
Project Manager or Assessment Engineer will attend the
Public Hearing to answer questions related to the annual
administration process if requested by the City.
Submittal of Annual Tax Roll Levy
Confirm Direct Levy Numbers (or obtain new Direct
Levy Numbers for new districts) with the County Auditor -
Controller.
Prior to approval of the annual levies, prepare the County
Auditor -Controller Signature Agreement showing the
estimated revenue and parcel count for each Direct Levy
Number.

Following approval of annual levies, prepare the County
Auditor -Controller Direct Levy Data Submission Form for
execution by the City. Submit preliminary levy rolls to the
County with requited Resolutions confirming assessments
as approved by the City Council.
Research all rejected parcels, review with City staff as
requited, and resubmit to County prior to County deadline
for current year's tax roll.
Coordinate with the County for the levy of assessments/
fixed charges on publicly owned parcels, provide list of all
assessments on publicly owned parcels to City staff.
Provide City with a copy of final files as accepted by the
County for each district/ fixed parcel levy in a. standard file
format (MS Fxcel or Access).
Provide Property Owner Support
Provide. "800" toll free number to County for property
owner to call regarding questions assessments/fixed
charges included on their property tax bills.
All property owner inquires will be documented, including
any actions taken. Project Manager will coordinate with
City staff, and will provide recommendations. to City on
resolution of property owner concerns.
Provide periodic reports of all calls received and actions
taken.
Provide Final Report
Provide a summary report showing the total charges levied
by the County.
Provide summary for any charges levied on publicly owned
or SBE parcels that are not included on County property
tax roll.
We do not anticipate any additional fees for providing the
services shown in our Scope of Work. Additional services
can be provided upon written request if desired by the
City

PROJECT EXPERIENCE
The Harris team has extensive experience in implementing
and administrating assessment and special financing
districts both before and after the passage of Proposition
218. Over the past five years, the Harris team has served as
assessment engineer for more than 500 annual assessment
proceedings while working with more than 100 public
agencies throughout California. We are proud of out
reputation, and the following are a few examples of
relevant projects performed by our project team members.

assignment are currently working with the agencies listed
below, and were responsible for the levy of assessments or
special taxes on over 1 million parcels for FY 2012/13 for

Landscape and Lighting Assessment District
Harris is currently administering the City's Landscape
and Lighting District which has three benefit zones and
includes approximately 1,600 parcels. As part of our
assignment, Harris is currently reviewing the fund balances
for each zone, and completing a replacement reserve study
for the district to identify future fiscal needs versus the
current revenue stream to assist the City in developing a
long range financial plan for the district.

I Iarris began assisting the City with the administration
of Lighting and Landscaping Maintenance District No.
1 (comprised of three zones with 49,000, 50,000 and
14,000 parcels respectively) and the Buena Vista Chamiel
Maintenance District (27 parcels) for the FY 2003-04 levy
process. In 2004, because the existing Maintenance District
No. 1 did not generate enough revenue to wholly fund the
City's maintenance expenditures, Harris assisted the City
with the establishment of a new Landscaping and Lighting
Maintenance Assessment District for areas of new
development. Harris continues to administer these districts
annually for the City of Carlsbad.

Harris has been providing annual district administration
services for the City of Ontario's Street Lighting and
Parkway Maintenance Assessment Districts since
FY 2000/01. This has included development of the

experience of our team members and our "independent
review" of the District's current assessment methodology
in response to recent court decisions will reduce the

Key Personnel
In Fiscal Year 2012-13, this. team successfully placed over
$56.6 million in assessments,. fees and taxes on more than
1 million parcels on county property tax bills all over
California.
Since November 1996, when Proposition 218 was enacted,
this project team has been involved in the formation of
104 operation and maintenance assessment districts and
has been involved in the formation of a total of 134
maintenance assessment districts both before and after
Proposition 21.8.
Table 1 above provides a summary of Harris' total
experience for assessment and fee districts, including over

Assessment Engineer
K. Dennis Klingelhofer, PE, will be the assessment
engineer for the project and is responsiblefor the
firm's financial engineering services. He is a registered
professional civil engineer in California. He has more
than 25 years of assessment and financial engineering
experience consulting to cities, counties, and special
districts throughout California. He has served as the
Assessment Engineer for more than 100 agencies. Tlais has
included the development of the assessment methodology
in compliance with the requirements of Proposition
218, as well as managing the annual administration and
levy processes. Additionally, Dennis isconsidered to be
an expert in assessment engineering and Proposition
218 processes and has been invited to speak before the
California League of Cities, local chapters of the American
Public Works Association, and the California Society of
Municipal Fmance Officers.
Dennis has developed a reputation for providing complete
and thorough reports, and meeting project deadlines and
legally required line frames.
Database Manager
Caroli. Hill will assist with the details of the district
administration processes. She has more than 10 years
of experience in the area of assessment and financial
engineering.
Carol is proficient at compiling district databases,
researching and analyzing the different parcel attributes,
confirming database accuracy, notice and ballot production
and tabulation, and the annual levying of the assessment,
fees and taxes on county property tax bills throughout
California. Her computer and system network skills have

been applied to resolve many technical data challenges
associated with coordinating project implementation and

Staff Availability
Harris' Public Finance Group understands the legal time
lines associated with the placement of assessments and
other "fixed charges" on the County Tax Rolls. We have
adequate resources to respond as necessary and will project
staff availability.
We will submit a detailed schedule for the performance of
this work. We also have the depth of resources needed to
adjust to unanticipated changes, such as a change to the
budget or a rescheduled Board meeting date.

Scope of Services for the annual administration of the
City's assessment district for the following fee:

Report. Dennis served as principal -in -charge for the review
of the County's Landscape and Lighting Assessment
District No. 1979-3 (LL 2). The district consisted of
approximately 29,000 parcels and 60 benefit zones. As a
result of a review of the parcel database for the District,
the County was able to collect an additional $$200,000
in revenue with no increase in assessments. Dennis also
oversaw the annual administration of the district for
several years including the preparation of the Annual
Engineer's Report and preparation of the assessment roll.
Contra Costa County Mosquito and Vector Control
District, Assessment District Formation andAnnual
Administration. Dennis served as project manager for
the development of a benefit methodology and the
preparation of the Engineer's report for the formation of

a benefit assessment district in June 1996 which included
over 250,000 parcels. The assessment methodology
developed for the District has been used as a model by
other Districts for the adoption of similar assessments/
fees. Dennis continued to serve as the District's
Assessment Engineer for the preparation of the annual
Engineer's Report and the development of the parcel
database used to prepare the annual collection report so
that assessments and fees could be collected on tax rolls
through 2010.
East Bay Municipal Utility District, RockridgeArea
Pipeline Improvement Project. Dennis served as assessment
engineer for the East Bay Municipal Utility District and
the City of Oakland for the formation of an assessment
district under the Municipal Improvement Act of 1913
for the Rockridge Area Pipeline Improvement Project
in Oakland. The total project cost was approximately
$3 million. Services included the preparation of the
Engineer's Report and the preparation and mailing of
assessment ballots and notices
City of Hayward, Twin Bridges (Tiact7015)Assessment
District. Dennis served as principal -in -charge for the
formation of the Twin Bridges Assessment District.
The assessment district was formed to provide bonded
financing for the construction of a neighborhood park
within Tract 7015. The services included preparation of
the Engineer's Report, noticing/balloting and attendance
at the City Council Meetings.
Hayward Area Recreation and Park District, Park
Maintenance District No. 96-1. Dennis served as the
assessment engineer for the Hayward Area Recreation and
Park District's formation of a district -wide assessment
district. The Assessment District was formed under
the Landscaping and Lighting Act of 1972 to fund
improvements which include the construction, operation,
maintenance and servicing of parks, recreation facilities,
and landscaping necessary for the operation of the
District's facilities. The area of assessment included
approximately 68,000 in the City of Hayward and portions
of the unincorporated areas of Alameda County. Services
included the development of the assessment

Livermore Area Recreation and Park District,
Distridwide Landscape Maintenance District. Assessment
Engineer. Services included the analysis of areas of
benefit and development of assessment methodologies,
compiling annual cost estimates, preparation of the
Engineer's Report, and presentations at Board workshops
and property owner meetings. There were approximately
26,000 parcels within the assessment district.
City of Petaluma, Lakeville HigbivayAssessmentDistrict.
Dennis served as project manager and assessment engineer
for the formation of the Lakeville Highway Assessment
District under the Municipal Improvement Act of 1913.
The assessment district provided funding for the widening
of Lakeville Highway from 2 to 4lanes with an estimated
construction cost of $10,000,000. The District included
approximately 130 commercial and industrial parcels.
Services included community meetings with property
owners, benefit analysis and preparation of the Engineer's
Report and preparation and mailing of the assessment
ballots.
County of Sacramento, Sacramento Open Space District
Feasibility Study. Project Manager. This study looked at
the feasibility of forming an assessment district for the
Sacramento Open Space Authority (SOSA). The study
included developing a comprehensive parcel database for
use throughout the project; assisting SOSA in identifying
potential projects to be funded and in developing project
evaluation criteria; developing and evaluating alternative
assessment methodologiesfor district formation;
identifying methodologies for the allocation of funding,
working with SOSA and local agencies; assisting SOSA
in evaluating strategies for the "tiering" of assessments;
preparing the Preliminary Engineer's Report based upon
requirements of the Landscape and Lighting Act of 1972.

City of San Diego, Carmel Valley Neighborhood 10
Cost Reimbursement District Formation and Cost Verification.
Assessment Engineer. This project funded over $20
million in developer infrastructure improvements.
Activities included researching and assembling pertinent
land use information, identifying public improvement
eligible construction costs, developing a method of
apportionment, and preparing a plat showing the proposed
boundaries of the CRD. The documents reviewed were the
city ordinance, the cost reimbursement agreement, Public
Facilities Financing Plan and Facilities Benefit Assessment
for the region and resolutions.
San Joaquin Area Flood Control Agency, Flood Proterian
Restoration Assessment District No. 96-1. Assessment
Engineer. This project included the development of an
assessment methodology which took into consideration
the development status of a parcel and recommended an
implementation of a Flood Control Facilities Equalization
Fee program which allowed a lower assessment to be
levied upon undeveloped parcels initially but required
them to pay a fee at the time of development such that
they pay their "fait share" of the project's costs. This
innovative strategy was instrumental in gaining property
owner support for the creation of the assessment district
which included approximately 74,000 parcels and provided
almost $70 million in funding for the upgrading of flood
control facilities.
County of Santa Clara Vector Control District,
Assessment District Formation. Dennis served as served
as project manager and Assessment Engineer for the
establishment of a countywide assessment district under
the Health and Safety Code and in compliance with
Proposition 218. Services included performing the benefit
analyses and preparing the Engineer's Report. Following
the formation of the assessment district, the annual
assessments were submitted to the County for inclusion on
the property tax bills.

Lake Elsinore/San Jacinto Watersheds Authority
(LESJWA), Storrs Water Utility FeeAnalyszr. Carol saved
as project analyst for the preparation of a Preliminary
Rate Analysis for a Drainage Basin Utility Fee for funding
operation and maintenance activities designed to clean
up and maintain the water quality in Lake Elsinore, which
is fed by the San Jacinto River. She was responsible for
analyzing the Riverside County Flood Control and Water
Conservation District's parcel -based GIS data files, and
providing research and data summaries for the feasibility
analysis. There were over 165,000 parcels of land within
the study area.
City of Los Altos, Server Services Fee. Carol serves as
deputy project manager for this project, and her duties
have included assisting with the review of the previous rate
structure and analyzing the water consumption data for the
sewer accounts in the City and assisting with the proposed
rate structure analysis. In July 2008, the City completed the
218aequired Protest Hearing and increased the fates. Carol
also assisted with preparing and mailing the notice of
public hearing on the sewer fee modification and increase.

preparation of the mailed Public Hearing Notice material,
managed the production and mailing of the ballots to the
56,000 property owners, managed the production and
mailing of the Notice to the 75,000 owners of property
in and around the City of Modesto affected by the water
and sewer rate increases, and assisted the City Clerk with
tabulation of the protests and ballots received before
and during the Public Hearings. Harris is currently under
contract with the City to assist with their 2010 Water
Utility Fee increase.
