The Board of Public Works and Safety of the City of Richmond, Indiana, met in regular session in its office in the City Hall in said City, _ Friday, February 11, 1955, .at the hour of 8:00 o 'clock A.M. ( CST) . Mr Coleman presiding with the following members being .present: Mr. Hodgin and Mr. Chambers. The following business was had, to-wit : On motion duly made, seconded and carried, the minutes of the previous meeting were dispensed with. Mr. Hubert Jacobs, Permit Inspector of the State Highway Commission of the State of Indiana, met with the Board and discussed the erection of a sign at the Huron Hotel located at North 9th and "E" Streets. Mr. Jacobs stated that the sign as it was now being erected was in conflict with the State code and asked that the Board of Works co-operate with him in having this sign removed to another location on the hotel. The Board authorized the Clerk to write a letter to the Ad-O-Lite Neon Service Company asking them to conform with the State code on the State Highways in the State of Indiana. The Board unanimously accepted the following contract between the City of Richmond, Indiana •and the Chesapeake and Ohio Railway Company, CONTRACT This agreement, by and between the City of Richmond, Indiana, hereinafter called the City, and The Chesapeake and Ohio Railway Company, hereinafter called. the Railway Company, witnesseth that: Whereas, the railroad of the Railway Company is • carried over Main Street •in said City on a bridge con- structed by the Railway Company or its predecessor in title, and the City desired to install thereon two traffic signs of the design, at the locations, and in the manner specified in Drawing No. 23941-1, a blue print of which is hereto attached and made a part hereof, and the Rail- way Company is willing that said signs be so installed. Now, Therefore, it is agreed that the City may so install said signs on said bridge and maintain the same provided that the same be done at the sole risk and ex- pense of the City; and thst it indemnify and hold harmless the Railway Company from all loss, damage, cost, or liability by reason thereof and remove the same upon sixty days' written notice from the Railway Company to the City. Executed in duplicate by the City, by order of the Board of Public Works, and by the Railway Company by its duly authorized officer this llth day of February, 1955. Reeg City Clerk THE CHESAPEAKE AND OHIO RAILWAY COMPANY By Its On motion duly made, seconded and carried, the Board unanimously adopted the following Resolution: 85 RESOLUTION WHEREAS : The City of Richmond, Indiana, has two (2) main highways (U. S. #35 and U. S. #4O) running along and upon Main Street which is traveled upon both by out of state motorists and local motorists : and WHEREAS: The State Highway Commission of the State of Indiana has installed a "stop and go" traffic signal at the intersection of West Main Street and West First Street (U.S. #35 and U. S. #40) to control traffic that flows in an east- west and north-south direction, and permitting "left turns" at time regulated intervals : and WHEREAS : The City of Richmond, Indiana, with the authority of the State Highway Commission painted signs and lanes upon said highways #35 and #40 to direct the flow of traffic in a westerly direction, advising what lanes to use for "left turns" and "straight ahead" movement, which signs are obliberated in a short period of time: and WHEREAS: The Board of Public Works and Safety of the City of Richmond, Indiana has caused an investigation to be made for most permanent means of maintaining signs of this nature. This investigation produced a means of a permanent nature by the erection of signs on the Chesapeake and Ohio Railway bridge that spans over Main Street: and WHEREAS: The Chesapeake and Ohio Railway was advised of the investigation and after a thorough study by said Chesa- peake and Ohio Railway Company an Agreement was prepared by said Railway Company and presented to the Board of Public Works and Safety of Richmond, Indana for proper execution : NOW THEREFORE, be it resolved by the Board of Public Works and Safety, that the contract between the Chesapeake and Ohio Railway Company and the City of Richmond, Indiana, to install two ( 2) traffic signs of the design, at the locations and in a manner specified in Drawing No. 23941-1, as executed by said Board of Public Works and Safety on the date of February 11, 1955. On motion duly made, seconded and carried, the Board unanimously entered into an agreement with the State Highway Commission of Indiana and the City of Richmond, Indiana. AGREE MEN T THIS AGREEMENT MADE AND ENTERED INTO by and between the STATE OF INDIANA, through the State Highway Department of Indiana, and the City of Richmond, through its duly authorized and undersigned officals hereinafter referred to as the "City" witnesseth: WHEREAS, the City has requested that signal equipment be installed for the purpose of regulating traffic at the intersection of Southwest 1st Street and U. S. 40 (National Road) within said City, and WHEREAS, the State Highway Department deems the regulation of traffic by means of signal devices., as hereinafter designated, to be beneficial to traffic : at said intersection to the extent of the cost of the materials and equipment. IT IS THEREFORE AGREED BY AND BETWEEN the State, through said Department, and said City, that such traffic facilities shall be installed under terms and conditions as follows : (1) The City, with its own forces or by contract in consideration of the benefits to traffic using said inter- section, shall perform all work of installation of such faci- lities and the State, through said Department, hereby grants 86 said City permission to enter upon said intersection for the performance of such work, (2) That the work of installation to be performed by the City shall be performed in accordance with the rules and regulations of the Department, and said work shall be per- formed under the supervision of and to the satisfaction of the Department. ( 3) The major electrical signal materials and equipment required in said traffic signal installation shall be furnished and paid for by the State Highway Department. (4) On and after the completion of the work of installa- tion, the signal devices so installed shall be the property of, and subject to the control of the State, through said Department, under rules and regulations of the Department and laws of the State now inforce or hereinafter enacted, and the maintenance of such equipment and signal facilities shall be at the expense of the State, through said Department. (5) The electric energy required to operate the signal facilities shall be furnished or paid for by the City. (6 ) The City shall begin installing the traffic signal equipment not later than sixty ( 60) days after receiving the plans and specifications from the Department for said signal installations.
