NOW, THEREFORE, BE IT RESOLVED by the Mayor and the Council of the Borough of Carteret, County of Middlesex, State of New Jersey, as follows: 1. The proposal from T &M Associates for engineering services with regard to the Industrial Road Box Drainage Improvements Noe Street Drainage Project Design and Construction Phase services at a total cost not to exceed $50,000.00 is hereby approved. 2. This action is approved as an award of a professional services contract pursuant to N.J.S.A 40A:11- 5(1)(a) in accordance with the Borough's Fair and Open Process as authorized by law. 3. OUR MISSION, Re: Industrial Road Box Culvert Drainage Improvements Noe Street Drainage Project Dear Mayor Reiman: March 6, 2017 As I previously reported, in accordance with the attached draft agreement, Praxair, Inc (Praxair) has agreed to compensate the Borough of Carteret for 100% of the costs ($350,000) for the relocation & modification and redesign of the 72" RCP Drainage Line, associated manhole structures, and the new Stormwater Outfall Tide Chamber at Noe's Creek to be constructed along Industrial Road as part of the Noe Street Drainage Project. The reason for the requested relocation is that an existing 8" diameter Praxair high pressure nitrogen pipeline which runs along Industrial Road between Harris Street and Noe's Creek conflicts with the proposed 72" RCP drainage force main which runs along the west side of the road and Praxair prefers to keep their line in service rather than take It out of service and embark on a lengthy and costly relocation. Per the agreement, Praxair will fully compensate the Borough for construction costs and soft costs needed to change two segments of the 72" RCP force main to 3 ft by 10 ft box culvert sections at the points of conflict. Construction Costs Enclosed is a draft Change Order No. 2 for the referenced construction contract between the Borough and Lucas Construction Group (LCG) for a contract increase of $300,000. We have reviewed the proposed costs for the required work provided by LCG and after cost negotiations, we recommend the Borough approve same. This change order will also require approval of the NJDEP as it will be a formal modification to the NJEIT Funded Noe Street Project. The NJDEP approval is largely administrative as the increased contract costs will be ineligible for NJEIT reimbursement and they are also being covered 100% by Praxair. Design and Construction Phase Engineering Costs The necessary drainage force main changes from 72" RCP to 3 ft by 10 ft Box Culvert sections at two critical locations due to the nitrogen pipeline conflicts will require redesign of force main along Industrial Road including design of the box culverts, three new special concrete manhole structures necessary to T &M ASSOCIATES, 1455 Broad Street, Suite 250. Reiman Borough of Carteret Be: Industrial Road Box Culvert Drainage Improvements Professional Engineering Services Noe Street Drainage Project transition from the 72" RCP to the box culvert sections, and design modifications to the Outfall Tide Chamber at Noe's Creek. Revised construction plans, construction details for the box culvert and the special transition structures, including structural design elements, and tide chamber modifications required for the drainage system changes have been completed to advance the overall Noe Street Drainage Project. Revised construction costs estimates have been prepared for the revised drainage design and have been used in cost negotiations with Praxair and LCG. The construction plans and associated design documents were issued. We solicited pricing for the extra work from LCG and reviewed the proposed costs and negotiated a final cost with LCG. Formal Borough and NJDEP Change orders will be prepared and require approval by all parties. We have met with Praxair representatives and reviewed optional plans and as previously stated Praxair has opted to ask the Borough to modify the proposed drainage design and reimburse the Borough for the costs. An initial Reimbursement Agreement was received by Praxair and we have reviewed same and presented the agreement for the Borough and their Attorney for review and comment. We have worked out all agreement revisions with all parties and under separate cover recommended the Borough approve the agreement. Upon execution of the formal agreement and change orders, we will authorize LCG to proceed with construction of the box culvert section and related drainage system design modifications. When submitted by LCG, we will review box culvert, special manhole structures, and tide chamber shop drawings and issue approval for fabrication as required. Once all materials are received and the work is scheduled, we will oversee the installation of the drainage improvements to check conformance with the revised plans. Daily inspection reports, photos, and field measurements will be taken and maintained as necessary during installation. Praxair will have a field representative on site during construction to ensure protection of its high - pressure nitrogen pipeline as continued service is critical for Praxair's customers. When completed we will certify by letter that all work is complete and acceptable so that the Borough can request full reimbursement for the work from Praxair. As -built drawings will also be prepared and incorporated into the final as -built plan set for the project. CART -02213 { March 6, 2017 . _. rr Daniel J. We will invoice this fee based on our current municipal engineering rate schedule and invoice the Borough monthly for our services. The Praxair Reimbursement Agreement also has a cost contingency provision wherein they agree to reimburse the Borough for unforeseen and unanticipated construction and soft costs which may arise during the construction phase of the work up to $50,000. Should any unforeseen work be identified and required during construction that is beyond the scope of our the originally identified scope of work provided herein, we will advise the Borough of the changed conditions and extra work requirements and provide a supplemental scope of services and fee estimate under separate cover.
