FRIDAY, NOVEMBER 6, 1953
The Board of Public Works and Safety of the City of Richmond, Indiana, met in
regular session in its office in the City Hall in said City, Friday, November 6,
1953, at the hour of 9:00 o'clock A.M. (CST . Mr. Coleman presiding with the
following members being present: Mr. Hodgin amd Mr. Haworth. .
On motion duly made, seconded and carried, the minutes of the previous meeting
were dispensed with.
The Board went on record of recommending to purchase of a 1050 gallon tank truck
to be used by the Fire Department and the money to be appropriated out of the
fO Common Council Contingency Fund in the sum of 3900.00.

A petition signed by residents on North 12th Street between Main and "A" Street
requesting the removal of the unoccupied building at 17 North 12th Street on
Lot #298 in Elizabeth Starr Addition, owned by John and Harriet Stelle. This
building is unsightly, unsafe, detrimental to the local property values, open
to vandals and prowlers, unlocked, water filled cistern which is dangerous to
local children, unsanitary haven for rodents and flies and foul oror from out-
side open privies: also is a fire hazard located in the business district less
than thirty feet from the. Wayne three story apartments occupied by many residents.
This petition was requested to be referred to the Building Inspector and he be
requested to make an investigation and report to the Board.
A petition signed by owners of real estate abutting on the thirteen hundred
block South 3rd Street, from "M" to "N!! Streets requesting fire protection by
• installation of a fire hydrant. This was referred to the City Engineer to make
study thereof with the Water Works and recommend.
On recommendation of the Mayor the board approved Paul Riley, Norman Pilgrim and
Guy Campbell as a committe of three make a study of the parking lot located on
North 10th Street, owned by Sherman Fleming. This lot for the public use. This
committee to make their recommendations to this board. •
The board approved the installation of 12 street lights in the area of South 19th
20th, 21st, and 22nd Streets, between South "E" And South "F" Streets as was
recommended by the light plant committee. The Clerk to notify the light plant _
to install the same.
The Board permitted the Huron Hotel to have a loading and unloading space in
front of said hotel on North "E" Street.
On recommendation of Capt. Juerling the board approved the removal of the parking
meter between the two drive-ways to the parking lot on North 7th Street that
is owned by Mrs. Ashe. The strip where the meter to be removed to be painted
yellow.
Capt. Juerling and Mr. Hodgin were appointed as a committee to make a study of
the future expansion of parking meter areas and make their recommendations.
An order was issued by the board to the Police Department to contact all the Filling
Station operators and warn them to stop the parking of cars on the sidewalks
around their stations.

The Board confirmed the Assessments Rolls Nos. 964-1953 and 965-1953 as adopted.
No remonstrances were filed or received.
The Board unanimously approved the following Agreement:
AGREEMENT
THIS AGREEMENT,made and entered into this 6th day of November, 1953,
by and between Stanley B. Gehr, a registered engineer, of Richmond,
Indiana, hereinafter called the engineer, and the City of Richmond,
Indiana, acting through its Board of Public Works and Safety, herein-
after called the owner.
WITNESSETH:
WHEREAS the owner intends to have constructed a new Fire Station, to
be known as Number Six (6) to be located on Northwest 5th Street,
Richmond:
NOW THEREFORE, the engineer and the owner, for the considerations here-
in after named, do agree as follows:
1. THAT the owner hereby employs the engineer to furnish professional
services for planning and constructing the said intended work
under the condition set out herein, and the engineer hereby
accepts said employment to furnish such professional services
under the conditions set out herein. Said professional services
shall consist of the necessary conferences, the preparation of
such preliminary sketches, plans including details, specifications and
necessary addendas thereto, if any, as the engineer may consider
-. -. useful.and necessary for the planning and construction of said
indended work, assistance to the owner's attorney in the pre-
paration of propasals and contracts for the construction of said
work, theissuance of certificates of payment to contractors,
the general administration of the work and the supervision of
the construction of the work.
• 2. The engineer will endeavor to guard the owner against defects
and/or deficienceis in the work and in the performance of con-
tractors doing the work, as well as in the sketches, plans,
details, specifications and supervision of the construction
of the work, estimates and other documents that may be prepared
by the engineer for the work, but he does not guarantee against such
defects and/or deficiencies. Any cost estimates the engineer
may make for this work shall be regarded as the engineer's
opinion only.
3. The owner shall pay the engineer for said professional services
a sum of money equal to six (6%) percent of the total cost of
the intended work including all fixed equipment that is a part
of the building contract, payment of said fee to be made in
installments in the following manner:
(a) A first installment in the amount of seven hundred fifty
dollars ($750) shall be paid by the owner to the engineer when
the preliminary sketches are completed and approved by the owner.

(b) Four and one half (4i%) percent of the estimated cost shall
be paid after the plans as prepared by the engineer and are
approved by the owner. Said payment becomes due when proceeds
from a bond issue for the aforesaid project are made available
to the owner, less any monies previously paid.
In the event the proceeds from the above mentioned bond
issue are not available to the owner within one hundred eighty
(180) days from the date of the approval and delivery of the
plans, specifications and estimates of cost, the owner shall
pay the engineer the total of four and one half (42) percent
of the estimated cost based on the final approved plans pre-
pared by the engineer from whatever funds that are or may be
made available, less any monies previously paid.

(c) The remainder of the fee shall be paid in additional
�.. month*y installments based on certificates of payment to con
tractors as the work progresses.
4. The owner shall reimburse the engineer for all costs of trans-
portation and living away from Richmond, if any, and for the cost
of all long distance telephone calls on account of this work,
ifany. Such reimbursements shall be in addition to the fee and
to other charges set out herein and shall be paid when billed.
5. If the owner shall require the engineer to make changes in the
work after the construction contract has been awarded and work
started the owner shall pay the engineer for all extra work
caused by such changes at the rate of ten dollars ($10.00) per
hour for each hour of such extra work caused the engineer on
account of such changes. Payment for such extra work shall be
made when billed and shall be in addition to the fee and other
reimbursements set out herein.
6. •The owner shall furnish the engineer a complete survey of the
site showing grades, property lines and all other conditions
whichcoulc affect the intended work, such survey to be made
at a scale of 1" equal to 20 feet. Ifrequested by the engineer
the owner shall make soil borings and other tests under the
direction of the engineer at theowner's expense. .
7. When-the plans andspecifications are completed and paid for,
the engineer shall furnish the owner with seven (7) sets of
• prints or copies of said plans and specifications. All _
original tracings andsheets shall remain the exclusive
property of the engineer. It is understood and agreed that
the ownershall not use any-Of these sketches, plans and
specifications to cause to be constructed'-any.work other than
that herein described.
