HomeMy Public PortalAbout07-18-1952 238 OFFICE OF THE BOARD OF PUBLIC WORKS AND SAFETY, RICHMOND, INDIANA, FRIDAY, JULY 18, 1952. , The Board of Public Works and Safety of the City of.P.ichmond, Indiana, met in regular session in its office in the City Hall in said City, Friday, July 18, 1952, . Mr. Coleman presiding with the following members being present: Mr. Hodgin and Mr. Haworth. The following business was had to-wit: On_ motion duly made, seconded and carried the minutes of the previous meet- ing were dispensed with. On motion made, seconded and carried the following was made a record of: CASE OF - CHARLES BECK, CITY BUILDING INSPECTOR VS LESLIE FRAZER • A committee consisting of Earl Robbins, representing Leslie Frazer and Arthur Thomas representing Charles Beck, and H. G. Cole- man, Chairman of the City of Richmond Board of Works met on July 15, 1952, at Two P.M. in the. office of the Mayor of the City. After hearing evidence from H. Francis Henderson, Charles Beck and Norman Schute, the committee, decided as follows: As the City Building Code applying to Concrete Block structures is not clearly defined as to proceedure, and as by common practice, for many years, contractors within city of Richmond have followed certain proceedure approved by Building Inspectors, therefore, the committee decides to sustain the action of Mr. Charles Beck in re- fusing to permit Leslie Frazer from constructing a two-story, cement block dwelling, using eight-inch blocks for the first and second , stories. Voting to sustain Arthur Thomas H.G. Coleman Voting not to sustain Earl Robbins Chairman of Committee /s/. H. C. Coleman Councilman Law' s report on permission to remove a large dead elm tree from in front of 1424. Ridge Street was referred to the Park Department. Councilman Law' s letter from Tussell Alexander was referred to City Eng- ineer' s office. On recommendation of the Chief of Police the Board approved the appoint- ment of Robert H. Rinehart as probationary patrolman on the Police Depart- ment as of August 1., 1952, Mr. Carol Porter, manager of the Porter Sign Service, appeared before the Board as ordered and reported that he was hying to make provisions to remedy the smoke nuisance at the plant located on North 17ths Street, The - Board will take this matter under advisement until a final report is given by Mr. Porter. The Board authorized. the Fire Chief to purchase and install enough 3" water line to adequately fight the dump fires at the North 20th Street Dump, 3 9 • The Board accepted the "Coal bid of the Kendall Coal Company to furnish coal for the various departments of the City as follows: II • More or Less . In case of freight rate increase this bid will be increased accordingly. The Board unanimously adopted Improvement Resolution No. 957-1952 as follows: . IMPROVEMENT RESOLUTION NO. 957-1952. Resolved by the Board of Public Works and Safety of the City of Richmond, Indiana, that it is deemed necessary to improve property abutting on South "I" and "J" Streets between South 12th and South 13th Streets and on South 12th and South 13th Streets between South "I" and South "J" Streets by the construction of a Sanitary Sewer in accordance with the plans, profile, details, drawings and specifications now on file, in the office of the City Civil Engineer and such improvement is now ordered. The cost of .said improvement shall be assessed upon the benefited property owners all according to the method andmanner provided for in an Act of the General Assembly of the State of Indiana, entitled, "An Act Concerning Municipal Corporations" approved March 6, 1905, and in accordance with and pursuant to the provisions of all amendatory and supplemental acts thereto, passed by the General Assembly of the State of Indiana. Assessments, if deferred, are to be paid in ten equal annual installments, with interest at the rate of Six (6%) percent, per annum. A bond or bonds shall be issued to the contractor in payment for such work, unless the property owners pay said assessment before said bond or bonds. are issued. Under no circumstances shall the City of Richmond, Indiana, be, or be held responsible for any sum or sums, due from said property owner or owners for said work, or for the collection of the same, or for the payment of any bond, bonds, certificate or certificates, issued to said contractor in payment for such work, except for such, moneys as shall have been actually received by said City from the assessments for such improvement., or such moneys as said. City is, by said above entitled Act, required to' pay. All proceedings had, and work done in the making of said improvement, assessment of property, collection of assessments and issuance of bonds therefore, shall be as provided for in said above entitled Act and amendments thereto. Adopted this 18th day of July, 1952. The Board unanimously adopted Improvement Resolution No. 958-1952 as follows, to-wit: IMPROVEMENT RESOLUTION NO. 958-1952 RESOLVED BY THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF RICHMOND, IND.IANA, That it is deemed necessary to improve the alley between South loth and South 15th Streets, from South "G" to end of the alley, by construction of a concrete roadway the full width of said alley in accordance with the profile, details, drawings, and specifications on file in the office of the Board of Public Works and Safety of said City, and such improvement is now ordered. The cost of said improvement shall be assessed upon the real estate abutting on said Alley Improvement and on property abutting on the streets or alleys intersecting the alley proposed to be improved, and on property within 150 feet of the line of the alley to be improved, and upon the City of Richmond, Indiana, if said City is benefitted by said improvement, al: according to the method and manner provided for in Act of the General Assembly of the State of Indiana, entitled "An Act Concerning Municipal Corporation" , ap_ proved March 6, 1905, and in accordance with the pursuant to all amendatory and supplemental acts, thereto, passed by the General Assembly of the State of Indiana, Assessments, if deferred, are to be paid in ten equal installments, with interest at the rate of six per cent (6%) per annum. Adopted this 18th day of July, 1952. 241 The Clerk presented proofs of publication that a public hearing would be held on Declaratory Resolution No. 9-1952 to vacate a portion of Randolph Street. The hearing to be held on this date at 9:00 o' clock A.M. ( c. s. t. ). The proofs were ordered filed. The Board meets and hears all present who desired to be heard on DeclaratoryResolution No.. 9-1952. The Board now unanimously confirms Declaratory Resolution No. 9-1952 as adopted. The Clerk presented proofs of publication that bids would be received on this date until the hour of 9:00 o' clock A.M. (cst) for improvements as provided in Improvement Resolution No. 954-1952• The proofs were ordered filed, • The following bid was received: 00 ',-i Henry Rodenberg proposes to furnish all material and labor neces- sary to complete the concrete pavement of alley as provided in Improvement Resolution No. 954-1952 at the cost of $2, 370.00. The City Eftgine,ere s:estimate was ? 2, 370.00. On recommendation of the City Engineer the Board unanimously accepted the bid of Henry Rodenberg, The Clerk presented proofs of publication that bids would be received on this date until the hour of 9: 00 o'clock A.M. (cst) for improvements as provided for in Improvement Resolution No. 955-1952. The proofs were ordered filed. The following bid was received. Henry Rodenberg proposes to furnish all material and labor necessary to complete the curb gutters and sidewalks as provided in improve- ment Resolution No. 955-1952 at the cost of . 2, 140.00. The City Engineer' s estimate was ,$2, 361. 60. On recommendation of the City Engineer the Board unanimously accepted the bid of Henry Rodenberg. The Clerk presented proofs of publications that bides would be received on this date until the hour of 9:00 o' clock A.M. (cst) for improvements : as provided for in Improvement Resolution No. 946-1952 (Bealview Sewer) . The proofs were ordered filed. No bids were received and the Board now takes under advisement what should be done as the next step® - The Board allowed the claims in the amount of G21,540. 65.
