HomeMy Public PortalAbout2014.067 (04-15-14)RESOLUTION NO. 2014.067 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD APPROVING THE 2014 LYNWOOD FARMERS MARKET PROGRAM AND AMENDMENT OF 2013 LYNWOOD FARMER'S MARKET RULES AND REGULATIONS AND FEE SCHEDULE WHEREAS, on May 21, 2013, at a regularly scheduled Council meeting, the Lynwood City Council approved a Lynwood Farmer's Market Pilot Program in conjunction with the popular "Movies at the Park" on Thursdays at Yvonne Burke /Ham Park located on Atlantic Avenue along with its Rules and Regulations form; and WHEREAS, as part of the approval, the Lynwood Farmers Market would be evaluated towards the conclusion of the 8 week pilot program for possible changes or cancellation; and WHEREAS, due to the success of the Market, Council extended the 8 week Pilot program for an additional 4 weeks; and WHEREAS, the Farmer's market proved to be an excellent community resource that created an interactive atmosphere for Lynwood community members to come together and enjoy the experience of a culturally diverse activity within the City's borders; and WHEREAS, the vendors participating are both Lynwood and non - Lynwood residents and are providing potential movie goers and residents a variety of healthy foods both raw and prepared to peruse, eat and enjoy; and WHEREAS, due to the success of last year's Farmer's market Pilot Program and the increasing interest from the community and surrounding vendors, it is requested the 2014 Farmer's Market be approved and operate in conjunction with the Lynwood Movies in the Park; and WHEREAS, Yvonne Burke /Ham Park parking lot will be required to close by 2pm to public cars and remain closed for Event purpose only until 9pm in order to set up and break down booths and clean area; and WHEREAS, vendors will pay a one -time business license fee of $60 and appropriate booth fee as stated in the Rules and Regulation governing the 2104 Farmer's Market Program; and WHEREAS, contingent upon the approval of the 2104 Farmer's Market, the Rules and Regulation governing the Program have been amended accordingly. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: Section 1. The City hereby authorizes and approves the 2014 Lynwood Farmer's Market Program to be held from June 19, 2014 ending September 4, 2014. Section 2. The Lynwood Farmer's Market 2014 Rules and Regulation are hereby approved as amended in the form attached as Exhibit "A ". Section 3. The City hereby approves the $60 event business license fee and vendor fee schedule as stated in the 2014 Lynwood Farmer's Market Rules and Regulations. Section 4. The City hereby approves no parking signs to be posted in accordance with Lynwood municipal law restricting parking as needed in the Yvonne Burke /Ham Park parking lot between 2pm and 9pm every Thursday until proposed end date_ Section 5. The City Manager, or her designee, is hereby authorized to direct logistics and sign all documents necessary and appropriate to carry out and implement said activities on the behalf of the City. The City of Lynwood name and logo are the property of the City of Lynwood and may only be used with written permission from an authorized representative of the city. LOCATION Yvonne Burke /John Ham Park; 11832 Atlantic Blvd, Lynwood, CA MARKET OUTDOOR SEASON June 19, 2014 thru September 4, 2014 EVERY Thursday from 4:00 pm — 8:00 pm* *Time schedule may be changed with a minimum 4 day notice PURPOSE The purpose of the market is to provide a service to the community in the following ways: 1. Provide a venue for promotion and sale of locally produced food; 2. Provide the customer with a central source for high quality, locally produced and value added food products as well as a venue to connect with local artisan and crafts people; 3. Provide a center of activity and education for visitors and families of our community where they may become familiar with, recognize and value the wide variety of resources to be found locally; 4. Increase the awareness and promotion of existing agri- tourism offerings. GOVERNANCE The City of Lynwood Farmer's Market is an initiative of the City Council Healthy Cities MARKET MANAGEMENT City staff will have full authority to implement and, when necessary, enforce the Market Rules and Regulations and Code of Conduct. PRODUCTS • Vendors must be approved by city staff and permitted by the Los Angeles County Health Department and meet regulatory criteria to be eligible to participate in our Market. • Hand crafted items must be original in nature and locally produced in whole by the seller. No crafts shall be permitted that are derived from kits or resale unless approved by city staff. • Exceptions to the above regulations may be considered on a case -by -case basis by city staff. While the market does not offer exclusive rights to any one vendor to sell any one product, staff may exercise their right to limit the number of vendors to avoid excessive duplication. VENDOR ELIGIBILITY All vendors must reside or do business within the City of Lynwood or the County of Los Angeles although consideration will be given to vendors outside of these areas. EVENT CAPACITY Be advised that this Farmer's Market will have a maximum capacity of (30) vendors on any given event day. VENDOR RESPONSIBILITIES All vendors are responsible for the following: Compliance with all conditions laid out in these Rules and Regulations and the Code of Conduct; • Obtaining a City of Lynwood Event Business License ($60 Fee) • Knowledge and compliance with health and safety regulations; • Obtaining all appropriate permits and licenses and certificates with respect to sale of goods offered; • Display of an attractive, easy to read sign with their farm or business name and location; • Post prices for ALL items. Prices should be fair market value! Cooperation, not competition is encouraged in pricing; • A Producer may sell on behalf of no more than 2 other producer's provided the other producer's certifications are posted and in plain sight at the Booth where each separate producer's goods are located and fees must be paid separately. • Provide their own shelter (fire retardant — certified), tables, chairs, tablecloths, displays, signs, bags, waste disposal containers, sanitation supplies and all other necessary items for their booth; • Maintain a tidy area throughout the market day — leaving the area clean at the end of the day; • Booths must be set up by the start of the business session and taken down immediately after the business session, unless otherwise pre- arranged with city staff. All regular vendors are expected at the market every week. Any occasional vendor scheduled or regular vendor expected to be present MUST notify city staff by noon on the day prior to the scheduled date of market if they will not be in attendance at that session. If two (2) weeks are missed the vendors' space is subject to reassignment. Fees paid in advance are nonrefundable, but may be used as credit towards future dates within that Market season only. (No Exceptions). Vendors must arrive at the market 30 minutes prior to the start of the market session or their space may be reassigned. For the Health and Safety of the vendors and patrons this will be strictly enforced. Please call staff on the day of market if unavoidably delayed. The onsite staff is responsible for all space assignments. INSURANCE Vendors are responsible to carry their own insurance for the booth and product(s). Written proof of Insurance is required with the application. NON - COMPLIANCE WITH MARKET RULES; CONFLICT RESOLUTION AND CODE OF CONDUCT Any vendor who fails to abide by the market rules and regulations is subject to the cancellation of their participation in the market without refund at the direction of the staff. Vendor will be notified within 4 working days of the violation in writing and will be given the opportunity to appeal in writing provided the appeal is received no later than 4 business days from the notification date of violation. Upon review, the Market Manager will provide a detailed response with a decision regarding the vendors violation that will be final. • If a conflict arises and a review is necessary, a detailed description of the issue in question must be submitted in writing to staff within 10 days of the incident or issue arising. Staff will review the conflict report and respond within 4 working days. Once the report regarding determination of fault is prepared, the vendor at fault will be provided the detailed report with findings, rationale, and the desired disciplinary resolution of the conflict up to removal from the Market. The determination provided by the Market Manger will be final.
