The t oard of Public Works and Safety of the City of Richmond, Indiana, met in regular session in its office in the City Hall in said City, Friday, August 17, 1951, at the hour of 8:00 otclock A.M. (cst) . Mr. Coleman presiding with the following members being present: Mr. Hodgin and Mr. Haworth. The following business was had, to-wit: On motion-duly made, seconded and carried, the minutes of the pre- vious meeting were dispensed with. Mr. John Harlan appeared before the Board and presented a petition signed by approximately 400 signatures of residents in the area of Henley Road and East Main Street, requesting the installation of a traffic signal at the intersect on of Henley Road and East Main St :'eets in the best. interest of and for the safety of people using said streets. This pettition was ordered received and the Clerk was ordered to contact the State Highway Commission requesting the erection of a traffic signal at said intersection. The City Attorney, Mr. Haworth presented and read the following: AGREEMENT THIS AGREEMENT, Made by and between the City of Richmond, Indiana, acting by and through its Board of Public Works and Safety, here- inafter referred to as CityT and International Harvester Company, a corporation, hereinafter referred to as Harvester, WITNESSETH: That said City grant to said Harvester the right to construct maintain and use a bridge over and across North 13th Street, at a point 177 feet 8 inches north of the north line of North E Street in said City, where said North E Street intersects with North 13th Street. Said bridge is to connect building #19 of said Harvester on the west side of said North 13th Street and building #17 on the Bast side of said North 13th Street. Said bridge is to be 11 feet 8 inches wide at its base and the floor of said bridge is to be 16 feet 8 inches above the level of the street at the east end, and 18 feet 7 inches above the level of the street at the east end, and 18 feet 7 inches above -the level of the street at the west end. On the west side of said street against building #19 the footing of said bridge will be encased in cement and will extend into the sidewalk a distance of two feet, the same to be protected by a steel guard rail. Said bridge is to be used by Harvester in its manufacturing business and more particularly in moving materials, equipment and c II manufactured products over and through said bridge. Said construction shall be done and performed in all respects according to plans and specifications made by the Works Engineering Department of said Harvester, a copy of the same, properly ident- ified by the parties, is on file in the office of the Clerk of said City. In consideration of the rights herein granted to it by said City, said Harvester agrees to construct, maintain and use said bridge in a sfae and proper manner and so as not to interfere with the ordinanry use of said street by the public, and said Harvester shall at all times save the City harmless from any claim for loss or damage to persons or property occasioned by the construction, maintenance or use of said bridge. . This agreement and all the rights, conditions and obligations thereof shall enure to and be binding upon the sucessors and assigns of said Harvester, and and subsequent owner or usesr of said bridge and the land and buildings which it connects. Mr. Haworth moved that the above agreement be accepted as signed August 6th, 1951, on this 17th day of August, 1951, seconded by Mr. Hodgin and on voice vote was unanimously carried an so ordered. The Clerk presented the publisher' s affidavit showing that on the 6th and llth days of August, 1951, a notice had been published in the Richmond Pallidium-Item, a newspaper of general circulation in the City of Richmond, Indiana, containing a "NOTICE TO BIDDERS" , for the furn- ishing the Street Department of said City with a 22* ton carload of Calcium Chloride, and such notice the date of Agust 17th, 1951, at the 127 hour of 9:00 o' clock A.M. (cst) , sealed proposals would be received and opened. Mr. Hoggin moved that the bid of the Anderson Ica and Coal Comapny be accepted, seconded by Mr. Haworth and on voice vote the motion was unanimously carried. The Clerk presented a publisher' s affidavit showing that on the 23rd and 30th days of July, 1951, a notice had been published in the Richmond Pall dium-Item a newspapre of general circulation in the Cit of Richmond, Indiana, containing a "NOTICE TO TAXPAYERS" , that a public hearing would be held on the 17th day of August, at the hour of 9:00 o' clock A.M. (cst) , to receive and consider any re- monstrances which may have been filed on Improvement Resolution No. 943-1951, for the construction of a "Sanitary Sewer" in the Marymount Addition, between South 13th and 14th Streets, from South "M" to "0" Streets. The proofs were ordered filed. This being the day of hearing, the City Civil Engineer files with the Board his estimate of the total cost of said construction of the "Sanitary Sewer" in the Marymount Addition, between South 13th and 14th Streets, from South "M" to "0" Street to be an estimated cost of $8,380. 00. The Board meets to hear all persons interested in or whose property is affected by the propsed construction of the "Sanitary Sewer" in the Marymount Addition. After hearing all persons interested in or whose property would be affected who appeared and being duly ad- vised in the premises, the Board decides that the benifits to property liable to be assesed for said sewer are equal to the est- imated cost of the same as reported by the City Engineer and thereupon takes final action on said resolution as orginally adopt- ed, and confirms the same. The Clerk was ordered to prepare the proper advertising to receive bids to do the work of constructing the "Sanitary Sewer" in the Marymount Addition, and said bids to be received on the 14th day of September, 1951, at the hour of 9:00 o' clock A.M. (cst) . The Board authorized the Clerk to prepare an Ordinance for Council' s consideration to transfer the sum of 600.00 from Acct. S-24, Storm Sewers, Special Streets, to Account #S-26, Traffic Signs and Guides, Special Streets. The monet is to be used for One-Way signs to be erected on North "B" Street, to make North "B" Street One- Way from North 7th Street to North. 16th Street. 8 A petition requesting the installation of a Traffic Light at South Ninth and 'IL° Streets was presented and received. This petition was signed by 15 residents in the area of South Ninth and "L" Streets. The Clerk was ordered to contact the State Highway Commission requesting that the Traffic Signal be in- stalled at said intersection. The Board allowed the claims in the amount of $ 17, 247. 17.
