No. 17 -68 Date of Adoption ft 4, 2017 AUTHORIZING A PROFESSIONAL SERVICES CONTRACT T &M ASSOCIATES, RE: NOE STREET PARK PROJECT WHEREAS, the Borough of Carteret is in need of specialized engineering services with regard to Survey Services for the Noe Street Park Project, Green Acres requirements; and WHEREAS, T &M Associates, 1455 Broad Street, Suite 250, Bloomfield, New Jersey 07003, possesses the requisite experience and expertise to provide said services; and WHEREAS, T &M Associates has submitted a proposal to provide said services at a total cost not to exceed $10,750.00; and I I WHEREAS, the Mayor and the Council have reviewed said proposal; and WHEREAS, the Chief Financial Officer has certified that funds are or will be available for said purpose. NOW, THEREFORE, BE IT RESOLVED by the Mayor and the Council of the Borough of Carteret, County of Middlesex. State of New Jersey, as follows: 1. The proposal from T &M Associates for engineering services with regard to Survey Services for the Noe Street Park Project, Green Acres requirements at a total cost not to exceed $10,750.00 is hereby approved. 2. This action is approved as an award of a professional services contract pursuant to N.J.S.A 40A:11- 5(1)(a) in accordance with the Borough's Fair and Open Process as authorized by law. 3. A copy of this Resolution be forwarded to the Borough's Purchasing Department and T &M Associates. Adopted this 4 th day of May, 2017 and certified as a true copy of the original on May 5, 2017. Mayor Daniel Reiman Borough of Carteret 61 Cooke Avenue Carteret, New Jersey 07008 O,3 0A OF q� j � Y A fr1 a 4 L V 1 I �J May 4, 2017 Re: Noe Street Park Properties Professional Survey Services (Green Acres Requirements) Dear Mayor Reiman: As requested, we are providing herein this scope of services and fee estimate to prepare Outbound Surveys of Lots 2 -7, 8.01 & 8.02 in Block 5801; Lot 7 in Block 6411; and a portion of Lot 9 in Block 5801 which encompasses the conservation/drainage easement for the Noe Street Drainage project in accordance with Green Acres requirements. All survey work will be performed in accordance with New Jersey laws, court rulings and administrative codes pertaining to land surveying: NJAC 7:36 Appendix 2, NJSA 45:8 et seq., NJAC- 13:40 -l.let seq., the Map Filing Law 46:23 -9.9, State of New Jersey Department of Environmental Protection Green Acres Program and other laws pertaining to this professional activity. Specifically, T&M will prepare the Outbound Surveys to meet the requirements detailed in the NJDEP Green Acres "Scope of Survey Services and Standard Detail Requirements ", dated July 1, 2011 and the "Policy & Procedures Addendum to Scope of Survey Services, dated September 2011. T &M will require, from the Borough, a current Title Binder of each parcel being surveyed. In addition T &M will conduct a search of the public record for each of the adjoining lots and may also need to perform a records search, of the properties in question, to the "mother" parcels. Further, as requested, we will provide subdivision plats for Lots 2 & 3 in Block 5801 showing portions of the two properties which will contain the new stormwater pump station and generator building. The plats will be prepared with approximate dimensions for appraisal purposes. PROJECT SERVICE SCOPE The Outbound Surveys will include: • A basis of bearings (north reference) and the beginning point values will be derived from the New Jersey State Plane Coordinate System North American Datum 1983 Adjustment (NJSPCS NAD83 ). The grid factor will be applied to the Northing and Easting values in US Survey Feet. • Deed Conflicts will be reported as gores or overlaps. The deed conflicts will be drawn on the map and a separate metes and bounds description will be prepared to reflect the conflicts shown on the map. • Evidence of easements or servitudes, either disclosed in the current title binder or observed during the process of conducting the field survey, will be shown on the survey map. Comer markers, with identifiable caps, will be set where none exist including three (3) concrete monuments as prescribed by Green Acres standards. NJSPCS Northing and Easting values will be indicated for each of the property corners (either found or set). • The character and location of evidence of possession or occupation along the perimeter of the surveyed property, both by occupants of the surveyed property and by adj oiners, observed during the process of conducting the survey will be field located, shown, and identified on the survey map. • The report for the Green Acres survey consists of the plan of survey, the metes and bounds description(s), and the Surveyor's Certification and Summary Form SCHEDULE AND DELIVERABLES The Survey and related deliverables Report will be completed within 45 days of receipt of authorization and receipt of the current Title Binder of the parcel being surveyed, weather permitting. The following deliverables will be supplied to the Borough for use at closing and/or Green Acres reimbursement: • Six full size paper copies of the Survey Plan(s), signed, sealed, and dated, depicting the results of the field and record investigation. • Six metes and bounds description corresponding to and derived from the plan of survey. Accompanying each description will be a reduced size survey map, signed by the Professional Land Surveyor. One CD containing: • The exact text of each metes and bounds description in MS Word 2003 format. • An exact copy of the cad drawing in AutoCAD 2008 format. • An exact copy of the AutoCAD drawing in adobe pdf format. • One file containing a dxf format single layer digital drawing containing the closed polygon of the perimeter survey lines and certain other lines that are internal to the survey. • One copy of the Surveyor's Certification Form signed and sealed by the New Jersey Licensed Professional Land Surveyor who was in responsible charge for the completion of the survey, survey plan, and the metes and bounds description. One copy of the checklist signed and sealed by the New Jersey Licensed Professional Land Surveyor who was in responsible charge for the completion of the survey, survey plan, and the metes and bounds description(s) to assure that the specific items have been completed and that all deliverables are submitted. Based on this scope of services, we propose a lump sum fee of $10,750 to be billed monthly utilizing on a percent complete basis. LU%HTING CONDITIONS /ASSUMPTIONS /EXCEPTIONS • The parcels to be surveyed are shown as Lots 2 -7, 8.01 & 8.02 1 in Block 5801; Lot 7 in Block 6411; and a portion of Lot 9 in Block 5801 on the Carteret Tax Map sheet No. 59 dated March 28, 2002. The correct lot designation will be confirmed with the Borough Assessor's office upon initiation of these survey services. • We understand that the Borough has already acquired the property and is requesting the survey for submittal for Green Acres funding. • Our services do not include subdivision mapping for Lots 2 and 3 in Block 5801 and Lot 7 in Block 6411 related to the stormwater pump station and generator building parcels which will not be conveyed to Green Acres. • This proposal does not include any topographic (contour) information either by field survey or by G.I.S. data. • T &M will make every effort to ensure we provide complete Green Acres Outbound Survey Reports within 45 days. However, the surveys cannot be completed without sufficient time to review the Title Binder. • The Borough will ensure site access for T &M personnel. • Services not specifically listed are not included.
