PROFESSIONAL SERVICES CONTRACT FOR
LEGAL SERVICES
WIIEREAS, there exists a nccd for professional services to represent the Borough
in connection with police negotiations and arbitration, general labor matters, various
police related matters including representation with regard to Merit Board Appeal;
and
WHEREAS, legal services are a professional service exempt from the requirements
of competitive bidding pursuant to N.J.S.A. 40A: 11-5(1 ) (a); and
WHEREAS, the Local Finance Officer has certified that funds are available;
NOW, THEREFORE, BE IT RESOLVED that thc Mayor and Couocil of the
Borough of Carterct does hereby approve the appointment of Genova, Burns &
Vernoia at a maximum cost not to exceed $35,000.00 billable per attached contract..
BE 1T FURTHER RESOLVED that thc Mayor and Borough Clerk are hereby
authorized to execute the said contract.
IT IS FURTHER RESOLVED that the contract is awarded without competitive
bids in accordance with N.J.S.A. 40A:1105 (1) (a) duc to thc specialized and
professional nature of the scrvices provided.
BE IT FURTHER RESOI,VED that a notice of this action shall be published in
The 1 lome News Tribune on September 7, 1999.
