However, we are still early in our experience of the Omicron variant. For the period 12/5 to 12/18 Barnstable County's 14 -day average percent positive rate was 8%. The only town with a rate less than 5% was Provincetown (2.7%). There will be an update of these figures, with town -specific rates through 12/25, published by the DPH on Thursday evening. Centers for Disease Control and Preventkan CDC Updates and shortens Recommended Isolation and Quarantine Period for General Population Media Statement For Immediate Release: Monday, December 27, 2021 Contact: Media Relations (404) 639-3286 Given what we currently know about COViD-19 and the Omicron variant, CDC is shortening the recommended time for isolation from 10 days for people with CDVID-19 to.5 days, if asymptomatic, followed by 5 days of wearing a mask when around others. The change is motivated by science demonstrating that the majority of 5AR5-CoV-2 transmission occurs early in the course of illness, generally in the 1-2 days prior to onset of symptoms and the 2-3 days after. Therefore, people who test positive should isolate for 5 days and, if asymptomatic at that time, they may leave isolation if they can continue to mask for 5 days to minimize the risk of infecting others, Additionally, CDC is updating the recommended quarantine period for those exposed to CDVID-19. For people who are unvaccinated or are more than six months out from their second mRNA dose (or more than 2 months after thej&j vaccine) and not yet boasted, CDC now recommends quarantine for 5 days followed by strict mask use for an addltlona1 5 days. Alternatively, if a 5 -day quarantine is not feasible, it Is imperative that an exposed person wear a well -fitting mask at all times when around others for 10 days after exposure. Individuals who have received their booster shot do not need to quarantine following an exposure, but should wear a mask for 10 days after the exposure. For all those exposed, best practice would also include a test for SARS-CoV-2 at day 5 after exposure. If symptoms occur, individuals should immediately quarantine until a negative test confirms symptoms are not attributable to COViD-19. Isolation relates to behavior after a confirmed infection. Isolation for 5 days followed by wearing a well -fitting mask will minimize the risk of spreading the virus to others. Quarantine refers to the time following exposure to the virus or close contact with someone known to have CDVID-19. Both updates come as the omicron variant continues to spread throughout the U.S. and reflects the current science on when and for how long a person is maximally infectious. Data from South Africa and the united Kingdom demonstrate that vaccine effectiveness against infection for two doses of an mRNA vaccine is approximately 35%. A COVID-19 vaccine booster dose restores vacclne effectiveness against infection to 75%, CDVID-19 vaccination decreases the risk of severe disease, hospitalization, and death from CDVID-19. CDC strongly encourages COVID-19 vaccination for everyone 5 and older and boosters for everyone 16 and older. Vaccination is the best way to protect yourself and reduce the impact of COVID-19 on our communities. The following is attributable to CDC Director. Included with this upgrade will be a new sewage disposal system, located as far from the wetland resources as physically possible on the property. Due to the small lot size, lot configuration the new septic system will require several variances from Title 5 and the Brewster Board of Health Regulations. The applicant proposes to demolish the existing 4 Bedroom dwelling and build a proposed 4 Bedroom dwelling located further away from the edge of wetlands (Coastal Bank). Additionally, the existing septic system will be upgraded to a Maximum Feasible Compliant 1995 Title 5 septic system consisting of a 1500 gal septic tank, distribution box, and 3 — 500 gal precast chambers for a maximum 4 Bedroom capacity septic system. Due to the constraints of the lot size, location of the existing wetlands, and the larger footprint of a current Title 5 leach facility compared to the existing leach pit, the proposed leach chambers will be located slightly closer to the wetland edge. The existing leach pit is located approximately 27.7' above the approximate hightide wrack line and the proposed leach facility will be approximately 32.2' above the approximate hightide wrack line. 5. Mottling Due to Wetness (Redoximorphic Features) - A color pattern in soil consisting of blotches or spots of contrasting high or low chroma colors which may be an indication of the upper extent of soil saturation by groundwater. Multiple Compartment Tank _ A septic tank containing more than one settling compartment in series. Munsell System -The system of classifying soil color consisting of an alpha -numeric designation for hue, value and chroma together with a descriptive color name accepted by the USDA/Natural Resources Conservation Service (NRCS) used as a standard procedure in soil classification. Naturally Occurring Pervious Material - Naturally occurring soil exhibiting a percolation rate of 60 minutes or less per inch which was deposited on a site by natural causes and not by human action. New Construction - The construction of a new building for which an occupancy permit is required or an increase in the actual or design flow to any system or an increase in the actual or design flow to any nonconforming system or an increase in the design flow to any system above the existing approved capacity. New construction shall not include replacement or repair of a building in existence as of March 31, 1995 that has been totally or partially destroyed or demolished, provided there is no increase in design flow, no increase in design flow above the existing approved capacity to any system, no increase in the number of dwellings or dwelling units or no increase in the number of bedrooms in any dwelling or dwelling unit. Nitrogen Sensitive Area - An area of land and/or natural resource area so designated by the Department in accordance with 310 CMR 15,215, Nonconformin System - Any system which is not in full compliance with the standards and requirements of 310 CMR 15.000 and for which a variance or local upgrade approval has not been obtained. Nonconforming systems include, but are not limited to, cesspools, privies, failed systems, and systems with a design flow above 10,000 gpd. Observed Ground -Water Elevation - That elevation below the ground surface at which water is observed weeping, flowing from the walls of, or standing in a deep observation hole. On-site S stem or Disposal System or On-site Subsurface Sewage Disposal System or System - A system or series of systems for the treatment and disposal of sanitary sewage below the ground surface on a facility. (a) The standard components of a system are: a building sewer; a septic tank to retain solids and scum; a distribution system; a soil absorption system containing effluent distribution lines to distribute and treat septic tank effluent prior to discharge to appropriate subsurface soils; and a reserve area. (b) These terms also include tight tanks, shared systems and alternative systems. Unless the text of 310 CMR 15,000 indicates otherwise, these terms also include nonconforming B.REWSTER BOARD OF HEALTH REGULATION REGARDING VARIANCE REQUESTS FOR ON-SITE SEWAGE DISPOSAL SYSTEMS APPLICATIONS The following regulation is promulgated under the authority of Chapter 111, Section 31, of the Massachusetts General Laws: Section I — Purpose: 1.1 Brewster draws its groundwater from a single source aquifer which is integrally connected with and flows into, the surface waters, ponds, streams, coastal estuaries and embayments. These water bodies constitute significant recreational and economic resources of the town, used for bathing and other water -related recreation, including shellfishing and fishing for human consumption. Inadequately treated wastewater effluent presents serious threats to the water quality of the sole source aquifer, posing potential public health and safety hazards and threatening economic losses to the affected communities. Additional and more stringent preventative measures than those set forth in Title 5 of the State Environmental Code, 310 C.M.R. 15.000, et seq., are necessary to protect the public health from potentia] and present sources of pollution from sewage disposal systems in Brewster. Thus, these regulations shall apply to all applications for variances from the provisions of Title 5 of the State Environmental Code, 310 C.M.R. 15.000, et seq., as well as, applications seeking variances from local Brewster Board of Health Regulations governing the siting, construction, inspection, upgrade and expansion of on-site sewage treatment and disposal systems. Sections II --- Definitions: 11 Environmentally Sensitive Area means the following: A. Land area that borders on or is within 300 feet of the following Resource Areas, as defined in the Brewster Wetlands Protection Regulations, Section 1.04: beach, dune, flat, bank (coastal and inland), freshwater wetland, coastal wetland, marsh, meadow, bog, swamp, lake, pond, river, stream, estuary, land subject to coastal flowage, and the ocean. B. Land with groundwater six (d) feet or less below natural ground surface elevation, as defined by the USGS 1992, 2' Water Table Contour Map, as the same may be amended; C. Land within Zone 11 of an existing or proposed municipal well, as Zone Il is the Massachusetts public Drinking Water Regulations set forth at 310 C.M.R. 22.00, et seq., as the same may be amended; D. Land in a protective private drinking well zone as defined by the Brewster Board of Health Private Well Regulations, effective June 29, 2007, as the same may be amended; E, Land in freshwater pond recharge areas as those areas are shown on the Cape Cod Commission Map, entitled Cape Cod 'Water Resources Classification Map I dated January 16, 2009, as the same may be amended; F. Land in critical environmental habitats, as those habitats are mapped and depicted on the Cape Cod Critical Habitat (Association for the Preservation of Cape Cod) Atlas, dated August 1990, as the same may be amended. 2.2 New Constriction shall have the same meaning as defined in Title 5. of the State Environmental Code, 310 C.M.R. 15.002. 2.3 Bedroom shall have the same meaning as defined in the Brewster Local Regulation to Supplement Title 5 of the State Environmental Code, effective May 22, 2015, as the same may be amended. 2.4 Buildable Upland means the total area of a lot as measured in square feet, but excluding that portion of the lot located within beach, dune, flat, bank (coastal and inland), freshwater wetland, coastal wetland, marsh, meadow, bog, swamp, lake, pond, river, stream, estuary, land subject to coastal storm flowage, and the ocean, as those areas are defined under the Brewster Wetlands Protection Regulations. Section III — Granting of a Variance: 3,1 All Variances. The Board of Health may vary the provisions of any state or local regulation pertaining to the design, inspection and installation of septic systems in Brewster only when, in the opinion of the Board of Health, the person requesting a variance has demonstrated by a preponderance of credible evidence that; (A) enforcement of the provision from which a variance is sought would be manifestly unjust, considering all the relevant facts and circumstances of the individual case; and, (B) a level of environmental protection that is at least equivalent to that provided under the unvaried regulation can be achieved without strict application of the provision from which a variance is sought. 3.2 Environmentally Sensitive Areas. (A) Variances for projects in Environmentally Sensitive Areas shall only be permitted for the following systems: 0 Failed Systems as defined in Title 5, 210 C.M. R. 15.002; ii} New Construction. With regard to variances for New Construction, in order to meet the manifestly unjust requirement of the Variance standard set forth in Section 3.1 above, the applicant must demonstrate that: (a) enforcement of the provision from which a variance is sought will deprive the applicant of substantially all beneficial use of the subject property; and, b) when compliance to the provisions of the Brewster Board of Regulation Regarding Leaching Facility Setbacks cannot be met for New Construction of residential dwellings, in addition to meeting the requirements of Section 3.2(a) above, the design flow of the system shall be equal to or less than one Bedroom per 10,000 square feet of Buildable Upland calculated at 110 gallons per day per Bedroom; provided, however, an application for New Construction of a two (2) bedroom house on previously undeveloped land may be permitted under this provision where the applicant can meet the requirements of 310 C.M.A. 15.215 (aggregate flows) or 15.217 (enhanced nitrogen removal), and agrees to execute and record at the Barnstable County Registry of Deeds to run with the title to the property a deed restriction limiting the number of bedrooms permitted on the property to two (2) bedrooms. iii} Upgrade of existing residential systems provided no additional design flow is proposed; and, iv} All other structures, provided the project does not trigger an increase in design or actual flow above the existing approved capacity of the system. (B) In order to meet the manifestly unjust requirement of the Variance standard set forth in Section 3.1 above, applicants seeking variances for projects in Environmentally Sensitive Areas must: i) demonstrate that enforcement of the provision from which a variance is s sought will deprive the applicant of substantially all beneficial use of the subject property; ii} in addition to meeting the requirements of Section 3.2 (a) above, agree to install water saving devices on all fixtures. If the Brewster Board of Health detennines that it is necessary to protect public health and the environment, it may require a deed restriction limiting the number of bedrooms permitted on the property to a number equal to or less than one bedroom per 10,000 square feet of buildable upland or a number determined by the Board of Health. Such deed restriction must be recorded at the Barnstable County Registry of Deeds to run with the title of the property. Section IV - Certificates of Granting Of Variance 4.1 once granted by the Board of Health, a written Certificate of Granting of Variance will be issued by the Board of Health, approved by the Department of. Environmental Protection pursuant to the provisions of Title 5 of the State Environmental Code, and posted conspicuously in Brewster Town Hall for 30 days following its issuance. Thereafter, the Certificate of Granting of Variance shall be recorded against the title to the property by the property owner at the Barnstable County Registry of Deeds. Section V - Expiration of Variance 5.1 A Variance approved by the Brewster Board of Health hereunder shall expire if the work permitted under the Variance is not complete within one (1) year from the date of the issuance of the Certificate of Granting of Variance. Section VI - Severability 6.1 If any provision of these regulations is declared invalid or unenforceable, the other provisions shall not be affected thereby but shall continue in full force and effect. Chairman's announcements Massachusetts Department of Public Health (MDPH) tracks the number of mosquitos that test positive for West Nile Virus and Eastern Equine Encephalitis. No mosquitos, humans or animals have tested positive for West Nile Virus or Eastern Equine Encephalitis in Brewster. MDPH announced today that they had their first case of West Nile Virus in a human this year. Brewster is in a low-risk category for West Nile Virus and far Eastern Equine Encephalitis the risk remalns remote. This is an important reminder to protect ourselves from mosquito bites. 3. Citizen's forum None 4. Covid update Mrs. von Hone stated that on a weekly basis, the Massachusetts Department of Public Health tracks the number of positive cases over a 2 -week period. Currently there are 21 positive cases in Brewster. There is usually between 7-9 new cases a week. There have been a few isolated clusters over the past few weeks in some of the businesses in town. Most cases are outside of the work environment. Barnstable County numbers are going down. Most of the cases are in young adults in their 20's who have not been vaccinated. There are cases in the higher age bracket (up to 70 years of age) that have been fully vaccinated and have had breakthrough cases. They will be available on a schedule to be released by the State and it should follow along with the same schedule as the 1 st round of vaccinations (as far as who can receive it first, etc.). Barnstable County Department of Health and Environment will be taking the lead on the booster shots. Every Thursday the County has a Covid vaccination clinic at the Barnstable County Complex from 10AM — 2PM. You can register online at the County website, or you can walk in. Only Pizer and Modern a vaccines have been approved as booster. J & J has not been approved yet. The vaccine rates are not moving up ata high rate, but for the most part, Brewster has done well with the vaccinations as well as the Cape in general. Mrs. von Hone stated that she met with the school nurses, and they are in the process of finalizing guidance and protocols for opening. Masks will be mandated for everyone through October 1St at least. The school population would need to reach an 80% vaccination rate before the mandate would be lifted. However, Brewster only has elementary schools so until they approve a vaccine for that age group the mask mandate will have to stay in place. It is al part of the power point presentation that was given to the Board on nitrogen loading about a month ago. This is In anticipation of the Planning Board approving some housekeeping items in their section of the Zoning Bylaw that relates to the Water Quality Protection District (WQPD) which oversees Zone 11(our public drinking water wells) and the District of Critical Planning Concern (DC PC) in Town. These parts of town have stricter requirements with regards to nitrogen loading, to protect our groundwater and to protect Pleasant Bay and the nutrient overload that is taking place there. The Town is mandated to mitigate and address this with the other 3 towns that are contributing nutrient loads to Pleasant Bay. information included in the packets was from the Town Planner as well as the proposed changes to the Zoning Bylaw as it relates to the WQPD. The Planning Board met last week and did not make any decision or conclusion and did not vote on the proposed changes. The housekeeping changes in the bylaw are to address some confusion that has been experienced on what would fall under these restrictions and how the nitrogen loading is calculated, because when the bylaw was written, it was based on the creation of the DCPC and a nitrogen loading calculation derived from a technical bulletin put out by the Cape Cod Commission (CCC). When the Town wrote the bylaw and passed it, they didn't take the parameters that were created in the CCC Technical Bulletin ward far word. This caused confusion when consultants and engineers had to go through the calculation of the nitrogen on a proposed project. Mrs. von Hone highlighted the changes for the Board. One of the issues discussed was to remove the parameters on how to calculate the nitrogen loading for a particular project. it was suggested to take it out of the Zoning Bylaw and put it into a Board of Health Regulation. The Health Department currently reviews nitrogen loading calculations when reviewing a septic system installation. A couple of items that were added were a more restrictive requirement for commercial properties. The draft states that SPPM would remain for residential properties and commercial properties would go down to 3PPM. This would reduce the BOH 9/1/21 Minutes Page 3 nitrogen loading by 21 %. The other addition is that if there is a project that can't meet the 5 or 3 PPM requirement, they could potentially make a payment to offset them not being able to meet the PPM. There is no draft BOH regulation yet. Mrs. Graczewski stated that she had watched the Planning Board's 8/25/21 meeting and as it was described to the members, the regulation that is being proposed for the BOH would come into play anytime there was a bylaw or regulation in Brewster that spoke to nitrogen loading requirements or thresholds. Then the regulation would describe only how the calculation is to be performed. Dr. Pearson asked about I/A technology and the offset fee. Mrs. von Hone stated that she is unsure if this would be part of this bylaw change. 6. The entire Iot is surrounded by Schoolhouse Pond. It had a Title 5 Inspection done in July, which passed. Further information was received later that revealed the leaching was closer than 300` to the pond. The system is upgradient of 5chooIhouse Pond and is approximately 220` from the edge of the pond. The system was installed in 2000. Based on the elevation of the septic system above groundwater, the location of the system from the pond in addition to the system being designed so that it is parallel to the pond shoreline and has a pump, Mrs. von Hone would give her approval for this. Covid update Mrs. von Hone stated that she is still tallying data on a weekly basis and utilizing the VEVA for initial contact with any positive Brewster cases, including close contacts that result from the positive tests. Brewster seems to be on the downward side of the 4th surge that it's been in. The Town is hovering around 6-10 cases weekly. Over the last 1 Y2 months most of the cases are in the older population. 7+ cases have popped up in the long-term care facilities in the last few weeks. The biggest concern is the holiday season coming up. People are still being advised to get vaccinated and to get the booster shot. The schools are doing a great job of keeping Covid out of there. Dr. Pearson asked how the long-term care facilities are doing with getting their residents the booster shot. Mrs. von Hone stated that the State is setting up avenues through large scale pharmacies to help them. Mrs. von Hone stated that Mad ern a and Johnson & Johnson rooster shots were approved today. 6. Flu Clinic update Mrs. von Hone stated that the annual drive-thru flu clinic eras held on 10/15/21. It went very well. 236 people participated. This was also operated as an Emergency Response Dispensing Drill, which helps us with the practice mandates which we are required to do for emergency planning. A homebound flu clinic is also being coordinated with the VNA. She also confirmed with the schools that they will be hosting a couple of regional clinics. 7. Discussion to establish priority topics Mrs. van Hone brought this up to the Board because she wants to get a discussion started with them about other issues and topics they would like to start talking about. She suggested: wastewater issues, I/A systems in Town, how are they working, wellness programs, schools -how do we get them more involved? Dr, Pearson stated that she loves the idea of a wellness program and suggested maybe doing some collaborating with the group that will be determining the Sea Camps use. She also mentioned looking into the proximity of septic systems to flood plains. Mrs. Graczewski spoke about the Water Quality Working Group. Ms. Hol eman thought it would be helpful if the Board had continuing dialogue with the schools regarding tobacco/vaping issues. Of the many areas of interest to Cape Cod towns is the infusion of additional water infrastructure funds. It is important to note that the law uses existing formula -based programs to allocate funds to the states for projects. In this instance that means the bulk of assistance— $11 billion nationally for water and wastewater projects of which roughly $1 billion over five years will come to Massachusetts—will come through the State Revolving Fund (SRF) managed by the Massachusetts Clean Water Trust and MassDEP. SRF funds go to towns that propose water- projects that compete on a statewide basis for funding. The extra $1 billion will actually end up supporting more than $1 billion in projects because Massachusetts leverages federal funds through the bond markets and uses the bond proceeds to fund projects. The infrastructure law mandates that 51% of the funds support loans and 49% be used for principal forgiveness (i.e. it will be the equivalent of a grant) on an aggregate basis. It remains to be determined how much forgiveness will apply to individual projects and so the exact amount of forgiveness is not yet known. The principal forgiveness, the formula for which has yet to be developed, will rely on a town having an SRF loan. As with the eligibility for the Cape and Islands Water Protection Fund 25% loan forgiveness subsidy, a town has to have a project with an SRF loan to obtain this support. The new principal forgiveness will be in addition to what is provided to the Cape SRF towns from the Cape and Islands Fund, all of which means projects proposed and financed over the next five years that obtain SRF loans almost assuredly will see subsidies greaterthan 25%. In addition to the infrastructure Bill funding above, there are other federal funds that will be available to support the work of Cape Cod towns. The American Rescue Plan Act (ARPA) allocated about $89 million to the SRF program that will make the funding pie larger. Plus, it appears that a portion of the ABPA funds allocated to Barnstable County will be sent to the towns on a prorated basis that can be dedicated—as is possible with local ABPA funds—to water quality projects. The need for action in Massachusetts is clear and recently released state -level data demonstrates that the Infrastructure Investment and Jobs Act will deliver for Massachusetts. Massachusetts can also compete for the $12.5 billion Bridge Investment Program for economically significant bridges and nearly $16 billion of national funding in the bill dedicated for major projects that will deliver substantial economic benefits to communities. Broadband internet is necessary for Americans to do their jobs, to participate equally in school learning, health care, and to stay connected. Yet 11% of Massachusetts households do not have an internet subscription, and 2% of people in Massachusetts live in areas where, under the FCC's benchmark, there is no broadband infrastructure. Under the Infrastructure Investment and Jobs Act Massachusetts will receive a minimum allocation of 100 million to help provide broadband coverage across the state including providing access to the at least 137,000 people in Massachusetts who currently lack it. Additionally, the review found unvaccinated residents are five times more likely to become infected than fully vaccinated residents (two doses of the Moderna or Pfizer vaccine or one dose of Johnson & Johnson) and unvaccinated residents are 31 times more likely to become infected than fully vaccinated residents who have received a booster. The review also found that 99.9% of breakthrough cases among fully vaccinated people under the age of 60 did not result in death. Among the breakthrough cases for residents over the age of 60, 97% did not result in death, No deaths have been reported in breakthrough cases among those under age 30. "The data are clear. This review shows that fully vaccinated people in Massachusetts have near -universal protection from severe illness and death and that boosters are demonstrating even stronger protection from COVID," said Health and Human Services Secretary Marylou Sudders.
