HomeMy Public PortalAbout130_030_44-2011 Sec. 70-30 water shut off 08.31.11 highlighted (2) ORDINANCE NO. 44-2011 AN ORDINANCE TO AMEND THE CODE OF ORDINANCES PERTAINING TO SECTION 70-30 FOR THE CITY OF TYBEE ISLAND, GEORGIA WHEREAS, the duly elected governing authority for the City of Tybee Island, Georgia, is authorized under Article 9, Section 2, Paragraph 3 of the Constitution of the State of Georgia to adopt reasonable ordinances to protect and improve the public health, safety, and welfare of the citizens of Tybee Island, Georgia, and WHEREAS, the duly elected governing authority for the City of Tybee Island, Georgia, is the Mayor and Council thereof, and WHEREAS, the governing authority desires to adopt ordinances under it police, zoning, and home rule powers, and WHEREAS, the City of Tybee Island so as to amend in particular Section 70-30 pertaining to the shut off of water for violation of regulations, and NOW, THEREFORE, it is ordained by the governing authority of the City of Tybee Island that Section 70-34 relating to the shut off of water for violation of regulations shall be amended so as to clarify the rules applicable to the turning off or shutting off of water generally and hereafter such section shall read as follows: Sec. 70-30. Turning on or shutting off water generally; shut off for violation of regulations. No person shall be allowed to turn on or shut off the water in any of the pipes or mains of the city without a permit or proper authority from the city. The supply of water may be withheld from all premises when the ordinances, rules, or regulations adopted by the Mayor and Council have, in any manner, been violated and the city reserves the right at any time, without notice, to shut off the water in its mains for purposes of making repairs or extensions or other necessary purposes. The city further reserves the right to shut off water at any time the provisions governing water service are violated. 1. Effect of turning on service. The turning on of water service and/or the providing of water service to any premises shall mean that the applicant has agreed to comply with ordinances, rules and regulations of the city as relating to utility services. The applicant shall be responsible for ensuring there are water fixtures within the premises ___________ prior to water service being turned on by the city. It is the intention of the governing body, and it is hereby ordained, that the provisions of this ordinance shall become and be made a part of the Code of Ordinances, City of Tybee Island, Georgia, and the sections of this ordinance may be renumbered if necessary to accomplish such intention. This Ordinance shall become effective on ________ day of __________________, 2011.
