' The Board pf Public Works and Safety of the City of Richmond, Indiana, met in regular session 'in its office in the City Building in said City, Friday, August 26, 1949, at 8:00 oeclock A.M. (C.S.T.). Mr. H.G. Coleman presiding with the following members being present: MR. Wm. E. Ross and Mr. C.M. Haworth. The following proceedings were had, to- wit: II/ . On motion duly made, seconded and carried unanimously, the minutes of the previous meeting were dispensed with. On recommendation of the Sanitary Inspector, the Board unanimously approved the closing of the toilets in the Market House building. The Board also approved the placing of dwPn&aduiping" sign on the Market House lot. Dr. Decker appeared before the Board and was advised to use more precattion in the future with the disposal of waste water from his dog hospital. Plans will be made for the inseallation of a "sanitary sewer in this area in the future. The request of the Fire Dept. of placing stickers on the parking meters, advertising the Fire Prevention Week, starting Oct9,19149, was taken under advisement. On recommendation of the Park Supt., the Board approved the removal 4of'a tree at 122 South 7th. Street and 2006 South A Street and the topping of one at 40 S. 18th St. The Board granted permission to J. Niewoehner to cut the curb in front o.f Lot #11, Bealview Addition. The Board authorized the Clerk to notify the St. Comm. to repair South 7th Strret, be- tween South 0 and South Q Streets, and also South 8th Street, between So. 0 and Q, Streets. The Jr. Chamber of Commerce was advised to contact the Ind, State Highway for permission to erect a wrecked automobile in the parkway at the intersection of W. 1st & Natal Road. The Board approved the request of the Onyx Club of staging a parade on Sept 25, 1949. The petition received from the White Kitchen, Inc., The Fire Proof Door Co. , requesting the vacating of Indiana Ave. , eastwardly from N.W. 5th St. to N.W. 4th St., was referred to the Engineering Dept.. for plans for a Declaratory Resolution. at The Board confirmed Imp. Res. #921E-1949.. aq ,: The Board held the second hearing on Imp Res. #925,926,927 and 931-1949. There were no remonstrances filed or presented. The Board confirmed all the above Imp. Res. The Clerk to prepare the advertising to receive sealed propesals Sept.16,19149, at 10:00 A.M. i IIIImp. Res. +929 and 930-194+9 still under advisement. Imp. Res. #932-191.9 public hearing to be held Sept. 23,1949, at 10:00 A. I. (D.S.T.) The Secretary of the Board also pre- • sented acknowledgement od service of said notice on Park T. Ammerman, President of the Board of Commissioners of Wayne County, and acknowledgement of service of said notice - on T.A. Greenstreet, local agent fot the Chesapeake and Ohio Railway Company. Said notice, proof of publication, and proofs of service having been examined and found to be in due form of law, were approved and ordered filed. Mr. Coleman stated that the Board was now ready to hear all persons interested in said matter, and to consider all objections or remonstrances to the plans, specifications and estimates of cost of said project heretofore filed by the Chesapeake and Ohio Rail- way Company and the City of Richmond. . . The Board. of Commissioners of the County of Wayne was represented at the hearing by Park T. Ammerman, and the Chesapeake and Ohio Railway Company was represented by Albert Cole and M.I. Dann. No written remonstrances were filed with the Board, and no oral objections weee made by any person at the hearing. After further `consideration of the plans, specifications, estimates for said grade separation pi;oject heretofore filed by the Chesapeake and Ohio Railway Company and the City of Richmond, on motion made by Mr. Haworth, secondee by Mr. Ross and car- rie unanimously, the following resolution was adopted RESOLUTION CONFIRMING THE NORTH D STREET GRADE SEPARATION PROJECT. W't REAS, on March 25,1949, this Board adopted a resolution providing for a grade sep- aration project at the point where North D Street is intersected by the tracks of the Chesapeake and Ohio Railway Company, and thereafter the notices and proceddings required by Chapter 221 of the Acts of 1921 were duly given, served and had, resulting in the filing of plans, specifications and estimates for said project by the City of Richmond and the Chesapeake and Ohio Railway Company, as provided by said statute; and WHEREAS, notice of the adoption of said grade separation resolution on March 25, 1949, and of the filling of such plans, specifications and estimates of the cost of the work to be performed has been duly published, and served on the Board of Commissioners of - the county of Wayne and the Chesapeake and Ohio Railway Company, and for the purpose of considering any objections or remonstrances by persons interested in or affedted by said project, a hearing has been held and no objections or remonstrances to said project or to said plans, specficatmions and estimates have been made to or filed with this Board;and WHEREAS, this Board, being duly advised, now finds that said grade separation project is - necessary and will be of benifit to the City of Richmond, Wayne County, and their in- habitants, and will be of benifit to the Chesapeake and Ohio Railway Company; that the plans and specifications filed by the City of Richmond and the Chesapeake and Ohio Rail- way Company for said project are satisfactory, and that the estimates of cost of con- struction filed by said parties are reasonable and proper;- and that the grade srpration resolution adopted by this Board on March 25, 1949 should be confirmed; now therefore, BE IT RESOLVED by the Board of Public Works and Safety of the City of Richmond, Indiana, that the resolution adopted by this Board on March 25, 1949, providing for a grade sep- aration project at the point on North D Street where said street istinterbected by the tracks of the Chesapeake and Ohio Railway Company be and the same is hereby confirmedvas adopted. RESOLVED FURTHER that the plans, specifications and esimates for said project as fil- .ed with .this Board by the City of Richmond and the Chesapeake and Ohio Railway. Comp- any be and the same are approved as filed. RESOLVED FURTHER that the construction of said project shall begin within thirty (30) days after written notice by this Board to the Chesapeake & Ohio Railway Company that said project has been approved by the Common Council of the City of Richmond, and that the City of Richmond and Wayne County have made or are making provision for the payment of their portions of the cost of said project; that the construction of said project shall be complied within six months (6) after the date of service of said notice, unless otherwise ordered by the- Board. 3gS-A RESOLED FURTHER that a copy of this resolution, certified by the Secretary of the Board, be filed with the„Clerk of Richmond for presentation to the Common Council of • said City, and that the Common Council be requested ,to approve or disapprove the construction of said project'as required by law.
