HomeMy Public PortalAbout05-06-1949 - Special Meeting • t 3'5 L.+ MINUTES OF A SPECIAL MEETING OF THE BOARD OF PUBLIC .WORKS IORKS AND SAFETY-, MAY 6, 1949. - A Special meeting of the Board of Public Works and Safety of the City of Richmond,. Indiana was held at the office of said Board in the City Hall in said City at the hour of 10:00 o'clock A.M. c.s.t. , on May 6, 1949, pursuant to notice of the hearing to -be -held at -said .time -and place relative to pro- - posed alteration of the grade crossing at the point where the tracks of The Chesapeake and Ohio Railway Company Icross North D Street. There were present at the meeting Harold G. Coleman, City Controller, W. Edwin Ross, City Engineer, and Clifford M. Haworth, City Attorney, constitut- ing the Board of Public Works and Safety; also R. Allen Crye, County Auditor, and John Brubaker, County Attorney for Wayne County, Indiana, representing Wayne County, and Albert H. Cole, M.I. Dunn, and W.R. Talbott, representing The Chesapeake and Ohio Railway Conpany. Proof of publication of the notice of the hearing to be held at this meet- ing was presented to the Board, showing that said notice had been published on the lath and 25th days of April, 1949, in the Pallidium-Item, the only newspaper of general circulation printed and published in the City of Rich- mond aid of general circulation in the County. There was also presented to the Board acknowledgement of service showing that copies of said notice had been delivered in person to R. Allen Crye, Auditor of Wayne County, on the 16th day of April, 1949 and T.A. Greenstreet, Resident Ageht of The Chesa- peake and Ohio Railway Company on the 19th day of April, 1949. On motion duly made, seconded and carried, said notice and proof of pub- lication .and service thereof were approved and ordered made a part of the minutes of this meeting by attaching a copy of the same to the minutes of this meeting. - • - - The Secretary of the Board then read to the meeting the resolution adopted by the Board of Public Works and Safety on the 25th day of March, 1949, pro® viding for the alteration of a grade crossing at the point where the tracks of The Chesapeake and Ohio Railway Company cross North D Street in the City of Richmond, such alteration to .consist of the depression of said railroad tracks and an elevation of the grade of North D Street. - The President of the Board stated that the Board was now ready to consider any written remonstrances and hear all interested persons desiring to be heard. No written remonstrances were filed, and the representaives of the County and Railway Company indicated' that they have no objection to the proposed - project. Various property owners whose property will be affected by the pro- ject were heard, and a general discussion of the project was had. After hearing all parties desiring to be heard, on motion duly made, sec- onded and unaimously carried, the following resolution was adopted. RESOLVED by the Board of Public Works and Safety of the City of Rich- mond that the resolution adopted by this Board on the 25th day of March, 1949, providing for a grade separation on North D Street in said City at a point where the tracks of The Chesapeake and Ohio Railway Company cross said street, be and the same is hereby confirmed, and that said project be and the same is hereby declared to be of public necessity and convenience. RESOLVED FURTHER that certified. copies of said resolution and this res- olution be filed wi tih the City Clerk for presentation to the Common Council and that such filing shall consitute the request of this Board to the Council for approval of such resolution and the grade project referred to therein.
